There are a few key items regarding Colorado Revised Statutes 2019 Title 12 Article 120 and accompanying Rules we want to bring to your attention as they are helpful to understanding so you do not fail to meet the laws that apply to the practice of architecture.
Continuing Education. Section 12-120-416, C.R.S., and Board Rule 3(a)(2)
Remember your continuing education (CE) requirements. You are required to obtain 12 compliant HSW CE credits for each calendar year. Refer to Statute section 12-120-416, C.R.S., and Board Rule 1.4(E) for Colorado specific requirements.
Definition of the practice of architecture. Section 12-120-402(5)(a), C.R.S.
Be familiar with this definition. If you know people who may be practicing architecture without a license, you may report this to the Board, who will investigate the complaint. A primary duty of the Board and architects is to protect the health, safety and welfare of the public from unlawful practice. Those representing themselves as an architect to the public, when they are not licensed, are breaking the law. It is the licensee’s responsibility to report this to the Board. There are exceptions however, so please understand these as well.
Definition of “Responsible control”. Section 12-120-402(6), C.R.S.
Responsible control and who should stamp drawings is a very important definition to understand. The licensee who stamps the drawings must be and is considered the person in responsible control. This is one and the same person. In many cases firms have policies that only a Principal or Partner-in-Charge stamp the documents. But if this individual does not meet the definition of responsible control they may be disciplined. Board Rule 1.2 (B)(16) details the definition of responsible control, so make sure you understand the requirements and develop your stamping policies accordingly.
Disciplinary actions – grounds for discipline. Section 12-120-406, C.R.S.
There are clear actions and situations that are grounds for discipline. Be familiar with these so you do not inadvertently break the law, or know when someone else is breaking the law that should be reported to the Board.
Professional liability – insurance. Section 12-120-410, C.R.S.
