Welcome to Ballnova. These Terms and Conditions explain the rules that apply when you access or use the Ballnova application and related services.

By using Ballnova, you confirm that you have read and understood these Terms and agree to follow them. Please read them carefully before using the Service.

1. About Ballnova

Ballnova is a mobile application operated by DERC GAMING STUDIO, DREC (PRIVATE) LIMITED, located at Flat 2, Block 71-B, Street 15, G-9/2, Islamabad, Pakistan.

Throughout these Terms, the words “Ballnova,” “Company,” “we,” “us,” and “our” refer to DERC GAMING STUDIO, DREC (PRIVATE) LIMITED.

The word “you” refers to anyone who accesses or uses Ballnova.

These Terms apply to the Ballnova application, its features, content, and any related services that we make available through the application.

2. Eligibility

Ballnova is intended for users who are 18 years of age or older.

By accessing or using the Service, you confirm that you meet this age requirement and that you are legally permitted to use the Service under the laws applicable to you.

We do not knowingly allow individuals under the age of 18 to access or use Ballnova.

If you do not meet the eligibility requirements, you must stop using the Service.

3. Accepting These Terms

Your use of Ballnova is subject to these Terms and our Privacy Policy.

By accessing, browsing, or using any part of the Service, you agree to these Terms. If you do not agree with them, please do not use Ballnova.

These Terms, together with any policies or rules specifically referenced in them, form the agreement between you and the Company regarding your use of the Service.

You agree to use Ballnova responsibly and only for purposes that are permitted by these Terms and applicable law.

When using the Service, you must not:

• Use Ballnova in violation of any applicable law or regulation.

• Attempt to interfere with the normal operation or security of the Service.

• Introduce viruses, malicious code, or other harmful material into the Service.

• Attempt to gain unauthorized access to our systems, servers, accounts, or other users' information.

• Copy, modify, distribute, sell, or commercially exploit the Service or its content without our permission.

• Use automated tools or other methods intended to manipulate, disrupt, or abuse the Service.

• Attempt to bypass any technical restrictions or security measures implemented by the Company.

We may take reasonable steps to protect Ballnova and its users when we identify activity that may violate these Terms.

5. Application and Device Requirements

Ballnova may be downloaded through an applicable Application Store, including the Apple App Store or Google Play Store.

You are responsible for providing a compatible device, internet connection, and any other equipment or services necessary to access the Application.

The availability and functionality of certain features may vary depending on your device, operating system, location, Application Store, or other technical conditions.

Application Store providers may have their own terms and policies. Your use of Ballnova remains subject to those requirements where applicable.

6. Intellectual Property

Ballnova and its original content, features, design, graphics, interface, trademarks, logos, software, and other materials are owned by or licensed to the Company and are protected by applicable intellectual property laws.

Unless we expressly authorize you to do so, you may not reproduce, modify, publish, distribute, sell, license, reverse engineer, or otherwise exploit any part of the Service.

Using Ballnova does not transfer ownership of any intellectual property to you. You receive only the limited right to use the Service in accordance with these Terms.

7. Third-Party Services and Links

Ballnova may include links to third-party websites, platforms, services, or content.

These third-party services are operated independently from the Company. We do not control their availability, content, security, privacy practices, or policies, and we do not guarantee the accuracy or reliability of information provided by them.

If you choose to access a third-party service, you do so at your own discretion. Your use of that service will be governed by its own terms and privacy policy.

The Company is not responsible for losses or damages resulting from your interaction with third-party services to the extent permitted by applicable law.

8. Service Availability

We work to keep Ballnova available and functioning properly, but we cannot guarantee that the Service will always be available or uninterrupted.

The Service may occasionally be unavailable because of maintenance, updates, technical issues, network problems, security incidents, or circumstances beyond our reasonable control.

We may also update, modify, suspend, or discontinue features of Ballnova when reasonably necessary.

9. Suspension and Termination

We may restrict, suspend, or terminate your access to Ballnova if:

• You breach these Terms;

• You use the Service in a way that may harm Ballnova, the Company, or other users;

• We are required to do so by applicable law or a competent authority; or

• We reasonably believe that continued access presents a security, legal, or operational risk.

Where appropriate, we may provide notice before taking action. However, we may act immediately when circumstances require it.

Once access is terminated, your right to use the Service will end.

10. Disclaimer of Warranties

Ballnova is provided on an “AS IS” and “AS AVAILABLE” basis, to the maximum extent permitted by applicable law.

We do not guarantee that:

• the Service will always be available or uninterrupted;

• the Service will operate without errors;

• all information provided through the Service will always be complete, accurate, or current;

• the Service will meet every user's individual requirements; or

• technical issues or defects will always be corrected.

To the extent permitted by law, the Company disclaims warranties that are not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Nothing in these Terms is intended to exclude or limit any consumer rights or other protections that cannot legally be excluded under applicable law.

11. Limitation of Liability

To the maximum extent permitted by applicable law, the Company and its suppliers will not be responsible for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of, or inability to use, Ballnova.

This may include loss of data, loss of profits, business interruption, or other similar losses.

To the extent that the Company is legally responsible for a claim relating to the Service, the Company's total liability will be limited to the amount you actually paid through the Service during the relevant period or USD 100, whichever is applicable.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

12. Privacy

Your privacy is important to us.

Our Privacy Policy explains what information we collect, how we use it, how it may be shared, and the choices available to you.

By using Ballnova, you acknowledge that you have had an opportunity to review our Privacy Policy.

13. Governing Law

These Terms are governed by the laws applicable in Pakistan, without regard to conflict-of-law principles.

Your use of Ballnova may also be subject to mandatory laws and regulations applicable in the jurisdiction where you access or use the Service.

If any provision of these Terms conflicts with a mandatory legal requirement that applies to you, that mandatory requirement will take precedence to the extent required by law.

14. Resolving Disputes

If you have a concern about Ballnova or believe that a dispute has arisen between you and the Company, we encourage you to contact us first so that we can try to resolve the matter informally.

Nothing in this section prevents either party from exercising rights or seeking remedies that cannot legally be waived under applicable law.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be interpreted or adjusted to the extent necessary to make it enforceable, where legally possible.

The remaining provisions will continue to apply and remain in effect.

16. No Waiver

If we do not immediately enforce a particular provision of these Terms, this does not mean that we have waived our right to enforce it later.

A waiver of one breach does not automatically constitute a waiver of any future breach.

17. Language

These Terms may be made available in languages other than English for convenience.

If there is a conflict between the English version and a translated version, the English version will prevail to the extent permitted by applicable law.

18. Changes to These Terms

We may update these Terms from time to time to reflect changes to Ballnova, our services, applicable laws, or our business practices.

When we make significant changes, we will take reasonable steps to notify users before the updated Terms become effective where appropriate.

The updated version will include a revised “Last updated” date.

Your continued use of Ballnova after the updated Terms take effect means that you accept the revised Terms. If you do not agree with the changes, you should stop using the Service.
