Background Checks for Child Care Personnel The Department of Health and Human Services (DHHS) requires criminal history record checks, including fingerprints, for child care personnel and household members in a licensed child care program in accordance with NH law RSA 170-E:7. In addition to fingerprint background check, child care providers will need to put staff members through federal-level criminal history searches The MyNDNow article notes these checks could include in-state Bureau of Criminal Investigation (BCI) searches, Federal Bureau of Investigation (FBI) database searches, or both. In accordance with state and federal law, the Department of Early Education and Care (EEC) requires rigorous and thorough Background Record Checks to ensure the safety of children in child care programs. The State of South Carolina has contracted with MorphoTrust to provide electronic fingerprinting services for child care providers who require a state (SLED) and federal (FBI) fingerprint-based criminal history background check.
Each healthcare and child care provider must inform applicants being fingerprinted that their fingerprints will be transmitted to the Mississippi Department of Public Safety and run through the Mississippi Criminal Information and Federal Bureau of Investigation databases in order to complete state and national background checks. (i) Requirements, policies, and procedures to require and conduct criminal background checks for child care staff members (including prospective child care staff members) of all licensed, regulated, or registered child care providers and all child care providers eligible to deliver services for which assistance is provided under this part as described in paragraph (a)(2) of this section; Federal law requires all states to implement state and federal criminal background checks that include fingerprints for child care providers.
The Child Care Subsidy Program is required to complete background checks annually on all new and renewing child care subsidy providers and anyone in the household age 13 and older if care is provided in the provider's home. State law requires the Department of Early Learning (DEL) to conduct background checks on anyone who is authorized to care for or have unsupervised access to children in licensed child care facilities and ECEAP sites. The Virginia law requiring the fingerprint background checks for licensed child care providers currently includes a sunset clause that brings it back to the General Assembly for reapproval each year.
Criminal Background Check Procedures for North Carolina Child Care North Carolina Law requires that a criminal history record check be conducted on all persons who provide child care in a licensed child care facility and all persons providing child care in non-licensed child care homes that receive state or federal funds. Beginning this month, child care providers in Kansas applying for or renewing a license are legally required to submit to a comprehensive background check, including fingerprints, for each individual residing, working or regularly volunteering in a licensed child care home, daycare center or school-age program. Character, suitability, and competence to provide child care and early learning services—Fingerprint criminal history record checks—Background check clearance card or certificate—Shared background checks.
(Non-licensed providers participating in the Child Care Assistance Program (CCAP) are also impacted by these changes.) These new enhanced background studies are required by changes in federal law. Fortunately, with the reauthorization of the Child Care and Development Block Grant in 2014, states now require comprehensive background checks, including fingerprint checks, for all child care providers caring for unrelated children and for all providers receiving federal subsidies. Over the next several years, new federal law will require states to conduct criminal background checks on all child care employees that work at a licensed, license-exempt, regulated, and registered child care provider.
Code 385 Appendix A, Background Checks may only receive payment through the child care assistance program if the individual obtains a license from the Illinois Department of Children and Family Services wherein a review and assessment of the allegations and criminal charges will be made pursuant to 89 Ill.
