Terms & Conditions for Arcade Clock: Wake Up Alarm
Last Updated: August 20, 2026
PLEASE READ THESE TERMS & CONDITIONS (THE “TERMS”) CAREFULLY BEFORE USING ARCADE CLOCK: WAKE UP ALARM (THE “APP”).
IMPORTANT: THE APP IS A CONVENIENCE TOOL. NO ALARM APPLICATION CAN BE GUARANTEED TO OPERATE WITHOUT INTERRUPTION OR FAILURE. SECTION 6 CONTAINS IMPORTANT ALARM-RELIABILITY AND WARRANTY DISCLAIMERS, AND SECTION 7 LIMITS LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY LAW. YOU SHOULD MAINTAIN AN INDEPENDENT BACKUP FOR IMPORTANT OR TIME-SENSITIVE EVENTS.
These Terms are between you (“you” or “User”) and the developer identified in Section 17 (“Developer,” “we,” “us,” or “our”). They govern your access to and use of the App, including its alarms, challenge features, widgets, Live Activities, in-app purchases, subscriptions, updates, and related functionality.
By downloading, installing, accessing, purchasing through, or using the App, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the App.
To the extent the App is distributed through Apple’s App Store, these Terms are intended to operate consistently with the applicable Apple Media Services Terms and Conditions and Apple’s minimum terms for licensed applications. Mandatory rights that cannot lawfully be waived remain unaffected.
1. Eligibility
You may use the App only if you are legally permitted to do so under the laws that apply to you. If applicable law requires the involvement, consent, or permission of a parent or legal guardian for you to use the App or agree to these Terms, you may use the App only with that involvement, consent, or permission.
The App is a general-audience utility and is not specifically directed to children. It is not intended for use in circumstances where doing so would violate applicable children’s privacy, consumer-protection, or other laws.
2. License and Permitted Use
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App on Apple-branded products that you own or control, solely for lawful personal use and in accordance with Apple’s applicable Usage Rules. Where Apple’s Usage Rules permit, the App may also be accessed through accounts associated with the purchaser through Family Sharing or volume purchasing.
The App is licensed, not sold. We and our licensors retain all rights not expressly granted to you.
You may not, except to the extent a restriction is prohibited by applicable law:
- copy, reproduce, distribute, sell, rent, lease, sublicense, or commercially exploit the App;
- reverse engineer, decompile, disassemble, or attempt to derive the App’s source code;
- modify, adapt, translate, circumvent, or create unauthorized derivative works from the App;
- bypass, disable, manipulate, or interfere with security, entitlement, subscription, or access-control mechanisms;
- use bots, scrapers, automated systems, or abusive traffic to interfere with or burden the App or related Apple services;
- use the App in violation of law, third-party rights, Apple’s applicable terms, or these Terms; or
- use the App in a way that could damage, disable, disrupt, or compromise the App, a device, or another service.
3. Alarm and Challenge Functionality
The App allows you to schedule alarms and may require completion of an interactive challenge before an alarm is dismissed or before the App completes an alarm-dismissal flow. Challenges may include activities such as math, typing, visual puzzles, tapping, vibration-based interactions, maze-style interactions, or scanning a registered barcode or QR code.
You acknowledge and agree that:
1. System dependency. Alarm scheduling and delivery depend on Apple-provided operating-system frameworks, including AlarmKit and related iOS services, as well as the condition and configuration of your device. We do not control iOS, Apple’s infrastructure, your hardware, or future operating-system changes.
2. Silent Mode and Focus. On supported systems, AlarmKit is designed to present alarms through Silent Mode and the current Focus. However, this does not create a guarantee that every alarm will be delivered, audible, visible, or perceived under every circumstance.
3. Possible failures. Alarm behavior may be affected by circumstances outside our reasonable control, including loss of AlarmKit authorization, a powered-off or depleted device, hardware or speaker failure, operating-system defects, incompatible or outdated software, corrupted device state, system resource limitations, user configuration, an interrupted update, or other device- or platform-level failure.
