This DMCA Policy applies to the Android application Anime Shimeji: Screen Pets, its Google Play listing, the website www.tomodev.vn, and related services operated by TOMODEV (“we,” “us,” or “our”).

We respect the intellectual property rights of artists, creators, copyright owners, licensors, publishers, studios, and other rights holders.

1. Scope of This Policy

Anime Shimeji: Screen Pets is an Android personalization application that may include:

• Animated Shimeji pets;

• Pet animations and visual effects;

• Emoji Battery designs;

• Emoji Stickers;

• Status Bar themes;

• Icons, backgrounds, graphics, and other visual content.

This Policy explains how copyright owners or their authorized representatives may report material that they believe infringes their rights.

2. Ownership and Licensed Content

The App, including its software, user interface, branding, original graphics, text, layout, animations, icons, and other original materials, is owned by or licensed to us and may be protected by copyright, trademark, and other intellectual property laws.

Content available in the App may be:

• Created or commissioned by us;

• Licensed from artists, creators, publishers, or other rights holders;

• Obtained under open-source, Creative Commons, stock-content, or similar licenses;

• Used with authorization;

• Otherwise used as permitted by applicable law.

Users receive a limited, revocable, non-exclusive, and non-transferable right to use the App and its content for personal and lawful purposes.

3. Third-Party Characters, Brands, and Trademarks

Unless expressly stated, Anime Shimeji: Screen Pets is not affiliated with, sponsored by, endorsed by, or officially connected with any third-party anime studio, manga publisher, game developer, character owner, artist, entertainment company, brand, or franchise.

Third-party trademarks, logos, character names, artwork, and copyrighted works remain the property of their respective owners.

Any reference to a third-party work does not imply ownership, endorsement, sponsorship, or official affiliation.

4. Reporting Copyright Infringement

If you are a copyright owner or are authorized to act on behalf of one, and you believe that content in the App, its Google Play listing, or our website infringes your copyright, please send a written notice to:

5. Required Information in a Notice

A copyright infringement notice should include:

1. A physical or electronic signature of the copyright owner or authorized representative;

2. Identification of the copyrighted work claimed to have been infringed;

3. Identification of the allegedly infringing material and information reasonably sufficient for us to locate it, such as:

   • The pet, animation, sticker, icon, theme, or content-pack name;

   • Screenshots or screen recordings;

   • The section of the Android App where the material appears;

   • App version;

   • Android package name;

   • Google Play listing URL;

   • Website URL, where applicable;

   • A description of the alleged infringement;

4. The claimant’s full legal name, mailing address, telephone number, and email address;

5. A statement that the claimant has a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;

6. A statement, made under penalty of perjury, that the information in the notice is accurate and that the claimant is the copyright owner or is authorized to act on behalf of the copyright owner.

A notice may include the following statement:

“I state under penalty of perjury that the information in this notice is accurate and that I am the copyright owner or am authorized to act on behalf of the copyright owner. I have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.”

6. Review and Response

After receiving a substantially complete notice, we may:

• Confirm receipt;

• Request additional information or evidence;

• Review the identified content and available licensing records;

• Contact the relevant artist, licensor, supplier, or content provider;

• Temporarily restrict the disputed content;

• Remove or replace the content in an App update;

• Remove or revise content in the Google Play listing or website;

• Take other action considered appropriate under applicable law.

Submitting a notice does not guarantee immediate removal.

We may decline or delay action where a notice is incomplete, inaccurate, fraudulent, abusive, or does not provide enough information to identify or evaluate the material.

We may share the notice and the claimant’s contact information with relevant licensors, suppliers, legal advisers, or other parties involved in resolving the complaint.

7. Counter-Notification

If content supplied or licensed by you is removed because of a copyright notice and you believe the removal resulted from mistake or misidentification, you may submit a written counter-notification to:

The counter-notification should include:

1. Your physical or electronic signature;

2. Identification of the material removed or disabled and where it appeared before removal;

3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;

4. Your full legal name, mailing address, telephone number, and email address;

5. Where the United States DMCA applies, a statement consenting to the jurisdiction of the appropriate United States Federal District Court or, if you are outside the United States, an appropriate judicial district in which the service provider may be found;

6. A statement that you will accept service of process from the person who submitted the original notice or that person’s authorized agent.

8. Restoration of Content

Where applicable law permits and we receive a valid counter-notification, we may forward it to the original claimant.

The disputed material may be restored within the period allowed by applicable law unless the original claimant informs us that legal proceedings have been filed seeking a court order.

We may decide not to restore material where removal is independently required by:

• Applicable law;

• Google Play policy;

• A licensing agreement;

• A contractual obligation;

• Security or safety considerations;

• Our editorial or business decision.

9. False or Misleading Claims

Do not knowingly submit false, misleading, fraudulent, or abusive notices or counter-notifications.

A person who knowingly materially misrepresents that content is infringing, or that content was removed by mistake, may be responsible for damages, costs, and legal fees under applicable law.

We may reject complaints submitted for harassment, censorship, competitive interference, fraud, or enforcement of rights not owned or controlled by the claimant.

11. Google Play Complaints

Anime Shimeji: Screen Pets is distributed as an Android application through Google Play.

Rights holders may also use Google Play’s applicable copyright or legal reporting process. A complaint submitted to Google does not replace the need to provide us with sufficient information to identify and review the disputed content.

We do not control Google Play’s review process, response time, or enforcement decisions.

12. Repeat Infringement

We may terminate or restrict relationships with artists, licensors, contractors, suppliers, or other content sources that repeatedly provide infringing material.

We may also permanently remove disputed content from the App and prevent it from being included in future Android releases.

13. No Legal Advice

This Policy is provided for informational and operational purposes and does not constitute legal advice.

Copyright notices and counter-notifications may have legal consequences. Parties should consider seeking advice from a qualified legal professional where ownership, licensing, authorization, or lawful use is disputed.
