2017 Annual Report from the HOA Information Center

As part of its function within the Division of Real Estate, each year the HOA Information and Resource Center makes available an annual report containing a legislative summary, complaint statistics and upcoming goals and objectives.

Meet Amanda from the HOA Center

We would like to introduce Amanda Lopez, the Division's new Program Assistant. Amanda is responsible for assisting the HOA Information Officer in the day-to-day operations of the HOA Information and Resource Center. Amanda primarily assists with HOA registrations, Designated Agent registrations, HOA renewals, Subdivision registrations and general licensing support. Amanda comes to the Division of Real Estate from the Division of Professions and Occupations.

When the Division receives a written complaint about one of our licensed professionals, we are required by law to investigate the activities of the licensee, or a person who is purportedly acting in a licensed capacity. On occasion, we can initiate an investigation on our own motion. The purpose of this article is to give you some information about how the Division manages the investigative process so that you know what to expect if you become the subject of a complaint.

The Division of Real Estate alerts consumers to be aware of scams targeting Colorado consumers, real estate brokers and out-of-state timeshare owners regarding the reselling of timeshares. The Division has recently received multiple calls reporting that they are cold-called, mailed or emailed solicitations from an unlicensed business entity purporting to be a full service property management company, real estate brokerage or title and escrow company that lists and sells timeshares.

Throughout the year each program at the Division of Real Estate goes through rule changes, application reviews, renewals and other related activities affecting both licensees and the consumer.

This quarter we discuss broker competency when working outside one’s normal area of expertise; and our Community Association Management investigators break down what is required to be in a management agreement and what is the required insurance requirements for CAMs.

When buying a home, what are the first things to think about? Some considerations may include: location, the quality of nearby schools, number of bathrooms and bedrooms in the home, etc. If a property is located in an HOA, then the considerations may include: what are the amenities and how high are the dues?

One important topic however is typically not addressed when buying a home within a HOA; is the replacement reserve account adequately funded?
