Welcome to Expensely, your go-to app for managing expenses. By using Expensely (“the App”), you agree to these Terms of Service (“Terms”). Please read them carefully.

1. Acceptance of Terms

By downloading, accessing, or using Expensely, you agree to comply with these Terms and any applicable laws or regulations. If you do not agree with these Terms, do not use the App.

2. Eligibility

You must be at least 18 years of age to use Expensely. If you are under 18 years of age, you must have parental or guardian consent to use the App. By using Expensely, you confirm that you meet these eligibility requirements.

3. No Account Required

Expensely does not require you to create or register an account to use its features. Your data is stored locally on your device, and Expensely does not collect or store any personal information without your consent.

4. Commercial and Personal Use

You may use Expensely for both personal and commercial purposes. The App is designed to help individuals and businesses manage their financial expenses. However, you agree not to use the App for illegal activities or any purpose that violates these Terms.

5. Subscription and In-App Purchases

Expensely may offer paid features or premium content through subscriptions or in-app purchases. By making a purchase, you agree to the following:

• Payment Terms: Subscription options, pricing, and payment terms will be made clear within the App before purchase.

• Renewals: If you subscribe to a service, your subscription will automatically renew at the end of each term unless you cancel it through your App Store account settings.

• Cancellation and Refunds: Subscription cancellations can be managed in your App Store account settings. Refunds for subscriptions and purchases are handled according to App Store policies.

6. Data Privacy and Security

We take privacy seriously. Please refer to our Privacy Policy for detailed information on how we collect, use, and protect your data.

• Although Expensely is designed to store your data locally, any data you choose to share (e.g., for backup or syncing purposes) is subject to our Privacy Policy.

• You are responsible for securing your device and keeping any sensitive data safe.

7. Maintenance and Support

Expensely is responsible for providing any maintenance or support for the App. If you experience any issues, please reach out to our support team.

Apple is not responsible for any maintenance or support services with respect to Expensely.

8. Warranty Disclaimer

Expensely is provided on an "as-is" basis. We do not warrant that the App will be error-free, uninterrupted, or meet your specific requirements. To the maximum extent permitted by law, we disclaim any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In the event that the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if applicable) for the App. To the maximum extent permitted by law, Apple will have no other warranty obligations with respect to the App.

9. Limitation of Liability

To the fullest extent permitted by law, Expensely, its developers, affiliates, and partners shall not be liable for any indirect, incidental, or consequential damages arising out of or relating to your use of the App.

• This includes, but is not limited to, loss of profits, data, or business opportunities, even if Expensely was advised of the possibility of such damages.

• In any event, Expensely’s total liability for any claim related to the use of the App is limited to the amount you paid, if any, to use the App or $50, whichever is lower.

10. Intellectual Property

The App and all associated materials, including software, design, and content, are protected by intellectual property laws. You agree not to copy, distribute, or create derivative works based on Expensely without prior written consent.

11. Product Claims

Expensely is solely responsible for any claims you or third parties may have related to the App, including product liability claims, failure to meet legal or regulatory requirements, and claims arising under consumer protection or similar laws. Apple is not responsible for addressing these claims.

12. Changes to the Terms or App

Expensely reserves the right to modify or discontinue the App or any feature at any time, without notice. We may also update these Terms periodically. While we will try to inform users of any significant changes, there may be instances where notification is not possible.

• If you continue to use the App after the changes are made, you accept the updated Terms. If you do not agree with the changes, you must stop using the App.

13. Legal Compliance and Export Control

By using the App, you represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or designated by the U.S. as a “terrorist supporting” country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

14. Governing Law

These Terms and any disputes related to the App will be governed by the laws of the jurisdiction in which you reside, without regard to its conflict of law principles. You agree to submit to the personal jurisdiction of the courts located within your jurisdiction for the resolution of any disputes.

15. Third-Party Beneficiary

You acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of the Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