4. User configuration. You are responsible for confirming that the alarm is enabled, scheduled for the intended time and days, configured with the intended sound and challenge, and otherwise set up correctly.
5. Scan Code challenge. If you use a barcode/QR-code challenge, you are responsible for registering the intended code and maintaining safe and practical access to it. A missing or damaged code, camera-access denial, camera malfunction, poor lighting, or scanning failure may interfere with the challenge.
6. No safety-critical reliance. The App is not designed or certified for emergency alerts, medical monitoring, life-safety systems, transportation safety, aviation operations, security systems, or other safety-critical use.
7. Backup alarm strongly recommended. For important events—including work, school, exams, travel, flights, medical appointments, medication timing, caregiving, or any event where delay could cause harm or loss—you should use an independent backup alarm or reminder.
8. Safe interaction. Do not attempt to complete interactive challenges while driving, cycling in traffic, operating machinery, or in any situation where interacting with a device would be unsafe or unlawful.
4. Device Permissions and User Content
Some features require permissions provided by iOS, such as alarm/notification authorization, Camera access, or access to eligible media in your music library. You control these permissions through iOS. Refusing or revoking a permission may make the associated feature unavailable without affecting unrelated features where technically feasible.
4.1 Camera and Codes
Camera access is used for the optional Scan Code challenge. The App may process the live camera feed on-device to recognize a barcode or QR code. The App does not need to retain photographs or video merely to perform that scan. A decoded code value that you choose to register may be stored as part of your alarm/challenge configuration as described in the Privacy Policy.
4.2 Audio and Music
You are responsible for ensuring that you have the legal right to use any audio file, ringtone, recording, or other media you import or select for use with the App.
The App does not grant you ownership of or additional rights in third-party music or other copyrighted content. You may not use the App to infringe copyright, circumvent digital-rights-management restrictions, or unlawfully copy, rip, download, convert, redistribute, or share protected media.
Where the App interacts with Apple Music or a local music library, use remains subject to Apple’s terms and the rights of the relevant copyright owners. Apple Music catalog content must not be treated as a freely exportable audio file unless Apple and the applicable rights holders expressly permit that use.
4.3 iCloud Data and “Delete iCloud Backup”
If you enable iCloud Sync, eligible App data may be stored or synchronized through Apple’s CloudKit infrastructure as described in the Privacy Policy.
The App provides a Delete iCloud Backup control. If you confirm deletion, the App requests permanent deletion of the Arcade Clock iCloud backup targeted by that feature. Once deletion completes successfully, we may be unable to recover that backup. Deleting the backup does not by itself delete data stored only on your device or cancel an App Store subscription. If iCloud Sync remains enabled, eligible local data may later be synchronized to iCloud again.
5. Arcade Clock Pro; Auto-Renewable Subscriptions
5.1 Subscription Offering
The App may offer an optional auto-renewable subscription marketed as Arcade Clock Pro, including monthly and/or yearly plans. The exact features, subscription duration, price, currency, trial or introductory offer (if any), and renewal terms presented on the purchase screen and Apple purchase confirmation are the terms applicable to that transaction.
Subscription features may evolve over time. We will not intentionally remove access during a paid subscription period in a manner prohibited by applicable law or Apple’s rules.
5.2 Apple Processes Purchases
All App Store in-app purchases are processed by Apple through your Apple Account and Apple’s In-App Purchase system. We do not directly receive or store your payment-card number or Apple Account password.
Payment is charged by Apple when you confirm the purchase, subject to Apple’s applicable billing terms.
5.3 Automatic Renewal
Unless cancelled, an auto-renewable subscription renews automatically for the applicable subscription period at the price shown by Apple for the renewal, subject to any notice or consent Apple or applicable law requires for a price change.
You are responsible for cancelling through Apple before renewal if you do not want the subscription to continue. Apple controls the timing and mechanics of billing and renewal.
