These Terms of Use ("Terms") govern your use of the Aerial IPTV Player mobile application ("Aerial", "the app", "we", "our", "us"). Please read them carefully.
In short:
Aerial is a media player. It does not include, sell, host, or recommend any channels, playlists, or content. You may only add content you own or are licensed to use, and you are responsible for it. The app is free with ads, and an optional auto-renewing subscription, Aerial Premium, removes the ads. The app is provided "as is".
By downloading and using the app, you agree to these Terms and to Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/), which applies in addition to these Terms. If these Terms and Apple's agreement conflict, Apple's agreement prevails on the points it covers. If you do not agree, do not use the app.
1. What the App Is
Aerial is a general-purpose player for IPTV playlists (M3U/M3U8), Xtream Codes API services, and XMLTV program guides that you supply. The app ships with no content. We do not operate, resell, endorse, or have any relationship with any IPTV service, and we have no control over the availability, quality, or legality of streams supplied by third parties.
2. Your Content and Your Responsibility
2.1 Rights to content
You represent that you own, or hold all necessary rights and licences for, every playlist, stream, guide, and image you add to the app, for example content from your Internet Service Provider, a licensed IPTV subscription, free-to-air or public-domain sources, or your own media.
2.2 Lawful use
You must not use the app to access, distribute, or record content that infringes copyright, trademark, or other rights, or that is unlawful in your country. You are solely responsible for the content you add, for any fees your providers charge, and for complying with your providers' terms.
2.3 Family features
Passcode locks and hidden channels are convenience tools. They are not a substitute for parental supervision.
3. Licence
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on Apple devices you own or control, as permitted by the App Store Usage Rules. You may not copy, modify, distribute, sell, rent, reverse-engineer, or create derivative works of the app, remove any notices, or use the app to build a competing product.
4. Prohibited Use
You agree not to: (a) use the app for any unlawful purpose; (b) circumvent digital rights management or geo-restrictions; (c) redistribute, rebroadcast, or publicly perform streams through the app; (d) interfere with the app or with the servers of third parties; (e) interfere with, block, or automatically click advertising shown in the app, or misuse the subscription or its free trial; (f) use the app if you are under the minimum age required in your jurisdiction.
5. Intellectual Property and Takedown Notices
The app, its design, icon, name, and code are our property or that of our licensors. Because the app hosts no content, we cannot remove third-party streams; notices concerning specific content should be directed to the provider hosting it. If you believe the app itself infringes your rights, contact us at the address below with sufficient detail and we will respond promptly.
6. Advertising
The free version of Aerial shows advertising, including banner, native and full-screen ads, provided by third parties. We do not control the content of third-party ads, and we are not responsible for products or services they promote. How ad data is handled is described in our Privacy Policy.
7. Aerial Premium Subscription
7.1 What it is
Aerial Premium is an optional auto-renewing subscription that removes ads from the app. It does not add channels or content, because the app provides none. Plans: Weekly, Monthly and Yearly. At times we may offer a discounted Yearly plan. The price of each plan, in your currency, is shown on the purchase screen before you buy.
7.2 Free trial
The Weekly plan may include a 3-day free trial for eligible Apple IDs. If you do not cancel at least 24 hours before the trial ends, the subscription starts and your Apple ID is charged the Weekly price. A trial can be used once per Apple ID. Eligibility is decided by Apple.
7.3 Payment and renewal
Payment is charged to your Apple ID account at confirmation of purchase. The subscription renews automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
7.4 Managing and cancelling
You can manage or cancel at any time in iOS Settings > [your name] > Subscriptions, or in the app from Settings > Manage subscription. Deleting the app does not cancel a subscription. Cancelling stops the next renewal; you keep Premium until the end of the period you already paid for.
7.5 Refunds
Payments and refunds are handled by Apple. To request a refund, use reportaproblem.apple.com. We cannot issue refunds ourselves, because we do not receive your payment.
7.6 Restore and devices
Premium is tied to your Apple ID, not to an account with us. Use "Restore" on the purchase screen or in Settings to recover it after reinstalling or on a new device signed in with the same Apple ID. Family Sharing is not enabled for these subscriptions.
7.7 Price changes
If we change a price, Apple will notify you where required, and you can cancel before the change takes effect.
8. Updates and Availability
We may update, change, or discontinue the app or any feature, plan or price at any time. Features depend on your device, iOS version, network, and the third-party services you use, none of which we control.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT STREAMS WILL PLAY, BE ACCURATE, OR BE UNINTERRUPTED. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR CONTENT, ARISING FROM YOUR USE OF THE APP OR OF ANY THIRD-PARTY CONTENT, AD OR SERVICE ACCESSED THROUGH IT. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP AND SUBSCRIPTIONS IN THE TWELVE MONTHS BEFORE THE CLAIM, OR TEN US DOLLARS IF YOU PAID NOTHING.
11. Indemnity
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from content you add to the app or from your breach of these Terms.
12. Termination
These Terms remain in effect until terminated. You may terminate at any time by deleting the app and cancelling any subscription. We may terminate or suspend your licence if you breach these Terms. Sections 2, 5, 9, 10, 11 and 13 survive termination.
13. Governing Law
These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to conflict-of-law rules, and disputes shall be brought before the competent courts of Vietnam, unless mandatory consumer law in your country of residence provides otherwise. Apple is a third-party beneficiary of these Terms and may enforce them against you.
14. Changes to These Terms
We may revise these Terms from time to time. The "Effective Date" above reflects the latest revision. Continued use of the app after a change constitutes acceptance. A change to a subscription's price or terms applies from its next renewal, and you may cancel before then.
