Terms of service

This terms of service("agreement") governs your use of the software application Joey for Reddit (“Application”, "app"). "We", "us", "our" refers to the creator(s) of the app.

DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE MAKE NO WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR USE AND NON-INFRINGEMENT. THE APPLICATION IS PROVIDED "AS IS” AND "AS AVAILABLE".

LIMITATION OF LIABILITIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT BE LIABLE FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE LOSSES OR DAMAGES (WHETHER OR NOT FORESEEABLE OR CONTEMPLATED BY THE PARTIES), EVEN IF WE OR OUR AFFILIATES HAVE BEEN ADVISED OF, KNEW OR SHOULD HAVE KNOWN THAT SUCH DAMAGES WERE POSSIBLE AND EVEN IF DIRECT DAMAGES DO NOT SATISFY A REMEDY.

INDEMNITY

To the maximum extent permitted by applicable law, You will indemnify, hold harmless and defend us and our Affiliates, at Your expense, from any and all third-party claims, actions, proceedings, and suits brought against us or any of our officers, directors, employees, agents or Affiliates, and all related liabilities, damages, settlements, penalties, fines, costs or expenses (including, reasonable attorneys' fees and other litigation expenses) incurred by us or any of our officers, directors, employees, agents or Affiliates, arising out of or relating to (i) Your breach of any term or condition of this Agreement, (ii) Your use of the Application, (iii) Your violations of applicable laws, rules or regulations in connection with the Application, (iv) any representations and warranties made by You concerning any aspect of the Application to any Third Party; (v) any claims made by or on behalf of any Third Party pertaining directly or indirectly to Your use of the Application (vi) violations of Your obligations of privacy to any Third Party; and (vii) any claims with respect to acts or omissions of any Third Party in connection with the Application. You will cooperate as fully as reasonably required in the defense of any claim. We and our Affiliates reserve the right, at our own expense, to assume the exclusive defense and control of any matter subject to indemnification by You.

YOUR USE OF APPLICATION

• To use the application, you must be over 13 years of age. If you are between 13 and 18 years of age, you must have your parent or legal guardian’s permission to use the application.
• You agree that by using the application you may be exposed to content that you may find offensive, indecent, objectionable or gore and that you use the application at your own risk.
• You agree that we own all applicable Intellectual Property Rights of the application. "Intellectual Property Rights" means any and all rights existing under patent law, copyright law, trade secret law, trademark law, unfair competition law, and any and all other proprietary rights worldwide. You agree that you will not, and will not allow any third party to, (i) copy, sell, license, distribute, transfer, modify, adapt, translate, prepare derivative works from, decompile, reverse engineer, disassemble or otherwise attempt to derive source code from the application, (ii) take any action to circumvent or defeat the security or content usage rules provided, deployed or enforced by any functionality (including without limitation digital rights management or forward-lock functionality) in the app, (iii) use the app to access, copy, transfer, transcode or retransmit content in violation of any law or third party rights, (iv) remove, obscure, or alter our or any third party's copyright notices, trademarks, or other proprietary rights notices affixed to or contained within the app.
• You agree to be bound by the Reddit User Agreement(www.redditinc.com/policies/user-agreement).
• You agree to be bound by the YouTube Terms of Service(https://www.youtube.com/t/terms).
• You agree to the privacy policy of the application.

PURCHASES AND REFUNDS

• You should make purchase(s) only if you can do so legally.
• All purchases made by you are 100% non-refundable by us.
• The marketplace from which the purchase was made may have their own refund policy.
• The app relies on the marketplace from which the purchase was made to retrieve the purchase details.

ACCESS

YOUR ACCESS TO THE APPLICATION MAY BE CHANGED OR TERMINATED ANY TIME WITH OR WITHOUT NOTICE.

MISCELLANEOUS

• We reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Application(or any part of it) with or without notice.
• If any part of this Agreement is held invalid or unenforceable, that part will be construed to reflect the parties’ original intent, and the remaining portions will remain in full force and effect.

CHANGES TO THESE TERMS

We reserve the right, at our sole discretion, to amend these Terms of Service at any time and will update these Terms of Service in the event of any such amendments. Changes will not be retroactive.

YOU ARE ADVISED TO CONSULT THE TERMS OF SERVICE BEFORE EVERY USE OF THE APPLICATION FOR ANY CHANGES.

If you disagree with the new terms, then you should stop using the Application and remove it from your device. Your continued use of the Application constitutes agreement to our revisions of these Terms of Service, and is subject to the new terms.

CONSENT

By using the Application, you agree to our Terms of service. If you do not agree, you should not use the Application and remove the Application from your device.
