This Privacy Policy applies no matter which of our stores, sites, applications, or website features you use or access, as well as any mobile application (each, an “App”) that includes an authorized link to this Privacy Policy (together the stores, our websites and Apps are referred to as the “Services”). Your use of our Services is also subject to our Terms of Use.

By using our Services, you agree to the collection, use, disclosure, and procedures this Privacy Policy describes. Please note that this Privacy Policy does not apply to third party websites (“Third Party Services”), such as Facebook, Twitter, Pinterest, Instagram, Snapchat, and Google+, that we do not own or control, even if you access them through our Services. We try to work only with Third Party Services that share our respect for your privacy, but we cannot take responsibility for their practices, content, or privacy policies. We encourage you to carefully review the privacy policies of any Third Party Services you access so that you know how they will collect, use, and share your information.

Personally Identifiable Information

We will never share your e-mail address or personal information for any external use. All information collected on this website will be used for fraud control, order verification or internal marketing purposes only. We may use third party services to help manage communication, but the contracting terms with these services absolutely prohibits their use or distribution of information we store on their servers, and these services use high-level encryption to protect your data. At any time, you will be able to remove your email or other contact information from our systems by emailing us at NLapp@newlook.ca.

Uploaded 3D Scan Videos

The videos recorded in the app’s interactive capture flows used to create a 3D model of your face (the “selfie” video and the “scale” or “calibration” video) are private, and not considered “User Content” as defined elsewhere in this policy. We process and store these videos on our cloud-based servers, and then transmit the 3D model back to your phone. A copy of the video may also be stored locally on your device. We will not share your videos or likeness with any third party unless you explicitly ask us to. We will only use your videos to respond to technical support inquiries or to improve the fitting algorithm.If at any time, you would like these videos removed from our servers, please email us at NLapp@newlook.ca and we will accommodate the request. If we delete your scan at your request, we will be unable to complete an order without you subsequently uploading another scan.

TrueDepth API

The Service also makes use of automatically collected information using the device camera and the TrueDepth API provided by Apple. The only use of this information is to create measurements of your head, for the bespoke glasses. None of the information collected by the TrueDepth API ever leaves the user's device nor is it persistently stored on the device.

Face model data is stored on password-protected servers hosted by Google and Amazon, both of whose web services are considered safe enough to store and transmit private health record data and financial data -- two types of data which are covered by the most stringent privacy regulations.

Email Conversations and Chats with Customer Support

Direct communications with the Topology or New Look staff exist for the purpose of educating and informing users about our products, helping them make selections, and discussing their orders with them. As such, any information or images shared by email with our customer service inboxes (NLapp@newlook.ca), shared through the chat feature of our app, or sent to us via Direct Message on Facebook or Twitter is not considered User Content as described below. This information will not be shared externally without explicit permission from the user. It may be shared internally within the company as necessary to train our employees or to help a customer fulfill their requests.‍

Website Cookies

Our website uses cookies in order to ensure a consistent experience for any individual user across all touch points with Topology. Using a browser feature that blocks cookies will not restrict access to our website, though it may lead to less optimal performance.

User Content

All information, likenesses, photographs, and videos not mentioned above that is transmitted or posted to our Services or to Topology’s application or page on third party sites (such as Facebook, Youtube, Twitter, etc.) falls under our User Content policy outlined in our terms of service. Examples include, but are not limited to, NPS survey responses and iOS app store reviews. Users do not transfer ownership of their user content, but they do warrant that the content is theirs to share and that it is appropriate for the service, and they do grant license to Topology and to other users of Topology’s services to distribute and use as they wish. California Privacy Rights

If you are a California resident, you have the ability to ask us for a notice identifying the categories of personal information, as defined by California Civil Code Section 1798.83, we share with our affiliates and/or third parties for their direct marketing purposes and the contact information for such affiliates and/or third parties (under California Civil Code Sections 1798.83-1798.84). If you are a California resident and would like a copy of this notice, please submit a written request to NLapp@newlook.ca.

Children’s Information

We are especially sensitive about children’s information. We do not knowingly collect personal information from children under the age of 13, in accordance with the Children’s Online Privacy Protection Act (“COPPA”). If you are a parent or legal guardian of a minor child, you may use our Services on behalf of such minor child. If you have questions concerning our information practices with respect to children, or if you believe a child under the age of 13 has provided us with personal information, please email us at NLapp@newlook.ca.

Changes to this Privacy Policy

We occasionally review this Privacy Policy to make sure it complies with applicable laws and conforms to changes in our business. We may need to update this Privacy Policy, and we reserve the right to do so at any time. If we do revise this Privacy Policy, we will update the “Effective Date” at the top of this page so that you can tell if it has changed since your last visit. Your continued use of our Services constitutes your acceptance of the terms of the Privacy Policy as amended or revised by us from time to time.
