Terms of Service

These Terms of Service ("Terms") govern your use of BabyLeap: Milestones & Teeth (the "App"), provided by Victoria Seniuk ("Developer", "we", "us", or "our").

By downloading, purchasing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. About the App

BabyLeap: Milestones & Teeth is an educational parenting application designed to help parents and caregivers understand infant development during the first 18 months of life.

The App provides information about:

• developmental leaps and growth spurts;

• developmental milestones;

• teething progress;

• common developmental behaviors.

The App is intended solely for informational and educational purposes.

2. Eligibility

The App is suitable for users with an App Store age rating of 4+.

Although the App may be accessed by users of any age, it is designed primarily for parents, guardians, and caregivers responsible for caring for infants.

3. License

Subject to these Terms and Apple's App Store terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use.

You may not:

• copy, distribute, or sell the App or its content;

• modify or create derivative works of the App;

• reverse engineer, decompile, or attempt to extract the source code except where permitted by applicable law;

• use the App for any unlawful purpose.

All rights not expressly granted remain reserved by the Developer.

4. Purchase and Payments

BabyLeap: Milestones & Teeth is available as a one-time lifetime purchase through Apple's App Store.

Your purchase grants access to the App without recurring subscription fees.

Payments are processed by Apple through the App Store. We do not collect or process payment information directly.

Refunds are governed exclusively by Apple's refund policies and procedures. Because purchases are processed by Apple, the Developer cannot approve or issue App Store refunds.

5. No User Account

The App does not require registration or account creation.

You may begin using the App immediately after purchasing and installing it.

6. Data Storage

Information you enter into the App—including, but not limited to, your baby's name, birth date, gender, developmental progress, milestones, and achievements—is stored locally on your device.

If iCloud synchronization is enabled on your device, certain data may also be synchronized using Apple's iCloud services (NSUbiquitousKeyValueStore).

The Developer does not operate external servers for storing your baby data and does not intentionally transmit this information to external services.

7. Medical Disclaimer

The App is provided for educational and informational purposes only.

The App is not intended to provide medical advice, diagnosis, treatment, or professional healthcare services.

Every child develops differently. Developmental milestones, growth spurts, teething timelines, and behavioral changes vary significantly between children. Information provided within the App should not be interpreted as a guarantee or prediction of any individual child's development.

If you have concerns regarding your child's health, growth, development, nutrition, or medical condition, you should promptly consult a qualified pediatrician or other licensed healthcare professional.

Do not disregard professional medical advice or delay seeking medical care because of information provided by the App.

8. Intellectual Property

The App, including its software, design, graphics, illustrations, text, icons, layout, and other content, is owned by Victoria Seniuk and is protected by applicable copyright, trademark, and intellectual property laws.

Except as expressly permitted by these Terms, no portion of the App may be copied, reproduced, republished, distributed, or exploited without prior written permission.

9. Updates and Changes

We may periodically release updates to improve functionality, fix bugs, add features, or maintain compatibility with newer versions of iOS.

We reserve the right to modify, suspend, or discontinue any feature of the App at any time without prior notice.

10. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis to the fullest extent permitted by applicable law.

We make no warranties or guarantees regarding:

• uninterrupted availability;

• accuracy or completeness of content;

• suitability for any particular purpose;

• compatibility with all devices or operating systems;

• error-free operation.

While we strive to provide accurate and up-to-date developmental information, we cannot guarantee that all content will always be complete, current, or applicable to every child.

11. Limitation of Liability

To the fullest extent permitted by law, Victoria Seniuk shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of the App.

This includes, without limitation:

• reliance on developmental information;

• health-related decisions;

• loss of data;

• interruption of service;

• device malfunction;

• loss of profits or other economic losses.

To the maximum extent permitted by law, the Developer's total liability arising from your use of the App shall not exceed the amount you paid to purchase the App.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

12. Termination

These Terms remain effective while you use the App.

You may stop using the App at any time by uninstalling it from your device.

We reserve the right to terminate or restrict access to the App if you violate these Terms or applicable law.

13. Changes to These Terms

We may update these Terms from time to time.

The updated version will become effective upon publication with a revised Effective Date.

Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Ukraine, without regard to conflict of law principles.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
