Holomi: Live 3D AI Roleplay (“the App,” “we,” “us,” or “our”) respects the intellectual property rights of copyright owners, creators, artists, developers, and other rights holders.

This DMCA Copyright Policy explains how copyright owners may report content that they believe infringes their rights and how affected parties may submit a counter-notification.

This Policy applies to content made available through the App, including, where applicable:

• Character images, artwork, illustrations, and animations
• 3D character models and visual assets
• Character names, profiles, biographies, greetings, and descriptions
• Videos, Reels, previews, backgrounds, and other media
• Written stories, dialogue, prompts, and roleplay content
• AI-generated text or visual content displayed through the App
• Icons, interface assets, audio, and other copyrighted material
• Content submitted, suggested, reported, or otherwise provided by users or third parties

1. Reporting Copyright Infringement

If you believe that copyrighted material available through the App infringes your copyright, you may submit a written copyright infringement notification to:

Your notification should contain all of the following information:

Where available, please provide:

• The character name
• The character profile or category
• A screenshot of the relevant material
• The screen or section where it appears
• A direct link or other content identifier
• A description of the image, video, model, text, or other material
• The date on which you observed the material

A notice may use wording substantially similar to the following:

“I have a good-faith belief that the use of the copyrighted material described in this notice is not authorized by the copyright owner, its agent, or the law. I declare, under penalty of perjury, that the information in this notice is accurate and that I am the copyright owner or am authorized to act on behalf of the copyright owner.”

Incomplete notices may delay our ability to investigate or respond.

2. Review and Response Process

After receiving a sufficiently complete copyright notification, we may:

• Review the identified material and available records
• Request additional information or evidence
• Temporarily restrict access to the material while reviewing the claim
• Remove or disable access to material that appears to be infringing
• Notify the party responsible for or associated with the affected material
• Preserve relevant records when legally or operationally necessary
• Take other action that we reasonably consider appropriate

Submitting a notice does not guarantee that material will be removed. We may decline or limit action when a notice is incomplete, inaccurate, unsupported, fraudulent, unrelated to copyright, or otherwise legally deficient.

We may also consider whether the reported use may be authorized by a license, an exception or limitation to copyright, fair use, public-domain status, or another applicable legal basis.

3. Counter-Notification

If you believe that material was removed or disabled because of a mistake or misidentification, you may submit a written counter-notification to:

The counter-notification should include:

A counter-notification may use wording substantially similar to the following:

“I declare, under penalty of perjury, that I have a good-faith belief that the material identified above was removed or disabled as a result of mistake or misidentification. I consent to the jurisdiction of the applicable United States Federal District Court and agree to accept service of process from the person who submitted the original notification or that person’s agent.”

After receiving a valid counter-notification, we may send a copy to the original claimant. Where applicable, the disputed material may be restored unless the original claimant informs us that legal action has been filed to prevent restoration.

We may decline to restore material when restoration would violate applicable law, platform policies, contractual obligations, user-safety requirements, or the rights of another party.

4. Repeat Infringement

Where appropriate and in suitable circumstances, we may restrict or terminate access for users, contributors, content providers, or other parties who repeatedly infringe copyrights or repeatedly submit unauthorized content.

We may consider factors such as:

• The number and credibility of infringement reports
• Whether the reports concern separate works or repeated conduct
• Whether the person knowingly submitted infringing material
• Whether valid counter-notifications were submitted
• Whether a court or competent authority has made a relevant determination
• Evidence of fraud, abuse, impersonation, or deliberate evasion

We reserve the right to remove content or restrict access after a single incident when the circumstances warrant such action.

5. AI-Generated Content

The App may use artificial intelligence to generate fictional character dialogue, roleplay responses, recommendations, or other content.

Because AI-generated content may be influenced by prompts, character settings, conversation context, model behavior, and third-party services, users should not instruct the App to reproduce copyrighted works, protected characters, distinctive creative content, or other material that they do not have permission to use.

AI-generated content is not automatically exempt from copyright law. A copyright complaint may be submitted when a person believes that content generated, displayed, or distributed through the App unlawfully reproduces protected expression.

When reviewing a complaint involving AI-generated content, we may consider:

• The allegedly infringed work
• The specific generated or displayed material
• The degree of similarity between the materials
• The prompt or context involved, where available and lawfully reviewable
• Whether the material was generated, uploaded, selected, or modified by a user or provider
• Any license, authorization, exception, or other relevant legal basis

We do not guarantee that AI-generated content will be original, non-infringing, or suitable for any particular use.

6. Characters, Names, Likenesses, and Other Rights

Copyright does not protect every name, title, idea, concept, style, theme, historical fact, or short phrase. Some complaints may instead involve trademarks, publicity rights, privacy rights, impersonation, defamation, or other legal rights.

When submitting a complaint, clearly identify:

• The rights you believe are affected
• The material at issue
• The legal or factual basis for your claim
• Your relationship to the affected work, person, brand, or property

A notice submitted under this Policy should not knowingly mischaracterize a trademark, privacy, impersonation, or other dispute as a copyright claim.

We may review non-copyright complaints under other applicable policies or request additional information.

7. Misrepresentations and Abuse

Do not knowingly submit false, misleading, fraudulent, or abusive copyright notices or counter-notifications.

A person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be responsible for damages and other consequences under applicable law.

We may reject communications that:

• Contain false or materially misleading statements
• Are submitted to harass, intimidate, censor, or impersonate another person
• Do not identify a protected work or specific disputed material
• Assert ownership without reasonable supporting information
• Attempt to misuse the copyright process for unrelated disputes
• Contain malicious files, spam, threats, or unlawful content

8. Information Shared During the DMCA Process

When handling a copyright notice or counter-notification, we may share the submitted information with:

• The person or entity associated with the disputed material
• The original claimant or counter-claimant
• Our service providers, advisers, or legal representatives
• Hosting, AI, content delivery, or platform providers
• Courts, authorities, or other parties when required by law

This means that your name, contact details, statements, and other information included in a notice or counter-notification may be disclosed to the opposing party.

Do not include information that is unrelated to the copyright claim. By submitting a notice or counter-notification, you acknowledge that the information may be processed and disclosed as necessary to evaluate and respond to the request.

9. Preservation of Evidence

We may preserve copies of reported material, notices, counter-notifications, correspondence, account or device identifiers, technical logs, and related records for purposes including:

• Investigating the claim
• Responding to a counter-notification
• Preventing repeated infringement
• Handling disputes or legal proceedings
• Complying with legal obligations
• Protecting the App, its users, and third parties

Removal of material from public or user-facing areas does not necessarily mean that all internal or backup copies will be deleted immediately.

10. No Legal Advice

This Policy provides general information about our copyright complaint process. It does not constitute legal advice and does not determine whether a particular use is infringing, licensed, fair use, or otherwise lawful.

Copyright matters can involve complex legal and factual questions. Parties should consider obtaining advice from a qualified legal professional before submitting a notice, counter-notification, or legal claim.

11. Changes to This Policy

We may update this DMCA Copyright Policy to reflect changes to:

• The App or its content features
• Applicable laws and regulations
• Our copyright review procedures
• Service providers or platform requirements
• Operational, legal, or safety considerations

When this Policy is updated, we will revise the Effective Date above.
