Welcome to Miss Focus. These Terms of Service ("Terms") govern your access to and use of the Miss Focus mobile application (the "App") provided by TidalAurum, LLC ("Company," "we," "our," or "us").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
Miss Focus is a productivity and ambient application designed to help users maintain focus during work or study sessions. The App provides:
Pomodoro timer functionality
Ambient music playback
Ambient sound mixing
Note-taking and diary features
An animated companion character
Level and experience tracking
Customizable character appearance
You must be at least 13 years old to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
By using the App, you represent and warrant that you meet these eligibility requirements.
Miss Focus does not require user account registration. All data is stored locally on your device. You are responsible for maintaining the security of your device and any data stored within the App.
The App offers both free and premium features. Premium features require a paid subscription or one-time purchase.

Prices are displayed in your local currency and may vary by region
Subscription fees are charged to your Apple ID or Google account upon confirmation of purchase
Sales tax may be added where applicable
Weekly and Yearly subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
Your account will be charged for renewal within 24 hours prior to the end of the current period
You can manage and cancel subscriptions in your device's account settings (Apple ID or Google Play)
If a free trial is offered:
The trial period will be specified at the time of offer
You will not be charged during the trial period
If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged
Refund requests are handled by Apple or Google according to their respective policies
We do not have direct access to process refunds
Contact Apple Support or Google Play Support for refund inquiries
We reserve the right to change subscription prices. Any price changes will:
Take effect at the start of the next billing cycle following notice
Be communicated in advance through the App or app store listing
Not affect your current billing period
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:
Download and install the App on devices you own or control
Use the App for personal, non-commercial purposes
You agree NOT to:
Copy, modify, or distribute the App or any content within it
Reverse engineer, decompile, or disassemble the App
Remove or alter any proprietary notices, labels, or marks
Use the App for any illegal or unauthorized purpose
Attempt to gain unauthorized access to any portion of the App
Use the App to infringe upon the rights of others
Redistribute, sublicense, rent, or lease the App
Use automated systems or bots to access the App
Extract or scrape any content, data, or materials from the App
The App and all content, features, and functionality (including but not limited to text, graphics, images, animations, music, audio, video, software, and code) are owned by TidalAurum, LLC or our licensors and are protected by copyright, trademark, and other intellectual property laws.
"Miss Focus," the Miss Focus logo, and all related names, logos, and designs are trademarks of TidalAurum, LLC. You may not use these trademarks without our prior written permission.
All music and audio content in the App is licensed for use within the App only. You may not:
Extract, download, or copy music files from the App
Use the App's audio content in your own projects or productions
Redistribute or publicly perform the audio content
You retain ownership of any notes, diary entries, or other content you create within the App ("User Content"). By using the App, you understand that:
User Content is stored locally on your device
We do not have access to your User Content
You are solely responsible for backing up your User Content
We are not responsible for any loss, corruption, or deletion of User Content due to:
Device failure or damage
App updates or reinstallation
Operating system changes
User error
Any other cause
Your privacy is important to us. Please review our Privacy Policy, which explains how we handle information related to your use of the App. By using the App, you agree to our Privacy Policy.
The App is distributed through the Apple App Store and Google Play Store. Your use of these platforms is subject to their respective terms and conditions.
The App may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of third-party sites.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

The App will meet your specific requirements
The App will be uninterrupted, timely, secure, or error-free
Results from using the App will be accurate or reliable
Any errors in the App will be corrected
Miss Focus is a productivity tool and is not intended to:
Diagnose, treat, cure, or prevent any medical condition
Replace professional medical advice
Serve as a treatment for attention disorders or other conditions
Consult a healthcare professional for medical concerns.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TIDALAURUM, LLC, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY:
INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE APP
UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA
ANY OTHER MATTER RELATING TO THE APP
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY US DOLLARS ($50), WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
You agree to defend, indemnify, and hold harmless TidalAurum, LLC and its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney's fees) arising from:
Your use of the App
Your violation of these Terms
Your violation of any third-party rights
Any User Content you create
You may terminate your use of the App at any time by:
Uninstalling the App from your device
Canceling any active subscriptions through your device settings
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination:
Your license to use the App is revoked
You must delete all copies of the App from your devices
Provisions that by their nature should survive termination will remain in effect (including ownership, disclaimers, indemnification, and limitations of liability)
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting within the App or on our website.
Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
We encourage you to review these Terms periodically.
These Terms shall be governed by and construed in accordance with the laws of the State of [Your State], United States, without regard to its conflict of law provisions.
Any dispute arising from these Terms or your use of the App shall be resolved through:

These Terms, together with the Privacy Policy, constitute the entire agreement between you and TidalAurum, LLC regarding the App.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer these Terms or your rights hereunder. We may assign our rights and obligations without restriction.
These Terms do not confer any third-party beneficiary rights except as expressly provided.
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.