5.4 Free Trials and Introductory Offers
If a free trial, introductory price, promotional offer, offer code, or similar benefit is available, eligibility is determined under Apple’s rules and the terms displayed before purchase. Unless cancelled before the end of a trial or offer period, the subscription may automatically convert to a paid subscription at the price disclosed to you before confirmation.
5.5 Managing or Cancelling
You can manage or cancel your subscription through your Apple Account subscription settings. Deleting the App does not cancel an active subscription.
Cancellation generally stops future renewals and does not retroactively refund the current billing period unless Apple or applicable law provides otherwise.
5.6 Refunds
App Store billing and refund requests are generally administered by Apple under Apple’s refund procedures and applicable law. Because Apple processes the transaction, we ordinarily cannot issue an App Store refund directly. Nothing in this section limits any non-waivable refund or consumer right you may have under applicable law.
5.7 Restoring Purchases
The App may provide a Restore Purchases function. Restoration and entitlement verification depend on StoreKit and Apple’s systems and generally require use of the Apple Account associated with the original purchase.
5.8 Subscription Changes
Where Apple permits upgrades, downgrades, crossgrades, promotional offers, billing-retry periods, grace periods, or other subscription-management features, the resulting effective date, billing treatment, and eligibility are determined through Apple’s subscription system.
6. Disclaimer of Warranties and Alarm Reliability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND ALL RELATED FEATURES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT OR GUARANTEE THAT:
- ANY ALARM WILL FIRE, SOUND, VIBRATE, DISPLAY, WAKE YOU, OR OTHERWISE ALERT YOU AT THE INTENDED TIME OR EVERY TIME;
- ANY CHALLENGE, SNOOZE, DISMISSAL, WIDGET, LIVE ACTIVITY, SYNC, RESTORE, OR SUBSCRIPTION FEATURE WILL ALWAYS OPERATE AS EXPECTED;
- THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, COMPATIBLE WITH EVERY DEVICE OR OS VERSION, OR AVAILABLE FOREVER;
- DEFECTS WILL BE CORRECTED WITHIN ANY PARTICULAR TIME;
- DATA WILL NEVER BE LOST, CORRUPTED, DELAYED, FAIL TO SYNC, OR REMAIN RECOVERABLE AFTER YOU INTENTIONALLY DELETE AN ICLOUD BACKUP; OR
- THE APP WILL MEET EVERY USER’S INDIVIDUAL REQUIREMENTS.
YOU ASSUME RESPONSIBILITY FOR VERIFYING IMPORTANT ALARMS AND FOR MAINTAINING AN APPROPRIATE BACKUP.
Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, the exclusions above apply only to the maximum extent permitted by law, and any mandatory warranty is limited to the minimum scope and duration permitted by law.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER THE DEVELOPER NOR ITS AFFILIATES, LICENSORS, CONTRACTORS, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, OPPORTUNITY, DATA, GOODWILL, REPUTATION, OR OTHER INTANGIBLE LOSS, ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGE IS POSSIBLE.
WITHOUT LIMITING THE FOREGOING, THIS INCLUDES LOSS OR DAMAGE ARISING FROM OR RELATING TO:
- a missed, delayed, silent, inaudible, incorrectly configured, or otherwise unsuccessful alarm;
- failure of the App to wake, remind, or notify you;
- missed work, school, travel, transportation, flights, examinations, meetings, deadlines, appointments, medication times, or other time-sensitive events;
- use of, inability to use, interruption of, or loss of access to the App;
- device failure, operating-system behavior, Apple service interruption, permission changes, or third-party services;
- loss, corruption, failed restoration, or failed synchronization of data; or
- unauthorized access to information where not caused by conduct for which liability cannot lawfully be excluded.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU ACTUALLY PAID FOR THE APP OR ARCADE CLOCK PRO DURING THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.
These limitations apply regardless of the legal theory asserted, including contract, tort, negligence, strict liability, statute, or otherwise.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, fraudulent misrepresentation, willful misconduct, or death or personal injury caused by negligence where applicable law prohibits such limitation. Mandatory consumer rights remain unaffected.
