Farmer, a person substantially engaged in the occupation of farming which shall include, but not be limited to, farming in all its branches, the cultivation and tillage of the soil, dairying, the production, cultivation, growing and harvesting of any agricultural, aquacultural, floricultural or horticultural commodities, the growing and harvesting of forest products upon forest land, the raising of livestock including horses, the keeping of horses as a commercial enterprise, the keeping and raising of poultry, swine, cattle and other domesticated animals used for food purposes, bees, fur-bearing animals, and any forestry or lumbering operations, performed by a farmer engaged in agriculture or farming as herein defined, or on a farm as an incident to or in conjunction with such farming operations including, but not limited to, preparations for market, delivery to storage or to market or to carriers for transportation to market.

If the farm truck or truck tractor being titled is new or from out-of-state, Form MV-1, "Application for Certificate of Title," must be completed by an authorized agent and a Pennsylvania inspection mechanic or an authorized agent, with an "83" dealer identification number or higher, must verify the vehicle's weight and Vehicle Identification Number (VIN). Proof of ownership in the form of a Manufacturer Certificate/Statement of Origin (MCO or MSO), previous certificate of title, court order, or transferable registration card for the vehicle, must be presented.

Forms MV-1 and MV-4ST, are completed by authorized agents. These authorized agents will be able to complete an application for title and issue you a temporary registration. Farm vehicles that meet the requirements of a Type A, Type B, Type C or Type D vehicle (described below) may qualify for exemption from registration. In order for your vehicle to be exempt from registration, however, you must obtain a biennial (two-year) certificate of exemption for that vehicle. The fee(s) for obtaining a Type A through Type D certificate of exemption can be found on Form MV-70S, "The Bureau of Motor Vehicles Schedule of Fees." To apply for a certificate of exemption, complete Form MV-77A (PDF), "Application for Farm Vehicle 2-Year Certificate Of Exemption." Vehicle requirements and instructions for completing the form are listed on the form.

Type A Vehicles - Type A farm vehicles are vehicles that have a gross vehicle weight rating or gross combination weight rating of 10,000 pounds or less. Farm vehicles with a Type A exemption are not required to bear a valid inspection certificate. A vehicle with a Type A exemption may only be driven on the highway between sunrise and sunset, and is restricted in use to:

Type B Vehicles - Type B farm vehicles are vehicles that have a gross vehicle weight rating or gross combination weight rating of 10,001 pounds to 17,000 pounds. Farm vehicles with a Type B exemption are not required to bear a valid inspection certificate. A vehicle with a Type B exemption may only be driven on the highway between sunrise and sunset, and is restricted in use to:

Type C Vehicles - Type C farm vehicles are vehicles that have a gross weight or gross combination weight rating greater than 17,000 pounds. Farm vehicles with a Type C exemption are not required to bear a valid inspection certificate. A vehicle with a Type C exemption may only be driven on the highway between sunrise and sunset, and is restricted in use to:

Type D Vehicles - Type D farm vehicles are vehicles that have a gross weight or gross combination weight rating greater than 17,000 pounds. Farm vehicles with a Type D exemption are required to bear a valid inspection certificate. However, a Type D vehicle with a valid inspection certificate may be operated at any time of day or night. Vehicles with a Type D exemption are restricted in use to:

Pennsylvania law also requires that registration-exempt farm vehicles maintain the minimum levels of liability insurance. Farm vehicles need not be covered under an individual automobile policy if the vehicle is covered under the farm policy. Check with your insurance agent to see if your current policy covers your farm trucks or truck tractors.

To apply for a certificate of exemption, you will need to complete Form MV-77A (PDF), "Application for Farm Vehicle 2-Year Certificate of Exemption." Portions of your most current income tax return filing demonstrating you are engaged commercially in farming must be attached to the form. The copy of the income tax return filing attached to the Form MV-77A (PDF), must show the business activity code or business activity description. Specific income information filed in the original return may be blacked out. If you do not have a copy of one of these income tax forms with your Form MV-77A (PDF) application, you will not qualify for a certificate of exemption.

