Preamble
The purpose of these general conditions of use (hereinafter referred to as the “GCU”) is to determine the rules governing the use of the “Allo Mairie Nice” mobile application published by the City of Nice. Use of the Service is optional and free of charge (excluding connection costs).
Any use of the Service implies consultation and acceptance of the present general terms of use (CGU). By installing the application on your terminal and/or by accessing the application, as a visitor and/or user, you unconditionally and unreservedly accept the entirety of the GCU defined below.
Article 1. DEFINITIONS
Allo Mairie Nice is available free of charge in Apple's “Apple Store” and Google's “Google Play Store” for download by the user on his Apple iOS and Android terminal. Allo Mairie Nice also includes content, software, programs, tools (programming, navigation, etc.), databases, operating systems, documentation and all other elements and services that make it up, as well as updates and new versions that may be made to Allo Mairie Nice by the City of Nice.
“Content” refers to, but is not limited to, the structure of Allo Mairie Nice, editorial content, drawings, illustrations, images, photographs, graphic charters, trademarks, logos, acronyms, corporate names, audiovisual works, multimedia works, visual content, audio and sound content, as well as any other content present within Allo Mairie Nice and/or any other element making up Allo Mairie Nice.
“Services” refers to the various features and services offered by Allo Mairie Nice.
“Site” refers to the official website of the City of Nice at the following address: https://www.nice.fr
“User” or “you” means an individual of legal age or a minor who has obtained prior authorization from his or her parents or legal guardian, and who has downloaded Allo Mairie Nice for his or her own needs, for strictly personal and non-commercial use, without any direct or indirect profit-making purpose.
Article 2. PURPOSE OF THE APPLICATION
Allo Mairie Nice is designed to give you access to information and services offered by the City of Nice.

Several services are offered to the user, including :
- reporting disturbances or incivilities on the public highway ;
- direct contact with the municipal police;
- a calendar of events in Nice;
- information on the City of Nice's areas of competence: culture and leisure, youth, sports, etc.Â
- online procedures in the practical life category: make an appointment at an annexed town hall, apply for a birth certificate or passport...Â
- features for sharing Allo Mairie Nice on the Facebook and Twitter social networks; This list may be modified at any time by the City of Nice, without any liability on its part.
Article 3. ACCESS TO THE APPLICATION
To access and use Allo Mairie Nice, you must have a compatible telephone or mobile terminal and access to the Internet.
Allo Mairie Nice can be downloaded free of charge from the “Apple Store” and “Google Play Store” platforms on the following mobile terminals:
- Apple® Iphone® cell phone running iOS 16 or higher - Android® API 9 or higher The software version of Allo Mairie Nice may be updated from time to time to add new functions and services.

Article 4. SERVICE SIGNALEMENT
The reporting of disorder or incivilities on the public highway is accessible via a form on Allo Mairie Nice.Â
The fields marked with an asterisk (location, category, description, first name, last name, e-mail) must be completed on the reporting form to enable the City of Nice departments to process your request. If these fields are not completed, no request can be validated and therefore taken into account by the services of the city of Nice. Other fields are optional (photo, telephone).
Use of the geolocation feature (location) as part of the Allo Mairie Nice reporting service requires the user's express prior consent to be geolocated. To do so, the user must activate the geolocation function directly in the settings of their mobile terminal, if they so wish, and accept that Allo Mairie Nice may use it. This function can be deactivated or activated at any time, free of charge.
By accepting the GPS geolocation function on the cell phone and Allo Mairie Nice, the user can specify his or her location when reporting a disturbance or incivility on the public highway.
 The report must be geolocated before it can be processed.

The reporting categories covered by this form are: cleanliness; illegal dumping; water and sanitation; technical problems; traffic and parking; natural hazards.

