In general, criminal background checks for prospective or current employees must comply with the Fair Credit Reporting Act (FCRA), as well as federal laws prohibiting discrimination. Current background check laws prohibit employers from accessing certain types of information, including military and medical records, while drug screenings and credit reports require an employer's consent. The illogical exemption of private gun sales from background checks is the very reason that criminals don't currently have to obey existing background check laws.
