The present proposal is about to shift the way of thinking (May 13, 2022).
First and primordial change mindset is to create the Earth/Planet Rights Law, in which the Human Rights Law is included, instead of advocating peace, dignity and equality on a healthy planet.
Second change mindset is to be aware to the electromagnetic field (EMF) that we are creating by electrification of everything, and to fill this lacuna on the Sustainable Development Goals as a subchapter in the chapter of Atmosphere Rights Law.
My proposal is to shift the way of thinking. The Earth does not belong to us, but we belong to the Earth. Instead of protecting the Earth for future generations of humankind, we must protect the Earth because it has rights. Any attempt is welcome.
At a first attempt, to create the Earth Rights Law, and to include the Human Rights Law within the Earth Rights Law, instead of advocating peace, dignity and equality on a healthy planet.
Step 1. To be aware of the earth system as a whole.
Step 2. To maintain the Human Rights Law as a chapter.
Step 3. To create other chapters for flora and fauna, for the hydrosphere, for the geosphere, and for the atmosphere. The climate may appear as a subchapter of the Atmosphere Rights Law.
Other attempt is to create the Planet Rights Law, and to include the Human Rights Law within the Planet Rights Law.
Step 1. To extend the concept of world.
Step 2. To maintain the Human Rights Law as a chapter.
Step 3. One chapter for the Earth Rights Law.
Step 4. Another chapter for other planets.
It is coming the Stockholm+50 event, the 50th anniversary of United Nations for the climate challenge struggle. This event points out as the multilateral environmental action to deal with the world’s triple planetary crisis – climate, nature, and pollution. If this event were my anniversary, the Earth being so unhealthy nowadays would embarrass me.
We are really facing climate change issues. United Nations is asking for acting since 1972, and our planet is as we see. Forty years later, the so-called Sustainable Development Goals were turned up. Words move on actions. Spread out the word is important, but it is even more important to act. Individual actions may be honorable, but they are not sufficient. I believe that most of the persons is connected with a huge number of sites and afterwards what is done is not strong enough. A huge amount of associations, a huge amount of world-class councils, a huge amount of non-profit organizations, among a huge amount of others, have the aim of contributing to achieve the net zero emissions. This huge amount of lovers, this amount of non-action is becoming frustrating. I believe that there are duplicated reports and talks, which do not represent duplicate efforts to do anything. Actions speak louder than words, as I may quote: 'If your actions don't live up to your words, you have nothing to say' by DaShanne Stokes, or 'Actions prove who someone is; words just prove who they want to be' by anonymous. In conclusion, if in 50 years of attempts no results are visible, acting and thinking differently are imperative.
We must play this harp no more and we should adopt a hands-on attitude.
To maintain the Human Rights Law as a chapter will be not the goal, but it is the easiest attempt for beginning in this process of shifting the way of thinking. As the International Human Rights Law was created from the Universal Declaration of Human Rights, adopted by the General Assembly in 1948, the Earth Rights Law should have its foundation in the international environment law. We must adopt the legal dimension of the climate crisis by making it as a true juridical structure. The existing rules and general principles of international environmental law have an important role in the awake for the environment problems. However, the international environmental law should be rewritten as a legal system, keeping its contribution in the fight against the climate change, the ozone depletion and the extinction of the biodiversity, to name a few.
Thus, the Earth Rights Law should lay down the obligations of Governments to act in certain ways or to refrain from certain acts [https://www.un.org/en/global-issues/human-rights], the obligations which States are bound to respect and to protect. It should be a universal and internationally protected code to which all nations can subscribe and all people aspire [https://www.un.org/en/global-issues/human-rights]. The final objective is to treat the Earth as a living being with its rights.
We are facing a disequilibrium in the earth system. The "hotfog" is only the iceberg peak, the electromagnetic field should be recognized as a factor. It is urgent to face the electromagnetic field over the Earth surface, because the huge amount of satellites, mobiles, computers and so on, creates an extra electromagnetism field. 1. how volcanoes can affect climate, but how volcano hazards are related with the disequilibrium of the planet.
2. our exposure to EMF radiation, but the exposure of the Earth.
Therefore, this extra EMF should be evaluated and classified in order to establish the adequate legislation in the chapter Atmosphere.
This text is not to convince anyone for the existence of the climate change. This text is for you, you who already know its existence, you who are already worried by its consequences, you who believe that something must be done. The present time, a time of war, a time of difficult access to commodities, is the time to change our way of life and is the time to change our economic and financial strategies. We must act simultaneously on all fronts, science/technology, economy/finance, social and law.
As a final comment, the present proposal might seem unreal and utopic. It is only a question of will. To be honest my first attempt in promoting this idea, I was called as a dreamer. Now, I expect to be listened some way. I believe that it is imperative to act. It is the time to save our planet. I finish as I began. The Earth does not belong to us, but we belong to the Earth.
