この利用規約（以下「本規約」）は、Aobalis Studio（以下「当方」）が提供するスマートフォン向けアプリケーション「Aobalis Tracker」（以下「本サービス」）の利用条件を定めるものです。
利用者は、本規約に同意頂いた上で、本サービスを利用できるものとします。
利用者が本サービスを使用することで、利用者と当方との間で、本規約の諸規定に従った利用契約が成立するものとします。
利用者が未成年者である場合には、親権者その他の法定代理人の同意を得たうえで、本サービスをご利用ください。
本規約の同意時に未成年であった利用者が成年に達した後に本サービスを利用した場合、当該利用者は本サービスに関する一切の法律行為を追認したものとみなされます。
当方は、利用者の承諾を得ることなく、いつでも本規約の内容を改定することができるものとし、利用者はこれを異議なく承諾するものとします。
規約の変更があった場合は、公式サイト（Google Sites）上の本ページに新しい利用規約を掲載してお知らせします。
利用規約は随時更新される場合があります。変更がないか定期的にこのページを確認することをお勧めします。
本サービスにおける個人情報及び利用者情報については、当方が別途定める「プライバシーポリシー」に則り、適正に取り扱うこととします。
本サービス自体、およびそれに関連するすべての商標、著作権、データベースの権利、その他の知的財産権はすべて当方に帰属します。
利用者は、本サービスの利用に際し、以下の行為を行ってはなりません。
アプリ、アプリの一部、または商標をコピーまたは変更すること。
アプリのソースコードを抽出すること。
アプリを他の言語に翻訳したり、派生バージョンを作成したりすること。
当方または第三者の知的財産権を侵害する行為。
公序良俗に反する内容（不適切な写真・音声等）を保存・利用する行為。
自動操作ツール、ボット、またはその他の技術的手段を用いて、広告を不正に視聴したり報酬を不当に得たりする行為。
その他、当方が不適切と判断する行為。
利用者が禁止事項に違反したと認めた場合、当方は必要と判断した措置を取ることができます。
当方は、本サービスの完全性、正確性（GPS計測の精度を含む）、確実性等についていかなる保証を行うものではありません。
当方は、本サービスの利用、内容変更、中断、終了によって生じたいかなる損害（交通事故、端末の故障、データの消失、報酬の付与失敗等）についても、一切責任を負いません。
当方は、利用者の本サービスの利用環境について一切関与せず、また一切の責任を負いません。
本サービスは、独自の利用規約を有する以下のサードパーティのサービスを使用します。利用者は各サービスの規約にも従うものとします。
Google Play 開発者サービス
Google Maps / Google Maps Platform
Google AdMob (Google 広告)
利用者は、本サービス内の機能を通じて当方を任意に支援（応援）したり、リワード広告を視聴することで特定の報酬（期間限定の機能解放等）を得たりすることができます。
支払われた応援金は、理由の如何を問わず返金することはできません。
リワード広告の視聴完了によって付与される報酬は、本アプリ内でのみ有効なものであり、換金、譲渡、および本アプリ外での利用はできません。
通信不備やシステムの不具合により報酬が付与されなかった場合、当方は当該報酬の補填義務を負わないものとします。
正文: 本規約は日本語を正文とします。日本語の正文のみが契約としての効力を有するものとし、翻訳されたものはいかなる効力も有しないものとします。
準拠法: 本規約の有効性、解釈及び履行については、日本法に準拠し、日本法に従って解釈されるものとします。
管轄裁判所: 当方と利用者との間での紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

These Terms of Service (hereinafter referred to as the "Terms") define the conditions for using the smartphone application "Aobalis Tracker" (hereinafter referred to as the "Service") provided by Aobalis Studio (hereinafter referred to as the "Provider").
Users may use the Service only after agreeing to these Terms.
By using the Service, a usage contract shall be established between the User and the Provider in accordance with the provisions of these Terms.
If the User is a minor, please use the Service only after obtaining the consent of a parent or legal guardian.
If a User who was a minor at the time of agreeing to these Terms uses the Service after reaching adulthood, that User shall be deemed to have ratified all legal acts concerning the Service.
The Provider may revise the contents of these Terms at any time without obtaining the User's consent, and the User shall accept this without objection.
If there are changes to the Terms, the Provider will notify Users by posting the new Terms on this page of the official website (Google Sites).
The Terms may be updated from time to time. It is recommended that you check this page regularly for changes.
Personal information and User information in the Service shall be handled appropriately in accordance with the "Privacy Policy" separately established by the Provider.
The Service itself, and all trademarks, copyrights, database rights, and other intellectual property rights related to it, belong to the Provider.
Users shall not engage in the following acts when using the Service:
Copying or modifying the App, any part of the App, or the trademarks.
Attempting to extract the source code of the App.
Translating the App into other languages or creating derivative versions.
Any act that infringes on the intellectual property rights of the Provider or a third party.
Storing or using content that is offensive to public order and morals (inappropriate photos, audio, etc.).
Using automated tools, bots, or other technical means to fraudulently view advertisements or unfairly obtain rewards.
Any other acts deemed inappropriate by the Provider.
If the Provider determines that a User has violated any prohibited items, the Provider may take measures deemed necessary.
The Provider makes no guarantees regarding the integrity, accuracy (including the precision of GPS measurements), or reliability of the Service.
The Provider shall not be held liable for any damages (including traffic accidents, device failure, loss of data, failure to grant rewards, etc.) resulting from the use, modification, interruption, or termination of the Service.
The Provider is not involved in, and bears no responsibility for, the User's environment for using the Service.
The Service uses the following third-party services that have their own Terms of Service. Users shall also comply with the terms of each service:
Google Play Services
Google Maps / Google Maps Platform
Google AdMob (Google Advertising)
Users may voluntarily support the Provider through features within the Service or obtain specific rewards (such as temporary feature unlocking) by viewing rewarded advertisements.
Support payments (tips) made cannot be refunded for any reason.
Rewards granted upon completion of viewing rewarded ads are valid only within this App and cannot be exchanged for cash, transferred, or used outside of this App.
In the event that a reward is not granted due to communication failure or system malfunctions, the Provider shall not be obligated to compensate for said reward.
Governing Text: The Japanese version of these Terms shall be the authoritative text. Only the Japanese text shall have legal effect as a contract, and any translations shall not have any effect.
Governing Law: The validity, interpretation, and performance of these Terms shall be governed by and construed in accordance with the laws of Japan.
Jurisdiction: Any disputes between the Provider and the User shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
