This Privacy Policy explains how Avatravel Limited (“we”, “us”, “our”) collects, uses and protects personal information about drivers who use the Avadrive mobile application and related services (the “Driver App”).
This Privacy Policy applies only to drivers using the Driver App. A separate privacy policy will apply to passengers (if and when a passenger app or booking channel is launched).
We are the data controller for the personal data described in this Privacy Policy. We are established in Ireland and subject to the EU General Data Protection Regulation (GDPR) and applicable Irish data protection law.
Avadrive collects only the driver and trip information needed to operate the service, ensure safety and comply with Irish legal requirements, and we handle this data in line with GDPR and our Driver Privacy Policy.
If you do not agree with this Privacy Policy, you should not use the Driver App.
We collect and process the following categories of information about you when you register for and use the Driver App:
1.1 Registration and account information
Full Name
Contact details (such as email address and phone number)
Language or other profile preferences
Business details where relevant (for example, trading name or VAT number)
1.2 Driver and vehicle documentation
To confirm that you are legally allowed to provide transport services, we may collect:
Driving licence details
National Transport Authority (NTA) / SPSV licence details and related identifiers
Proof of insurance and policy details
Vehicle details (for example registration number, make/model, NCT status)
Any other documentation required by applicable transport or licensing laws
1.3 Trip and usage information
When you use the Driver App, we may collect:
Details of Trips you accept and complete (pick-up and drop-off areas, dates, times, distance, duration)
Booking, acceptance and cancellation history
Information related to your performance and reliability (for example, acceptance and cancellation patterns, completion of Trips)
Passenger feedback and rating scores about you, where such features are enabled
Information from communications sent through the Driver App (for example, messages with our support team)
1.4 Location data
When you are online in the Driver App and available for Trips, and during Trips, we may collect and process location data from your device, such as:
Your approximate or precise GPS location
Movement and route information during a Trip
You can usually control location permissions in your device settings, but if you disable location sharing, you may be unable to receive or complete Trips via the Driver App.
1.5 Technical and device information
We also collect technical information needed to operate and secure the Driver App, such as:
Device type and unique device identifiers
Operating system and app version
IP address, time zone and language settings
App event logs and diagnostic data (for example, crashes or connection issues)
1.6 Payment and financial information (limited)
For the purpose of paying you for Trips (where applicable), we may process:
Bank account or payment account details that you provide
Payout records and related transaction references
We do not store full credit or debit card numbers used by passengers; those are handled by our payment partners where applicable.
1.7 Information from feedback and support
If you contact us (for example by email or through in-app support), we may process:
The content of your enquiry or complaint
Follow-up communications and notes about how the matter was resolved
Where passengers submit feedback or complaints about Trips, we may also receive information about you in that context.
We use your personal information for the following purposes and legal bases:
2.1 To provide and operate the Driver App
Creating and managing your driver account
Allowing you to receive and manage Trip requests
Displaying relevant Trip information within the Driver App
Legal basis: Performance of our contract with you; our legitimate interests in operating our platform and services.
2.2 To verify eligibility and comply with transport laws
Checking that your licences, insurance and vehicle documents are valid and appropriate
Complying with Irish transport and licensing laws (for example Taxi Regulation Acts and SPSV Regulations)
Legal basis: Compliance with legal obligations; our legitimate interests in ensuring that only eligible, compliant drivers use the platform.
2.3 To record and manage Trips and payments
Recording Trip details (times, distances, completion status)
Facilitating calculations of amounts due under your driver agreement or contract
Maintaining booking, payout and invoice records
Legal basis: Performance of our contract with you; compliance with legal and tax obligations.
2.4 To ensure safety, quality and prevent misuse
Monitoring Trip data, cancellations and feedback for safety, service quality or misuse
Investigating incidents, complaints or suspected fraud or misuse
Enforcing our Terms & Conditions and any driver agreement (for example, suspending accounts where appropriate)
Legal basis: Our legitimate interests in ensuring safety, service quality and protecting our business, drivers and passengers.
2.5 To communicate with you
Sending service messages about your account, Trips, technical issues or updates to our Terms or policies
Responding to your requests, questions or complaints
Legal basis: Performance of our contract with you; our legitimate interests in running our services and maintaining relationships with drivers.
2.6 To comply with legal and regulatory obligations
Responding to lawful requests from regulators, tax authorities, law enforcement or courts
Keeping accounting records and complying with tax, transport and company law requirements
Legal basis: Compliance with legal obligations.
We do not use driver data for unrelated marketing without your consent. If we ever wish to send you marketing communications, we will ask for your permission or give you a clear way to opt out.
Under data protection law (including GDPR), you may have the following rights in relation to your personal information:
Right of access – to obtain confirmation whether we process personal data about you and to request a copy.
Right to rectification – to request correction of inaccurate or incomplete information.
Right to erasure – to request deletion of your personal data in certain circumstances (for example where it is no longer needed for the purposes described above).
Right to restriction – to request that we limit the processing of your data in certain cases.
Right to data portability – to receive certain personal data in a structured, commonly used and machine-readable format and to have that data transmitted to another controller where technically feasible.
Right to object – to object to certain types of processing based on our legitimate interests, on grounds relating to your particular situation.

