Welcome to OnDuty (the "Application"). This End User License Agreement ("Agreement" or "EULA") is a legal agreement between you (the "End User" or "you") and OnDuty App ("Licensor", "we", "us", or "our").
By downloading, installing, accessing, or using the Application, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not download, install, or use the Application.
You and the End User acknowledge that this Agreement is concluded between you and Licensor only, and not with Apple, Inc. ("Apple"). Licensor, not Apple, is solely responsible for the Application and the content thereof.
Licensor grants you a limited, non-exclusive, non-transferable, revocable license to use the OnDuty Application on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions (the "Usage Rules").
OnDuty offers premium features and utility tools via auto-renewing subscription plans ("Subscriptions").
Subscription Pricing & Cycle: Subscription pricing and billing intervals (e.g., monthly, annually) are clearly detailed within the Application’s checkout screens and/or paywalls.
Payment & Confirmation: Payment will be charged to your Apple ID account at confirmation of purchase.
Auto-Renewal: Your Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period.
Renewal Charges: Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period. The cost of the renewal will match the initial subscription price unless you are otherwise notified.
Managing Subscriptions: You can manage or cancel your subscription at any time, and turn off auto-renewal, by going to your App Store Account Settings after purchase.
No Refunds: Except as provided under applicable law or by Apple’s billing policy, all purchases are final and non-refundable.
Licensor is solely responsible for providing any maintenance and support services with respect to the Application, as specified in this EULA or as required under applicable law. You and Licensor acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.
To the maximum extent permitted by applicable law, the Application is provided "As Is" and "As Available" with all faults and without warranty of any kind. Licensor disclaims all warranties, express or implied. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application.
IMPORTANT: OnDuty is a utility app designed for informational and organizational use by Emergency Medical Services (EMS) personnel. OnDuty does not provide medical advice, diagnosis, treatment, or direct clinical decision-making. The Application is not a substitute for professional clinical judgment, local medical protocols, or institutional guidelines. Users assume full responsibility for verifying all calculations, drug dosages, protocols, and data before applying them in a clinical setting.
You acknowledge that Licensor, not Apple, is responsible for addressing any claims of the End User or any third party relating to the Application or your possession and/or use of the Application, including, but not limited to:
Product liability claims.
Any claim that the Application fails to conform to any applicable legal or regulatory requirement.
Claims arising under consumer protection, privacy, or similar legislation.
You acknowledge that, in the event of any third-party claim that the Application or your possession and use of the Application infringes that third party’s intellectual property rights, Licensor (and not Apple) will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You represent and warrant that:
You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country.
You are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with any applicable third-party terms of agreement when using the Application (for example, you must not be in violation of your wireless data service agreement or internet service provider terms while using OnDuty).
You and Licensor acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
