Welcome to Art of Breathing, a desktop application developed by Subhojit Kumar Mahato ("Developer", "we", "our", or "us").
These Terms and Conditions govern your access to and use of the Application. By downloading, installing, accessing, or using Art of Breathing, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you must not download, install, access, or use the Application.
Your use of the Application is also governed by the Privacy Policy and Medical Disclaimer, which are incorporated into and form part of these Terms and Conditions.
Subject to your compliance with these Terms and Conditions, the Developer grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to download, install, and use Art of Breathing solely for your own lawful use on devices that you own or control and in accordance with all applicable laws.
This license grants you the right to use the Application only. It does not transfer ownership of the Application or any intellectual property rights. All rights not expressly granted under these Terms are reserved by the Developer.
You agree to use Art of Breathing only in accordance with these Terms and all applicable laws. You agree not to, and not to permit others to:
Sell, rent, lease, sublicense, distribute, host, or otherwise commercially exploit the Application or make it available to any third party, except as expressly permitted by applicable law.
Copy, modify, adapt, translate, create derivative works from, disassemble, decompile, decrypt, reverse engineer, or otherwise attempt to derive the source code of the Application, except where such activities are expressly permitted by applicable law.
Remove, alter, or obscure any copyright, trademark, license, or other proprietary notices contained within the Application or its associated materials.
Use the Application in any manner that violates applicable laws or infringes the rights of the Developer or any third party.
Interfere with, disrupt, or attempt to compromise the security, integrity, or normal operation of the Application.
Art of Breathing welcomes feedback, bug reports, feature requests, comments, ideas, and other suggestions ("Feedback") that help improve the Application.
By voluntarily submitting Feedback to the Developer through the Application, the support page, email, or any other communication channel, you grant the Developer a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, adapt, publish, and incorporate such Feedback into the Application or related materials without any obligation to provide compensation, attribution, or further notice.
You represent that your Feedback does not knowingly infringe the intellectual property or other rights of any third party.
Art of Breathing may provide links to third-party websites or services for your convenience, including support pages, legal documents, attribution pages, and services provided by Google. These third-party websites and services are not owned, operated, or controlled by the Developer.
The Developer is not responsible for the content, availability, accuracy, security, privacy practices, or policies of any third-party website or service. Your use of such websites or services is governed by their respective terms, conditions, and privacy policies. We encourage you to review those policies before using such websites or providing any personal information.
The Developer may, from time to time, modify, update, improve, suspend, or discontinue the Application or any of its features. Such changes may include bug fixes, security updates, performance improvements, compatibility updates, new features, or the removal of existing features.
While the Developer may provide updates to improve the Application, there is no obligation to provide updates, enhancements, new features, or continued support for any particular version of the Application.
The Developer reserves the right to discontinue the Application or any of its features where reasonably necessary, including for maintenance, security, legal compliance, or technical reasons. Where practicable, reasonable notice of significant changes or discontinuation may be provided.
Art of Breathing is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by applicable law, the Developer disclaims all warranties, including, but not limited to, any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted or error-free operation.
The Developer does not warrant that the Application will always be available, operate without interruption, be free from errors or defects, or meet every user's individual requirements or expectations.
To the fullest extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including, without limitation, any loss of data, loss of profits, loss of business opportunities, business interruption, or any other commercial or economic loss, arising out of or relating to the use of, or inability to use, the Application, even if the Developer has been advised of the possibility of such damages.
In all cases, the Developer's total liability arising from or relating to the Application shall not exceed the amount paid by the user to obtain the Application. If the Application was obtained free of charge, the Developer shall have no monetary liability to the fullest extent permitted by applicable law.
These Terms and Conditions remain in effect for as long as you use the Application.
You may terminate your use of the Application at any time by uninstalling Art of Breathing from your device. If you have signed in with a Google account, you may also sign out from within the Application and revoke the application's access through your Google Account Security settings.
The Developer reserves the right to suspend or discontinue the Application, or to terminate these Terms with respect to future use, if necessary to comply with applicable law, protect the security or integrity of the Application, or in the event of misuse or a violation of these Terms. Where reasonably practicable, notice of such changes will be provided.
These Terms and Conditions shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles.
Any dispute arising out of or relating to these Terms or the use of the Application shall be subject to the jurisdiction of the competent courts located in India.
The Developer may update these Terms and Conditions from time to time to reflect changes in the Application, legal requirements, or business practices. When changes are made, the Effective Date at the top of this document will be updated. Continued use of Art of Breathing after the revised Terms become effective constitutes acceptance of the updated Terms.
