IDEA Section 1401: “assistive technology device” means any item, piece of equipment, or product system, whether acquired commercially off the shelf, modified, or customized, that is used to increase, maintain, or improve functional capabilities of a child with a disability. Assistive Technology is a broad group of tools and services that support student access to their curriculum and their ability to learn alongside peers with a similar amount of time and effort.
If data indicates that a student with a disability needs AT tools to support access or effort, it must be reflected on their IEP or 504 plan. This is true regardless of the tools that are available to all students. If the student cannot access the curriculum without the tool (and data supports the need), then it must be included in the plan.