8. Health and Safety
The App is intended for general productivity, entertainment, and wake-up purposes. It is not a medical device and is not intended to diagnose, treat, cure, monitor, mitigate, or prevent any disease, sleep disorder, disability, or medical condition.
Sound, vibration, screen motion, flashing or rapidly changing visual content (if present in a challenge), and repeated interaction may be unsuitable for some users. If you have a medical condition that could be affected by sound, vibration, light, visual patterns, sleep interruption, or device interaction, seek appropriate medical advice before using the relevant feature.
Do not place your device, charging equipment, speakers, or accessories in a position that creates a fire, overheating, hearing, fall, entanglement, or other physical hazard in an attempt to make an alarm more noticeable.
9. Intellectual Property
The App and its original software, interface, graphics, icons, challenge designs, text, sounds, artwork, code, branding, and other content are owned by or licensed to the Developer and are protected by applicable intellectual-property laws.
Except for the limited license in Section 2, no right, title, or interest in the App or our intellectual property is transferred to you.
Third-party names, trademarks, media, and services remain the property of their respective owners. Nothing in the App implies sponsorship or endorsement by Apple or any other third party unless expressly stated.
10. Third-Party and Apple Services
The App may depend on or interact with Apple technologies and services, such as AlarmKit, StoreKit, iCloud/CloudKit, system permissions, widgets, Live Activities, media frameworks, and the App Store. These services are outside our direct control and may be changed, suspended, restricted, or discontinued by Apple.
The App may also contain links to the App Store, our other apps, or other third-party destinations. We are not responsible for third-party content, availability, security, or privacy practices. Your use of third-party services is subject to their applicable terms.
11. Suspension and Termination
You may stop using and delete the App at any time. Deleting the App does not automatically cancel a subscription purchased through Apple.
To the extent technically and legally permitted, we may suspend or terminate access to features if we reasonably believe you have materially violated these Terms, engaged in fraud or abuse, attempted to bypass purchase or security controls, or used the App unlawfully.
Termination does not affect rights or obligations that by their nature should survive, including provisions concerning intellectual property, payment obligations already incurred, disclaimers, limitations of liability, dispute provisions, and general legal terms.
12. Disputes; Applicable Law; Mandatory Consumer Rights
If you have a dispute concerning the App, please contact us first at the email in Section 17 and give us a reasonable opportunity to attempt to resolve it informally.
Except where mandatory law provides otherwise, these Terms are governed by the law applicable at the Developer’s principal place of establishment, without giving effect to conflict-of-law rules that would require application of another jurisdiction’s law.
Subject to the mandatory consumer-protection provisions described in this Section 12, any dispute not resolved informally shall be subject to the exclusive jurisdiction of the courts located in the Developer’s principal place of establishment.
Nothing in these Terms deprives a consumer of mandatory protections, remedies, or rights that cannot be waived under the law of the consumer’s habitual residence. If applicable law gives you the right to bring proceedings in your local courts or before a local consumer authority, these Terms do not remove that right.
We do not require consumers to waive rights through a class-action waiver or mandatory arbitration provision in these Terms. Any arbitration or alternative dispute process will apply only where separately and validly agreed or required by applicable law.
13. Indemnification
To the maximum extent permitted by applicable law, and excluding claims arising solely from ordinary consumer use for which indemnification cannot lawfully be required, you agree to indemnify and hold harmless the Developer and its affiliates, officers, employees, agents, and licensors from third-party claims, losses, liabilities, damages, and reasonable costs arising from your:
- unlawful use of the App;
- material violation of these Terms;
- infringement or misappropriation of another person’s intellectual-property, privacy, or other legal rights; or
- unlawful use, import, distribution, or handling of audio, codes, or other content you provide to the App.
This section does not require you to indemnify us for our own fraud, willful misconduct, or other liability that applicable law does not permit us to shift to you.