If your vehicle does not meet the requirements of a Type A, Type B, Type C or Type D vehicle, it must be registered. However, if it meets the following requirements, it can be registered as a farm vehicle bearing special farm truck registration plates.

There are no distance limitations for registered farm vehicles. Please refer to Form MV-70S (PDF), "The Bureau of Motor Vehicles Schedule of Fees," for the most current registration fees for farm trucks.

Any farm truck not exempt from the registration requirements due to the nature of farm operations may be registered for only the months of the year the vehicle is in use. To be eligible, the vehicle must have a gross vehicle weight rating of less than 14,000 lbs. Insurance is not required for the months of the year the vehicle is not registered. Pennsylvania is a member of the International Registration Plan, which streamlines registrations of trucks operating in more than one state so that a truck owner is able to obtain one registration honored in all states. The IRP does not require, however, that a state recognize another state's restricted use plate. In order to operate a farm truck in any other state, you should check with that state prior to operating their vehicle in that state.

Proof of insurance is required. Agricultural class vehicles and trailers registered with an agricultural registration and plate are required to maintain NYS automobile liability insurance coverage (insurance requirements).

The owner of the vehicle must submit a Certification of Farm Vehicle Routes (PDF) (MV-260F), with the original registration application and at renewal if the route has changed.

Vehicle inspection is not required for farm registration, but the Vehicle & Traffic Law requires that farm vehicles be equipped with signaling devices, reflectors and lamps that are in good working condition. If a 1973 or newer junk vehicle is registered as a Farm Vehicle, it must be inspected by DFI.

You will also be required to register your livestock premises location so that you can submit the fish farm registration. Please call 888-808-1910 or go to the website and register yourself at www.wiid.org. Take the seven-digit livestock premises code, and place it on page 3 of the fish farm registration application before submitting it for approval.

An owner is not required to register a farm trailer or farm semitrailer that has a gross weight of 4,000 pounds or less. A vehicle owner may obtain a "FARM TRAILER" license plate for a farm trailer or farm semitrailer with a gross of more than 4,000 pounds but not more than 34,000 pounds. The fee for a "FARM TRAILER" license plate is $5.00 per year. A farm trailer or farm semitrailer with a "FARM TRAILER" license plate is exempt from the state inspection certificate requirements. "FARM TRAILER" license plates may only be used on farm trailers and farm semitrailers used exclusively to transport

Farm Semitrailers are issued a permanent license plate that do not display an expiration date (no expiration stickers). However, they are required to be renewed each year on or before the expiration date printed on the registration card. Farm Semitractors are not registered with a declared gross weight.

Certain vehicles registered as commercial vehicles may be operated for farm purposes. While being operated for farm purposes, it is not necessary to switch from the commercial license plate to a farm license plate. The registrant of the vehicle may complete the Certificate of Designation as a Covered Farm Vehicle and carry the certificate in the vehicle while operating as a farm vehicle. This form allows the operator of the commercial vehicle to utilize the farm vehicle exemptions outlined in Federal Code 49 CFR 390.39 and must be carried in the vehicle at all times when being operated for farm purposes.

Farms covered under the Produce Safety Rule are recommended to register their farm with the State of Indiana. Farm registration is free and is easy. Maintaining registrations of produce growers will enable IDOH to quickly identify and contact farms that may be involved in outbreaks, recalls, food defense threats, or other public health emergencies. Registration information will also allow investigators to rule out farms potentially implicated in the outbreak, preventing greater loss of product and consumer confidence. Re-registration is not required unless there are changes to ownership, character of business, or location of business take place. Registration will also allow IDOH to send you updated good agricultural practices information. When you register your farm with IDOH, you will receive a frameable certificate of registration.

Until 1977, regulations required farmers to properly pack size, and label their fresh fruits, nuts, and vegetables in standard containers to transport and sell in markets anywhere other than the farm site.
