1. Agreement to Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between Atlas Startech (“Company,” “we,” “our,” or “us”) and you—whether as an educational institution (“School”), authorized staff member, parent, or student—governing your access to and use of the School-Parents App and related services (“Service”). By accessing or using the Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must discontinue use immediately. Updates to these Terms will be posted with a revised “Last Updated” date, and continued use of the Service signifies acceptance of the new Terms.

2. Scope of Service

Atlas Startech provides digital communication and management tools to Schools and authorized users for educational use only. You agree to use the Service solely for lawful educational purposes and in accordance with these Terms.

3. Intellectual Property Rights

All intellectual property, including software, design, code, database structures, user interfaces, logos, analytics systems, and documentation, are the exclusive property of Atlas Startech or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for authorized educational purposes only. No portion of the Service may be copied, resold, or reverse-engineered without our written consent.

4. User Responsibilities

By using our Service, you confirm that you have the legal authority to represent your School or account, will not use the Service for any illegal, unauthorized, or commercial resale purpose, and will maintain confidentiality of credentials. You must comply with all applicable education, privacy, and data protection laws. Atlas Startech is not responsible for the accuracy or legality of data entered by Schools or users.

5. Prohibited Activities

You agree not to upload malicious code, spam, or unlawful content; attempt unauthorized access; copy or redistribute the Service; misuse communications features; or share content violating intellectual property or child protection laws. Violation of these rules may result in immediate suspension or termination of your account.

6. Data and Privacy

Your use of the Service is governed by our Privacy Policy, which forms an integral part of these Terms. By using the Service, you consent to our data handling practices. Schools are the primary data controllers for all student or parent information submitted via the Service. Atlas Startech acts only as a technology service provider and data processor, processing data solely on behalf of the School.

7. Data Security and Backups

We take commercially reasonable measures to secure user data; however, no system is entirely risk-free. While we perform periodic backups, Schools remain responsible for maintaining local copies of important records. We are not liable for accidental loss, corruption, or unauthorized access resulting from third-party causes.

8. Service Availability and Modifications

The Service is provided on an “as-is” and “as-available” basis. We do not guarantee uninterrupted operation and may perform maintenance or updates periodically. We are not liable for downtime or technical failures and reserve the right to modify or discontinue features without prior notice.

9. Payments and Subscriptions (If Applicable)

If your School subscribes to a paid plan, payment terms will follow the respective agreement. Failure to pay may result in suspension or termination of access.

10. Termination and Suspension

Atlas Startech may suspend or terminate Service access without liability or notice if Terms are violated, data is misused, or payment obligations are unmet. Upon termination, your license ceases immediately, and related data may be deleted in accordance with our Privacy Policy.

11. Indemnification

You agree to defend, indemnify, and hold harmless Atlas Startech, its officers, employees, and affiliates against claims, losses, or damages arising from user data, breach of Terms, or misuse of the Service. Schools are liable for compliance with data and content laws.

12. Limitation of Liability

To the maximum extent permitted by law, Atlas Startech shall not be liable for indirect, incidental, or consequential damages, including loss of profit or data. Total liability shall not exceed the amount paid by the School (if any) for use of the Service.

13. Disclaimer of Warranties

The Service is provided “as-is” without warranties of any kind, express or implied, including merchantability, fitness for purpose, or non-infringement. We make no guarantee that the Service will be error-free, secure, or compatible with all devices.

14. Jurisdiction and Governing Law

These Terms are governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts in Surat, Gujarat, India.

15. Updates to Terms

We may revise these Terms at any time. Updated versions will be posted in the app or on our website, and continued use constitutes acceptance of revisions.

16. Miscellaneous

These Terms, along with the Privacy Policy, form the entire agreement between you and Atlas Startech. If any provision is deemed invalid, remaining provisions remain enforceable. We may assign rights and obligations without notice. No waiver of any breach shall be deemed a waiver of future breaches.
