Warren Co. Ohio Chancery Court Book 4, pages 306-311, February Term 1833.

Be it remembered that heretofore, towit, at a court of common please begun and held at Lebanon in the county of Warren and State of Ohio on the fourth Monday of September being the twenty fourth day of the same month in the year of our Lord one thousand eight hundred and thirty two.  Jacob R. Schenck & Aaron R. Schenck by I. Milton Williams Esq. their solicitor filed in count here on the chancery side, his petition in the words and of the tenor following to wit.  To the honorable the Judges of the court of common pleas within and for the county of  Warren and State of Ohio, in chancery sitting.  Your petitioners Jacob R. Schenck and Aaron R. Schenck of the county and State aforesaid would humbly represent unto your Honors, that their father Ruliff Schenck, departed this life intestate about the month of December in the year eighteen hundred and thirty one, leaving a widow Hanah Schenck, and the following named children and heirs towit:  Jane Briney, wife of John Briney late Jane Schenck both of whom reside in Dark county in this state and John R. Schenck, Maria Verbryck, wife of Peter Verbryck late Maria Schenck, Sarah Schenck, Isaac Schenck, the last of whom is a minor under the age of twenty one years and your said petitioners Jacob R. Schenck and Aaron R. Schenck all of whom are residing in Warren County in this State.  Your petitioners further represents unto your honors that said Ruliff Schenck died seized in fee and possessed of the following described tracts or parcels of land towit:_ “Three hundred and forty acres of land being part of a tract of land situate lying and being in the Miami purchase in the county of Hamilton now in the county of Warren by the redivision of the state into counties and Territory of the United States North West of the river Ohio (now theState of Ohio) known by the name of section or lot  number six in the second entire Township east from the great Miami River and second entire range, being part of the lands purchased by John Cleves Symms Esq. from the United States:  said tract of three hundred and forty acres of land is to be taken on the West side of said Lot No. 6. on a line to be drawn paralell to the line between the said lot No. 6. and No. 12 thence binding North on range No. 3 east on the remainder of said Lot. No. 6. South on Lot No. 5. and west on Lot No. 12.“ which said tract of land was conveyed to said Ruliff Schenck by John Schenck, Peter Van Doran & Jacob Schenck by deed bearing date on the 11th day of April 1795._  Also “all that certain lot or parcel of land situate in the south half of section number one in the third Township of the third entire range in the miami tract (in the county of Warren) within the state of Ohio being the lot designated number three upon a plat made out agreeably to a late survey, designated to contain eighty seven acres (after deducting from the original contents of said lot the quantity of six acres and a half to be annexed to lot number two in order to compensate for a like quantity in which said number two may prove deficient” _ which said last mentioned tract was conveyed to said Ruliff Schenck by Jonathan Dayton by deed bearing date on the 12th day of September 1805.  Your petitioners further state that said tracts of land, have descended to the aforegoing named children and heirs of said Ruliff Schenck decd. as coparceners, and that his widow Hanah Schenck is entitled to her dower therein.  The premises considered, your petitioners prays pray your honors to order partition of the aforesaid described lands, by first setting off to the aforesaid widow her dower therein, and then makeing division of the residue amongst the aforenamed children and heirs of said Ruliff Schenck by assigning to each his and her respective share in severalty according to the form of the statute in such case made and provided:  and your petitioners as in duty bound will ever pray, etc. --Jacob R. Schenck, Aaron R. Schenck, I. Milton Williams sol for petitioners.  An acknowledgement of notice is attached to said bill in the words and of the tenor following towit.  We the undersigned defendants do hereby acknowledge that we have notice of the pendency & prayer of the aforegoing petition, and consent that partition may be made of the lands mentioned in the said petition and that an order for that purpose may be entered at the present term of the court of common pleas and issued returnable to the next term of said court.  Hanah (her X mark) Schenck, John R. Schenck, John D. Briney, Jane (her X mark) Briney, Peter Verbryck, Maria Verbryck, Sarah Schenck, A. H. Dunlevy Guardian ad litem for Isaac Schenck October 4t, 1832.  And thereupon the court appoint Anthony H. Dunlevy Esq. guardian ad litem for the minor defendants.  And the court order their decree to be entered in the premises in the words of the tenor following towit.  War Com Pleas.  September Term 1832  Petition for partition Dec__ Jacob R. Schenck & Aaron R. Schenck vs Hanah Schenck et al.  