WHAT IS PROBATION WITH RESTRICTIVE CONDITIONS (PRC)?
Probation with Restrictive Conditions (formerly known as IPP - Intermediate Punishment Program). It is a division of the Lawrence County Adult Probation Department. Probation with Restrictive Conditions (PRC) is differentiated from probation by its design as a more restrictive sentencing alternative. PRC targets higher risk populations than traditional probation. PRC sentences include:
Intensive supervision
Residential inpatient drug and alcohol treatment and outpatient treatment
House arrest with electronic monitoring
In addition, PRC will include special conditions that address public safety concerns. PRC will utilize existing programs in a more restrictive and structured manner while providing intensive supervision and immediate sanctions for violators.
WHAT IS THE PURPOSE OF PRC/IPP?
To protect society and to promote efficiency and economy in correctional systems;
To promote accountability of offenders to their community;
To fill gaps in local correctional systems; and,
To provide opportunities for offenders who have special needs to receive services to enhance their ability to become contributing members of the community. To be eligible for placement on intermediate punishment an offender must not demonstrate or have a history of violent behavior.
WHAT IS HOUSE ARREST?
Individuals on House Arrest are required to wear an ankle bracelet along with a tracking device at all times, which electronically monitors their whereabouts. Any eligible individual can be placed on House Arrest, however, those individuals serving mandatory D.U.I. sentences are by law, required to be on House Arrest with electronic monitoring.
While on House Arrest, individuals may only leave their residence at designated times for work, appointments or treatment or anything else specifically court ordered.
WHAT ARE THE QUALIFICATIONS FOR HOUSE ARREST?
Client must have a legal right to reside at the home, either through lease agreement or ownership. If the client does not possess this qualification, he/she must have permission from the owner / lessee to reside there.
The residence must have electricity, running water and all other facilities necessary to meet health and safety standards.
The residence must also be free of all alcohol, drugs, and weapons.
WHAT IS THE COST OF HOUSE ARREST?
As with traditional probation and parole, there is a $50.00 per month supervision fee for participants. Additionally, if the participant is on House Arrest, he must pay a fee to offset the cost of operating the equipment. This fee is $10.00 per day [plus a one time $50 hookup fee]. These fees must be paid in full before your expiration of intermediate punishment as this is a program privilege. If the fees are not paid in full, a person may be subject to revocation proceedings.
AM I PERMITTED TO LEAVE MY RESIDENCE?
You are only permitted to leave your residence during officer approved leaves.
AM I PERMITTED TO GO OUTSIDE IN MY YARD?
No. You are confined to the inside of your residence.
WHAT TYPE OF MAINTENANCE DO THE UNITS REQUIRE?
The units require a continuous two hour charge daily.
CAN I SHOWER/BATHE WITH THE UNIT ON?
Yes. You may shower/bathe with the unit on, they are water resistant. Please, do not shower/bathe while charging the unit.
WHAT IF I NEED TO GO TO THE EMERGENCY ROOM?
You are required to take the most direct route to the nearest hospital, acquire documentation stating the date(s) and time(s) that you were admitted and discharged, and call your probation officer as soon as possible.
WHAT IF I HAVE AN AFTER-HOURS EMERGENCY?
Should you have a true emergency that cannot wait until the next business day, please call 724.656.9300 and ask for the on-call probation officer. If you have a life-threatening emergency, dial 911.
