These terms of service may be subject to change at any time and without prior notice. By ordering a commission from me, AtomicStarCat, you (the client) affirm to have read and agree to be legally bound by the following Terms of Service listed below.
Failure to follow these guidelines will result in you being added to a private blacklist [for my reference] the users from which I cannot trust to give my designs/art any longer. If you try to loophole around these guidelines and/or use other people/accounts to get my work/profit from my designs after being blacklisted, I will make a public blacklist. If the circumstances arise, you may dm me to discuss any inquiries.
The number one rule: do NOT use ANY of my displayed art, examples, or sketches that were not meant for you under ANY circumstances! They do not belong to you in any way shape or form unless I have given it directly to you as gift or payment, or I have given you express permission to use it for a specific purpose! I work very hard for other people and I would rather you not take that away from both me and the recipient.
The artist and the client both have a right to refuse or cancel the commission for whatever reason, with or without explanation. Please see the Refunds section below for further information.
The Artist has a right to upload the commission on any/all social media unless specified by the client beforehand to keep the commission private.
The artist has the right to use any artwork as examples, and the character name and any relevant link will be displayed with the image in the examples page.
The artist does not work with NSFW, 18+, pedophilic, proship, incestuous, etc. requests or commissions for any reason.
I will not, under any circumstances, accept commissions or requests that entail my Can’ts and Wont’s in the respective “Cans and Can’ts” tab.
The artist’s work is to be used for personal uses only.
Keep in mind that I am a college student, and therefore, my studies take priority over my art.
Taking my art for usage in an AI generation program is strictly prohibited.
Using a sketch the artist has provided to generate a "finished" version of the piece is strictly prohibited.
Attempting to mimic my art with an AI program is strictly prohibited.
Using my art for NFT or anything in the related categories is strictly prohibited.
Offering for characters in my toyhou.se or any other platform that are not explicitly listed as UFT/OTA etc., under ANY circumstances is prohibited. I will ignore you and delete your offer.
After payment, the adoptable/custom/design belongs to the client I have sold/gifted/traded them to.
Claiming the design credits as the client’s or anyone else’s is prohibited.
I have the right to showcase any designs I worked on as examples, but I will not claim characters as my own that are not currently in my possession.
My characters/designs are not to be used for anything NSFW, 18+, pedophilic, proship, incestuous, etc. or anything related. If you fail to follow this rule, I will blacklist you and refuse to work with you again.
You can change the character's design, but I'd prefer it if they were recognizable.
(Toyhouse Applicable) Do not delete my designs or hide them from my view to try to loophole my rules. If you hide my design, make sure to authorize me to see them.
Designs received under any circumstances other than a real money transaction are not worth money. You are not under any circumstances to sell my designs for more than you have paid for them, whether in initial reception, or commissioned artwork. Profiting in any way off my work is unacceptable. This is one of my strictest rules.

I do not issue refunds for dissatisfaction, as these are effectively surprise customs. I do not issue alterations after delivery unless under extreme circumstances (see below).
Any text information is permitted to be changed, as it is your character after reception. However, design changes for this particular custom type are prohibited. If something about the design truly bothers you, you must contact me with a valid reason and I will personally fix it for you. Be aware I may not be able to make changes.
Trading, selling, or otherwise releasing ownership of your partner’s design is prohibited.
These designs are for personal use only!
I currently only accept payment through PayPal, Ko-Fi, Venmo, and Cash App.
Do not send any money to me before I accept your commission.
I take payment in a few ways, which you may choose from.
In full, up front (unwatermarked progress shots)
Half up front, half before delivery (watermarked progress shots)

I have a general turnaround time of two months. My goal will always be to have your art done in 2 to 3 weeks, but that is not my hard turnaround. If I do not give an update in 2-3 weeks, I implore you to contact me. You may contact me earlier if you please as well.
When I am finished with your commission, I will include an image through a Google Photos link with the background, and another with a transparent background. I do not send transparent versions for scene-style commissions.
The images may or may not be deleted from Google Photos links any time after 24 hours of being sent to the recipient, so save them as soon as you get them. Any art I use as an example will display the character’s name and link to their profile, if applicable.
After the sketch and line art phases are finished, I may or may not be able to make alterations to the art. Keep in mind that changes may not be possible after those two phases.
You, as the recipient are not permitted to alter my art in any way other than cropping, canvas sizing, photo filters, etc. Do not change any aspect of the art itself, including but not limited to proportions, expansion, contraction, touching up etc.
Tracing, reproducing, heavily referencing, or copying my artwork is prohibited.
You have the right, at any point during the commission, to request a progress shot.
I value communication, so please contact me for any reason or concern at any point.
When I begin your commission, I will send you a link to my Trello board for you to track my progress, which is linked in the main tab of my Terms of Service page already. It is always updated, and it is always accurate to how far I am with your commission, so feel free to check in anytime.
I do not issue refunds for commissions canceled by the client.
If I cancel or am unable to complete the commission for whatever reason, the Client will receive a full refund in addition to a .PNG file of whatever progress of the commission has been completed.
Refunds will be given within 72 hours after correspondence.
The Client will not be refunded if they are unsatisfied with the commission.
Pet commissions are pencil sketched portraits. They are somewhat stylized and cartoonish, so don't expect a photo-realistic picture.
Pet commissions are restricted exclusively for people I have met face to face in real life. I do not take pet commissions from people I only know online.
In addition to the payment methods listed in the Payment section, I accept cash for pet commissions.
I require at least two good-quality images of the pet in question, and more are welcomed.
General Terms apply to pet commissions as well.
I do not accept real-life pictures for character commissions. Provide at least one drawn and colored fullbody reference to work with.
Prices will be increased with character complexity. I do not accept commissions of characters that have Genshin Impact character-level or near Genshin Impact character-level complexity.
I do not draw characters in suggestive ways, clothes, or poses under any circumstances.