When using the reporting service, the user undertakes :
- not to report any incivility or disorder originating in a private area. In a context or in circumstances likely to infringe on privacy, the user undertakes not to take a photograph of a natural person or any element relating to a natural person and allowing direct or indirect identification.
- not to use the reporting form outside the territory of the city of Nice
- not to transmit photos of a personal nature (e.g. license plates, photos of people, etc.).
Article 5. FINANCIAL CONDITIONS
Allo Mairie Nice is offered free of charge to users, excluding the cost of subscription to the mobile telephone operator, the cost of connection and access to the Internet network, and any additional costs charged for loading data.
Article 6. APPLICATION OF THE GCU
The GCU apply to all users of Allo Mairie Nice.
The user is invited to read the GCU carefully on each visit, which can be accessed by clicking on the pictogram on the pages of Allo Mairie Nice and which may be modified at any time and without notice by the City of Nice.
Allo Mairie Nice may be updated on a regular basis. In this respect, any application downloaded by a user has a limited validity in time, taking into account these updates to be imperatively downloaded and possible technical, legislative or regulatory evolutions, of which the city of Nice has no control.
Article 7. INTELLECTUAL PROPERTY OF THE APPLICATION
The City of Nice is the exclusive owner of all intellectual property rights pertaining to Allo Mairie Nice and its content.Â
Without prejudice to the foregoing stipulations, none of the provisions of the GCU may be interpreted as an assignment, transfer, sale, concession, license, loan, lease or authorization to operate granted directly or indirectly by the City of Nice to the user of Allo Mairie Nice and its content and/or services.
Article 8. USER LICENSE
The City of Nice grants the user a personal right to use Allo Mairie Nice, its content and services, which is non-exclusive, revocable, non-assignable, non-transferable, worldwide and free of charge, solely for the user's own use of Allo Mairie Nice and its services, to the exclusion of any other purpose.
It is strictly forbidden for the user to access and/or use Allo Mairie Nice source codes and/or Allo Mairie Nice software components.
The user acquires no intellectual property rights over Allo Mairie Nice, the content and/or the services, nor any rights other than those granted herein.
This license does not grant the user any right to use the content. The user is therefore prohibited from reproducing, representing, adapting and/or exploiting any of the content.
The user expressly agrees that the use of Allo Mairie Nice shall in no way infringe the rights of the City of Nice, and in particular that such use shall not constitute an act of counterfeiting, unfair competition or parasitic use of the content.

Article 9. CONDITIONS OF USE
The user expressly agrees :
- to download Allo Mairie Nice onto his or her equipment exclusively for personal use;
- not to reproduce Allo Mairie Nice permanently or temporarily, in whole or in part, by any means and in any form;
- to notify emergency services in the event of imminent danger: 17 for the police, 15 for the ambulance service and 18 for the fire department;
- not to use any software or process intended to copy the content without the prior written authorization of the City of Nice;
- to refrain from adapting, modifying, translating, transcribing, arranging, compiling, decompiling, assembling, disassembling, transcoding or reverse engineering all or part of Allo Mairie Nice, the services and/or the content;
- not to export Allo Mairie Nice or merge all or part of Allo Mairie Nice with other computer programs;
- to make only short quotations, analyses and reproductions intended for press reviews, and other uses expressly authorized by law, within the limits and conditions set by the latter, and subject in particular to quoting the names of the authors and the editorial source - to refrain expressly from using software or devices likely to disrupt the smooth operation of Allo Mairie Nice, or to take any action likely to impose a disproportionate burden on the infrastructures of the City of Nice;
- not to extract or reuse, including for private purposes, without the prior written authorization of the City of Nice, any substantial or non-substantial part of the content of the databases and archives constituted by Allo Mairie Nice;
- not to set up systems likely to pirate Allo Mairie Nice and/or the content in whole or in part, or likely to violate the present GCU;
- to inform the city of Nice as soon as he/she becomes aware of any act of piracy and in particular of any illicit or non-contractual use of Allo Mairie Nice and/or the content, whatever the means of distribution; - not to sell, rent, sub-license or distribute in any way whatsoever Allo Mairie Nice and/or the content to third parties.
Article 10. PERSONAL DATA PROTECTION
The City of Nice's “Allo-Mairie” service uses IT resources to manage and track requests for information or assistance, as well as reports - relating to the public space of the City of Nice - made by Nice users in the following areas: cleanliness; illegal dumping; water and sanitation; technical problems; traffic and parking; natural hazards; other problems.

Recorded data is reserved for use by the Ville de Nice's “Allo-Mairie” service for the sole purposes defined above, and is kept for 6 months from the date of registration of requests and reports. The data recorded may only be communicated to the operational departments - municipal or metropolitan - responsible for the request or report made. These services are subject to compliance with data protection regulations.

In accordance with European Regulation 2016/679 of April 27, 2016 on data protection, and the French Data Protection Act of January 06, 1978 as amended, you have the right to access your personal data and request its rectification and deletion. You also have a right to the portability of your data, a right to limit the processing of your data and the right to organize the fate of your data post-mortem.

