In order to book I require a 25% deposit of the session to hold your booking. The rest of the session fee is due the day of the session, prior to begining.
Once the session is complete you will receive your digital gallery via email within 7 business days of the session.
NO SHOW FEES: Please note, all no shows without adequate warning (7 days prior to booked session) will be charged a $50 non-refundable fee.
SESSION FEE: The entirety of the session fee is due prior to the beginning of the session on the day of the session. Please note all payments are final. This means I offer NO refunds.
In the event of illness, I will try to work with you to reschedule if able. This does not gurantee your cancellation fee will be waived.
CONTRACT
By choosing to participate in a photography session all parties involved agree to the following terms:
THIS AGREEMENT is made as of the day of the session and is between Baby Bug Photography [Stephanie Gagnon] (Photographer) and all/any client receiving services by baby Bug Photography [Stephanie Gagnon]
Engagement of Photographer
1.1 Services. Subject to the terms set out herein, Client engaged Photographer to provide, and Photographer agrees to provide, the photography services described in this Section 1.1 (The "Services") in connection with the chosen session type in the booking information, chosen by the Client.
2. Session Fees
2.1 Fees. Client agrees to pay the pre-determined and discussed session fee at the time of the session. If payment is not received at the time of the session the client will not receive their images until the session fee has been paid in full.
3. Photographer Responsibilities
3.1 Manner of Service. Photographer will ensure that the Services are performed in good, expedient, workmanlike and safe manner, and in such a manner as to avoid unreasonable interference with Client's activities.
3.2 Safety. All reasonable efforts to maintain client safety will be made with the understanding that the Photographer cannot be held liable for any injuries occurring during or after the session.
3.3 Guaranteed Delivery. Photographer agrees to have the completed selection of digital images ready for download within 7 business days from the session date.
3.4 Archive. After 7 days, all images will be purged from the photographers hard drive, except as needed for promotional purposes only to be determined by photographer at photographer's sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond the photographer's control.
4. Artistic Release
4.1 Consistency. Photographer will use reasonable efforts to ensure that the Services are produced in a style consistent with Photographer's current portfolio, and Photographer will use reasonable efforts to consult with Client and incorporate any reasonable suggestions prior to image delivery.
4.2 Style. Client acknowledges and agrees that:
Client has reviewed Photographer's previous work and portfolio and has a reasonable expectation that Photographer will perform the Services in a similar style when possible.
Photographer will use its artistic judgement when providing services, and shall have final say regarding the aesthetic judgement and artistic quality of the services; and
Disagreement with Photographers aesthetic judgement or artistic ability are not valid reasons for termination of the Agreement or request of any monies returned.
5. Term
5.1 Refunds. Refunds will not be given for any reason, including but not limited to, poor choices of clothing, make-up or hair related issues, facial expressions/smiles/etc, not following photographer recommendations, etc. Photographer is available by email prior to the session if Client has any questions regarding clothing, or other.
5.2 Late Arrivals. In the event the Client arrives late to the agreed session, the amount of time late may be deducted from the time allotted for the session. Photographer will not provide a refund or other compensation for the time deducted from the session due to late arrival of the Client.
5.3 Rescheduling by the Photographer. If the Photographer has to reschedule the session due to illness, weather, equipment malfunction, or other circumstance beyond the Photographer's control, Photographer will make every effort to reschedule at the earliest possible date.
5.4 No Show Fees. In the event the Client does not come to their session without contact Photographer, Client will be subject to a Non-Refundable No Show Fee of $50.
6. Limited License to Client
6.1 Personal Use. Photographer hereby grants Client an exclusive, limited, irrevocable, royalty-free, non- transferable and non-sub-licensable license to use Work Product for Client's Personal Use, provided that Client does not remove any attribution notices or copyright notices included by Photographer in any Work Product. "Personal Use" includes, but it not limited to, use (i) of photos on Client's personal social media pages or profile; (ii) in Client's personal creations, such as scrapbooks, albums, or personal gifts; (iii) in non-commercial physical display; and (iv) in personal communications, such as family newsletter, email, or holiday card. Client will not make any other use of the Work Product without Photographer's prior written consent, including but not limited to use of the Work Product for commercial sale.
7. Indemnity and Limitation of Liability
7.1 Indemnification. Client agrees to indemnify, defend and hold harmless Photographer and its affiliates, employees, agents and independant contractors for any injury, porperty damage, liability claim or other cause of action arising out of or related to the Services and or Work Product Photographer provides to Client.
7.2 Failure to Perform. If the Photographer is unable to perform this agreement due to illness, emergency, fire casualty, strike, act of God or causes beyond the control of the Photographer, the Photographer and Client shall make every reasonable attempt to reschedule the session. Client shall have no further liability. Further, if the Photographer is unable to deliver photographic materials due to technological malfunctions, including but not limited to camera and processing, or otherwise lost of damaged without fault of the Photographer, liability shall be limited to the total fees paid under this agreement.
7.3 Failure to Deliver. Photographer shall not be held liable for delays in the delivery of such Work Product, or any Work Product undeliverable, due to technological malfunctions, service interruptions that are beyond the control of the Photographer (including as a result of delays in receipt of instructions from Client) and for Work Product that fails to meet the specifications set out in section 1.1 due to the actions of Client or participants at the selected session that are beyond control of the photographer.
7.4 Maximum Liability. Notwithstanding anything the contrary, Client agrees that photographers maximum liability arising out of or related to the services, or the Work Product shall not exceed the total Fees Payable under this agreement.
In proceeding with a booking Client agrees to these terms and gives implied consent to begin session.