You also have the right to lodge a complaint with the Data Protection Commission (DPC) in Ireland if you are unhappy with how we handle your personal data. Their contact details are available on the DPC website (www.dataprotection.ie).
We may share your personal information with:
Service providers and partners who help us operate the Driver App and related services (for example platform and dispatch system providers, IT hosting and cloud infrastructure providers such as data centres, customer support tools and payment processors). These providers act on our instructions and are bound by appropriate contracts and data protection safeguards.
Transport operators or business partners where you provide services on behalf of or under the umbrella of a partner operator, to the extent necessary to manage Trips and payments.
Regulators, law enforcement and authorities where we are legally required to do so, or where sharing is necessary to protect our rights, safety, or the rights and safety of others.
Professional advisers (such as lawyers, auditors or insurers) where necessary in connection with our legitimate business interests.
Purchasers or successors in the context of a business sale, merger or corporate transaction, subject to appropriate safeguards.
We do not sell your personal data.
As a general rule, we aim to store your personal data within the European Economic Area (EEA).
However, some of our service providers and technology partners may be located outside the EEA, or may store or access personal data from outside the EEA (for example in connection with cloud hosting or support services).
Where we transfer personal data outside the EEA, we will ensure that appropriate safeguards are in place, such as:
An adequacy decision by the European Commission; or
Standard contractual clauses approved by the European Commission, together with any additional measures required.

We keep your personal data only for as long as necessary for the purposes described in this Privacy Policy, including:
For the duration of your driver account and a reasonable period afterwards;
As required to comply with legal, tax, accounting and regulatory obligations;
For the time needed to resolve disputes, enforce agreements and protect our rights.
Retention periods may vary depending on the category of data and the context. We will take reasonable steps to delete or anonymise data when it is no longer needed.
We take appropriate technical and organisational measures to protect your personal data against unauthorised or unlawful processing, accidental loss, destruction or damage. These measures may include access controls, encryption where appropriate and regular security reviews.
However, no system can be entirely secure. You are also responsible for:
Keeping your device, login details and passwords secure;
Logging out or locking your device when not in use;
Informing us promptly if you believe your account has been compromised.
The Driver App may use or contain links to services provided by third parties (for example mapping or navigation services, payment providers or support tools). These third parties are responsible for their own privacy practices.
We encourage you to review the privacy policies of any third-party services you use in connection with the Driver App.
We may update this Privacy Policy from time to time, for example to reflect changes in the Driver App, legal requirements or our processing practices.
If we make material changes, we will notify you via the Driver App or by email, and indicate the date of the latest update at the top of this document. Your continued use of the Driver App after the updated Privacy Policy takes effect will constitute your acceptance of those changes.

Avatravel processes your personal information in compliance with this privacy notice and in accordance with the relevant data protection laws.
