Your Final Paycheck

What if I don't get my final paycheck?

When you are separated from a job through no fault of your own, your employer must issue your final paycheck within 24 hours of your separation. If your employer does not issue your final pay within the timeframe, you have the right to send your employer a demand letter. The Division of Labor Standards and Statistics website provides a template for writing a demand letter. In addition to providing some basic information about your company, you will be asked to provide the total amount of wages owed along with a description.

If your company does not respond within 14 days of receiving your demand letter, they have violated the law and they may end up paying you more including penalties.

You may also file a complaint online with the Division of Labor Standards and Statistics. The Division of Labor Standards and Statistics can be contacted by email at cdle_labor_standards@state.co.us or by phone at 303-318-8441.
