1. Acceptance of Terms:
By using the services provided by Anthonys Roadside (hereinafter referred to as "the Service"), you (hereinafter referred to as "the User") agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our services.
2. Description of Service:
Anthonys Roadside provides roadside assistance services, including but not limited to:
* Towing
* Jump-starts
* Tire changes
* Fuel delivery
* Lockout assistance
* Battery replacements
* Roadside diagnostics
* Motorcycle towing
* light auto repairs
* Vehicle Impound
* Vehicle Repossession
* Vehicle Removal
* Equipment Transport
* Vehicle Winching Service
* Vehicle Storage
Services:
Services are provided on an "as available" basis, and response times and/or estimated time arrivals (ETAs), may vary depending on location, weather conditions, and service demand.
3. User Responsibilities:
* The User must provide accurate and complete information when requesting assistance, including location, vehicle details, and the nature of the problem.
* The User is responsible for ensuring the safety of themselves and their vehicle while awaiting service.
* The User agrees to pay all applicable fees for services rendered.
* The User must have valid proof of vehicle ownership.
* The User is responsible for any items left in the vehicle after service is complete.
4. Payment:
* Payment for services is due upon completion of the service, unless otherwise stated.
* Anthonys Roadside accepts [cash, credit card, mobile payment, Cash.App, EFS check].
* Anthonys Roadside reserves the right to charge additional fees for credit card processing or check deposits.
* Rates for services will be provided to the User prior to the commencement of service unless otherwise stated.
* Anthonys Roadside reserves the right to charge a fee for cancelled calls.
*Anthonys Roadside reserves the right to charge up to 100% GOA (Gone On Arrival), for instantances including but not limited too, ghost calls, vehicle not at service loacation, early cancel, credit card payments, motorclubs, insurance agencies, and previously reduced pricing quotes to extend "good faith gestures".
GOA: Anthonys Roadside retains the right to charge a GOA in full amount of invoice with circumstances listed above.
* Anthonys Roadside reserves the right to alter priginal fee of service on a per call basis due to instances beyond our control, ie., weather conditions, driver safety, extended time on scene due to circumstance. if said instance is to occure, any unavoidable charges will be discussed before performing while on scene to give our customers implied consent to opt out of said additonal charges and/or services.
5. Limitation of Liability:
* Anthonys Roadside shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our services.
* Anthonys Roadside shall not be responsible for any damage to the User's vehicle that occurs as a result of pre-existing conditions or circumstances beyond our control.
* Anthonys Roadside is not responsible for any personal items left in the vehicle.
* In no event shall Anthony's Roadside's liability exceed the cost of the services provided.
6. Disclaimer of Warranties:
* The Service is provided "as is" and "as available" without any warranties, express or implied.
* Anthonys Roadside does not warrant that the Service will be uninterrupted or error-free.
* You agree to hold Anthonys Roadside harmless of any and all claims by contacting our prividers network, this including existing, and non existing claims.
7. Termination:
* Anthonys Roadside reserves the right to refuse or terminate service to any User for any reason, including but not limited to, abusive behavior, non-payment, or unsafe conditions, vehicle not at given service location, not enough providers on duty, and unforseen circumstances.
8. Governing Law:
* These Terms of Service shall be governed by and construed in accordance with the laws of KENTUCKY.
9. Changes to Terms:
* Anthonys Roadside reserves the right to modify these Terms of Service at any time. Any changes will be posted on our website or otherwise communicated to the User.