Be it remembered that a_ the present term of the court the above cause came on for hearing -- And thereupon the court after having examined the petition &c. are satisfied from the written acknowledgement of the defts appended to said petition that said defendants have notice of the pendency and pray_ of said petition and also that they have consented that partition be made of the premises described in said petition and that an order for that purpose be entered at the present term of the court, and issued returnable to the next term thereof. - Therefore, the court do order and dec__ that the sheriff of Warren county, cause partition to be made of the premises described the petition aforesaid by the oaths of William Coulson, James Baxter and Jacob Hall three judicious and disinterested freeholders of the vicinity by first setting off to the widow Hanah Schenck her dower therein, and then makeing partition of the residue of said premises, amongst the children and heirs of Ruliff Schenck decd. named in the aforesaid petition, by assigning to each his and her respective share in  severalty according to the prayer of said petition -  And that said sheriff make return of his proceedings hereon to the next term of this court - to which time this cause is continued to abide further order - By the court - George I. Smith Prest.  And therupon further process of and upon the premises aforesaid between the parties aforesaid and by order of the court here thereon is further continued until the fourth monday of February next en_ueing.  And afterwards on the twenty second day of October in the year of our Lord one thousand eight hundred and thirty two a writ of partition issued in the premises directed to the Sheriff of the county of Warren in the words and of the tenor following to wit.  The State of Ohio Warren County ss.  To John M. Houston Esq. Sheriff of our said county,  Greeting whereas at a court of common pleas begun and held at Lebanon in the county aforesaid on the 4t Monday of February A.D. 1832 it was so p__ proceeded on a certain petition filed in said court by Jacob R. Schenck & Aaron R. Schenck for the partition of the following described real estate late the property of Ruliff Schenck decd. to wit.  Three hundred and forty acres of land being part of a tract of land situate lying & being in the Miami purchase in the county of Warren and State of Ohio known by the name of section or lot number six in the second entire township east from the Great Miami River and second entire range being part of the lands purchased by John Cleves Symmes Esq. from the United States said tract of three hundred and forty acres of land is to be taken on the west side of said lot No. 6. on a line to be drawn paralell to the line between the said lot_ No. 6 & No. 12. thence binding north on range No. 3 east on the remainder of said lot No. 6 south on lot No. 5 and west on lot No. 12 - Also all that certain lot or parcel of land situate in the south half of section number one in the third township of the third entire range in the Miami tract (in the county of Warren in said State being the lot designated number two_ upon a plat made out agreeably to a late survey designated to contain eighty seven acres (after deducting from the original contents of said lot the quantity of six acres & a half to be annexed to lot number two in order to compensate for a like quantity in which said number two may prove deficient that said court did order & decree that the Sheriff of Warren County cause partition to be made of the premises aforesaid by the oaths of William Coulson, James Baxter and Jacob Hall by first setting off to the widow Hannah Schenck her dower therein and then making partition of the residue of said premises amongst the children & heirs of said Ruliff Schenck decd. to wit.  Jacob R. Schenck, Maria Verbryke wife of Peter Verbryck, Sarah Schenck & Isaac Schenck.  Therefore you are hereby commanded to cause dower to be set off & partition made of said premises agreeably to the requisitions of said order of court & of your proceedings hereon make return to our said court at Lebanon on the 4t Monday of February next and have you then there this writ -- Witness the honorable George I. Smith president Judge of our said court at Lebanon this 22nd October A.D. 1832   I.K. Wild, clerk.  And now at this day towit. the fourth Monday of February being the twenty fifth day of the same month in the year of our Lord one thousand eight hundred and thirty three come again into court here as well the said complainants by their solicitor aforesaid as the said defendants.  And the said sheriff towit. John M. Houston Esq. to whom the foregoing writ in form aforesaid was directed makes return thereof to the court here thus endorsed towit.  In obedience to the command of the within writ I have summoned the within named freeholders who have made partition of the premises within mentioned in the manner expressed in their return filed herewith 25th February 1833.  I. M. Houston sheriff.  This State of Ohio Warren County ss.  Before me the undersigned a Justice of the peace of Deerfield township in in said county personally came the within named persons towit William Coulson, James Baxter & Jacob Hall appointed by the court of common pleas of said county commissioners to set off the widows dower and make partition of the estate Ruliff Schenck deceased and were sworn agreeably to Law. to discharge the duties therein enjoined by said appointment.  Given under my hand and seal this 18th day of December A.D. 1832  Mason Seward J. P. (seal).