14. Changes to the App or These Terms
We may update the App and these Terms from time to time to reflect new features, security requirements, legal obligations, Apple platform changes, or business changes.
If a change to these Terms is material, we will provide notice where required by applicable law. Changes apply prospectively from their stated effective date. Where applicable law requires your consent to a material change, the change will not bind you without the required consent.
We may modify, suspend, or discontinue features of the App, subject to applicable law and obligations relating to paid subscription periods.
15. Apple App Store Minimum Terms
If these Terms are treated as the end-user license agreement for the App, or to the extent Apple’s minimum terms are required to be incorporated, the following provisions apply. If any provision below conflicts with another provision of these Terms, the provision required by Apple controls to the extent of that conflict.
1. Acknowledgment. These Terms are between you and the Developer, not Apple Inc. (“Apple”). The Developer, not Apple, is responsible for the App and its content.
2. Scope of License. Your license is limited to a non-transferable license to use the App on Apple-branded products you own or control, as permitted by Apple’s Usage Rules, except that the App may be accessed and used by other accounts associated with the purchaser through Family Sharing or volume purchasing where Apple permits.
3. Maintenance and Support. The Developer, not Apple, is responsible for maintenance and support required under these Terms or applicable law. Apple has no obligation to furnish maintenance or support for the App.
4. Warranty. To the extent any warranty applies and the App fails to conform to it, you may notify Apple, and Apple may refund the purchase price, if any, paid for the licensed App as required by Apple’s terms. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the App. Any other claim, loss, liability, damage, cost, or expense attributable to a failure to conform to an applicable warranty is the Developer’s responsibility to the extent required by law.
5. Product Claims. The Developer, not Apple, is responsible for addressing claims relating to the App or your possession or use of it, including product-liability claims, claims that the App fails to conform to applicable legal or regulatory requirements, and claims arising under consumer-protection, privacy, or similar law.
6. Intellectual Property Claims. If a third party claims that the App or your possession or use of the App infringes that party’s intellectual-property rights, the Developer, not Apple, is responsible for investigation, defense, settlement, and discharge of that claim to the extent required by applicable law.
7. Legal Compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on a U.S. Government list of prohibited or restricted parties.
8. Developer Contact Information. Questions, complaints, and claims concerning the App should be directed to the Developer using the contact details in Section 17.
9. Third-Party Terms. You must comply with applicable third-party terms when using the App, including applicable Apple Media Services Terms and any terms governing your wireless, data, iCloud, or media services.
10. Third-Party Beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms to the extent required by Apple’s minimum terms and, upon your acceptance, may enforce those required provisions against you as a third-party beneficiary.
16. General Provisions
16.1 Entire Agreement
These Terms, together with the Privacy Policy and any purchase terms displayed by Apple at the time of purchase, constitute the agreement governing your use of the App to the extent permitted by law. Apple’s applicable terms separately govern your relationship with Apple.
16.2 Severability
If any provision is held invalid or unenforceable, it will be enforced to the maximum lawful extent or modified to the minimum extent necessary, and the remaining provisions will remain in effect.
16.3 No Waiver
Failure to enforce a provision is not a waiver of the right to enforce it later.
16.4 Assignment
You may not assign these Terms except as permitted by law. We may assign our rights and obligations in connection with a merger, acquisition, corporate reorganization, asset transfer, or transfer of the App, subject to applicable consumer and privacy laws.
16.5 Force Majeure
To the maximum extent permitted by law, we are not responsible for delay or failure caused by events outside our reasonable control, including natural disasters, war, civil disturbance, labor disruption, power or telecommunications failure, cyber incidents not caused by our failure to meet mandatory legal duties, widespread platform outages, Apple service failures, operating-system defects, governmental action, or similar events.
16.6 No Agency
These Terms do not create a partnership, employment, fiduciary, joint-venture, or agency relationship between you and the Developer.
16.7 Headings
Section headings are for convenience only and do not affect interpretation.
