What is Terminal Leave Benefits?
TERMINAL LEAVE
Sec. 35. Terminal leave. – Terminal leave is applied for by an official or an employee who intends to sever his connection with his employer. Accordingly, the filing of application for terminal leave requires as a condition sine qua non, the employee’s resignation, retirement or separation from the service. It must be shown first that public employment ceased by any of the said modes of severances. (Provided for under CSC MC No. 41, s. 1998)
PAYMENT OF TERMINAL LEAVE
Sec. 37. Payment of terminal leave. – Any official/employee of the government who retires, voluntarily resigns, or is separated from the service and who is not otherwise covered by special law, shall be entitled to the commutation of his leave credits exclusive of Saturdays, Sundays and Holidays without limitation and regardless of the period when the credits were earned.(Provided for under CSC MC No. 41, s. 1998)
Sec. 38. Period within which to claim terminal leave pay.- Request for payment of terminal leave benefits must be brought within ten (10) years from the time the right of action accrues upon an obligation created by law. (Amended by CSC MC No. 41, s. 1998)
COMPUTATION OF TERMINAL LEAVE
Sec. 40. Computation of terminal leave – The terminal leave benefits shall be computed as follows:
TLB = S x D x CF
Where:
TLB = Terminal Leave Benefits
S = Highest monthly salary received
D = No. of accumulated vacation and sick leave credits
CF = Constant factor is .0478087

Sec. 65. Effect of decision in administrative case. – An official or employee WHO HAS BEEN PENALIZED WITH DISMISSAL FROM THE SERVICE IS LIKEWISE NOT BARRED FROM ENTITTLEMENT TO HIS TERMINAL LEAVE BENEFITS.

What are the requirements for TLB?
Agency Clearance
Ombudsman Clearance
Certified Photocopy of employee leave card with computed leave credits as at last date of service by the personnel
Approved Leave Application
Complete Service Records
Statement of Assets, Liabilities, and Net Worth (SALN)
Certified Photocopy of employee leave card with computed leave credits (last date of service by the personnel)
Complete Service Record
Certified photocopy of appointment NOSA (Showing the highest salary under the last appointment)
Computation of Terminal Leave Benefits signed by the respective regions’ Chief FASD and Regional Accountant.
In case of resignation, the employee’s letter of resignation duly accepted by the Head of the Agency. Additional Requirements in case of death
• Death Certificate issued by PSA
• Marriage Certificate issued by PSA
• Birth Certificate of all surviving legal heirs issued by PSA
• Waiver of rights of children 18 years old and above if applicable
What is the process for TLB?
Step 1: Fill in the Online Terminal Leave Benefits Processing Request Form
Step 2: Submit the hardcopy of the abovementioned requirements to the Human Resource Management Division - Administrative Service (HRMD- AS) through your respective regional Finance and Administrative Services Division (FASD) for review and request to the Department of Budget and Management (DBM)