We Jacob Hall, James Baxter, & William Coulson commissioners appointed by the court of common pleas for Warren County state of Ohio to make partition of the following described real estate of Ruliff Schenck late of the county and state aforesaid decd. amongst the children & heirs said deceased and also to set off and assign to Hannah Schenck widow of the said Ruliff her dower in the same towit 358 acres situate lying & being in the Miami purchase in the county and State aforesaid, being the West part of section No. 6 in the second entire Township east from the great Miami river and second entire range being part of the lands purchased by John Cleves Symes Esq. from the United States - and also 84 acres & 52 hundreths of an acre situate in the south half of section No. one in the third Township and third entire range in the Miami tract. in the county of Warren and State of Ohio have agreeably to the requistions of said order made partition of the same in the following manner:   first by setting off to the widow Hannah Schenck her dower in the same as follows to wit 120 acres & seventy six hundreths of an acre in section number six including the mansion house in full of her dower in the two several tracts above described as will more at large appear by refference to the foregoing plat.   We set off and assign to Aaron R. Schenck one of the children and heirs of the said Ruliff Schenck decd. 67 acres & 36 hundreths of an acre in section number 6 designated No. 1 in the foregoing plat in full of his share in said real estate.  We also set off & assign to Jacob R. Schenck 53 acres & 59 hundreths of an acre in the said section No. 6 in full of his share as one of the heirs of the said Ruliff Schenck decd. in the real estate of said deceased being No. 2 as designated on the foregoing Plat.   We also set off & assign to John R. Schenck one of the heirs aforesaid 63 acres and 81 hundreths of an acre in said section No. 6 in full of his share in said real estate being number 4 as designated on the foregoing Plat.  We also set off and assign to Isaac Schenck one of the heirs as aforesaid 69 acres & 60 hundreths of an acre being fractional lot No. 6 in section number 6 and fraction number 8 in section number one as designated in the foregoing plats of said real estate in full of his share of said real estate.  We set off to Jane Briney wife of John Briney 59 acres and 52 hundredths of an acre in section number one in full of her share as one of the heirs as aforesaid of the real estate of the said Ruliff Schenck decd. designated No. 7 on the foregoing Plat.  We set off to Maria Verbryck wife of Peter Verbryck one of the heirs as aforesaid 61 acres and 47 hundreths of an acre in section No. 6 in full of her share in said real estate being designated No. 3 on the foregoing Plat.  We set off to Sarah Schenck one of the heirs as aforesaid 67 acres and 17 hundredths of an acre in full of her share in said real estate designated number 5 on the foregoing plat.  Given under our hands this 16t of February 1833.  William Coulson, James Baxter, Jacob Hall Commissioners.  And thereupon the court order their final dec__ to be entered in the premises in the words and of the tenor following towit.  Mar Com Pleas  February Term 1833.  Petition for partition.  Jacob R. Schenck et. al. vs Hannah Schenck et. al.  Be it remembered at the present term of this court the above cause came on for formal hearing and thereupon said court examined all the papers filed in said cause are satisfied that the proceedings are regular.  The court are likewise satisfied that the order for partition of the premises mentioned in said petition heretofore issued has been duly executed, and said court after having carefully examined the report anexed thereto approve of the same as well as the assignment of dower and approve and confirm the same.  The court therefore order the proceedings in this case to be recorded and that the heirs each pay his & her proportion of the costs which have acrued according to the statute, &c. and that on failing to do so execution issue therefor  By the court.  George I. Smith P__.  Costs. Taxed $22.96.