In the interests of confidentiality and the protection of your personal data, we must be able to verify your identity in order to respond to your request. Article 11. AVAILABILITY OF THE APPLICATION
The City of Nice undertakes to use its best efforts to ensure secure access, consultation and use of the Allo Mairie Nice services. Allo Mairie Nice is accessible 24 hours a day, 7 days a week, except in the event of force majeure or the occurrence of an event beyond the control of the City of Nice, and subject to any breakdowns and maintenance operations necessary for the proper functioning of Allo Mairie Nice.Â

Article 12. LIMITATION OF WARRANTY
Access to and use of Allo Mairie Nice are the responsibility of the user.
Allo Mairie Nice is provided “as is” and is available without warranty.
It is the responsibility of each User to take all appropriate measures to protect his/her own data and/or software stored on his/her computer and telephone equipment against any attack.
The User declares that he/she is aware of and accepts the characteristics and limits of the Internet network, and in particular the functional characteristics and technical performance of the Internet network; problems related to connection and/or access to the Internet network and/or websites; problems related to network availability and congestion; problems related to network failure or saturation; problems relating to transit times, access to information posted online, response times for displaying, consulting, querying or otherwise transferring data; risks of interruption; lack of protection of certain data against possible misappropriation or piracy; risks of contamination by any viruses circulating on said networks, etc. for which the City of Nice cannot be held responsible.
The City of Nice cannot be held responsible :
- in the event of failure, loss, delay or error in data transmission beyond its control ;
- messages and/or data sent to a false, erroneous or incomplete address;
- if data is not received, for any reason whatsoever, or if the data received is illegible, incomplete or impossible to process;
- if the user is unable to access or use Allo Mairie Nice for any reason whatsoever;
- if, for any reason whatsoever, the connection is interrupted.
Furthermore, the city of Nice declines all responsibility in the event of misuse of the terminal and/or incidents related to the use of the terminal while using Allo Mairie Nice. The city of Nice cannot be held responsible for any damage of any kind caused to users, their terminals, their computer and telephone equipment and the data stored on them, nor for the consequences this may have on their personal, professional or commercial activity.
Article 13. CHANGES TO GENERAL TERMS AND CONDITIONS OF USE
The terms and conditions of use applicable are those in effect at the time the user connects to and uses Allo Mairie Nice.
The city of Nice reserves the right to modify, at any time, all or part of the provisions of the GCU without prior notice or information to users in order to adapt them to changes in services, technical developments, legal or jurisprudential or when new services are introduced.
Any changes made by the city of NICE to the GCU will be brought to the attention of users simply by posting them online. They are deemed accepted without reservation by any user accessing Allo Mairie Nice after said posting. The City of Nice therefore invites all users to consult the GCU on a regular basis.
Any new Service integrating new techniques or new features improving the quality of existing services will also be subject to the present GCU, unless expressly provided otherwise.
Article 14. TERMINATION OF THE APPLICATION
The city of Nice may terminate the use of Allo Mairie Nice at any time by giving notice of termination to the user if the GCU are not respected.
Upon termination, the rights and licenses granted to you will terminate and you must cease all use of Allo Mairie Nice.

The director of development and hosting is the Direction déléguée aux Systèmes d'Informations of the Métropole Nice Côte d'Azur and the City of Nice. The publication director is the Communications Department of the Metropole Nice Côte d'Azur and the City of Nice.
ARTICLE 16. APPLICABLE LAW
These GCU are governed by French law.
Any dispute or contestation relating to the execution or interpretation of these rules which cannot be settled amicably between the parties shall be submitted to the competent courts of the Nice administrative tribunal.
GDPR Notice
The information collected is subject to computer processing implemented by the AlloMairie service of the Métropole Nice Côte d'Azur, for the purposes of:
- Take into account reports from citizens on the territory of the Métropole Nice Côte d'Azur and ensure its follow-up;
- Forward the request to the department(s) concerned;
- Statistically monitor response times;Â
- Improve service quality.
The collection of your data, necessary to process your request, is based on the performance of a mission in the public interest or in the exercise of public authority (art.6.1 e).Â
The data recorded is reserved for the use of authorized personnel of the departments of Métropole Nice Cote d'Azur, Ville de Nice and AlloMairie, for the sole purposes defined above. It is kept in the active database for the duration of the processing of the report, then 13 months after the request has been taken into account, and then deleted.
