Marin judge: Prohibition on Mount Tam bike programs extended

A Marin County judge has delivered a victory to a group of environmentalists seeking to prevent expanded bicycle access on Mount Tamalpais.
Earlier: MMWD Board authorized an amendment to a contract for outside legal counsel with Best, Best & Krieger LLP to assist in the case. The original contract, issued in June for environmental law and litigation services, was not to exceed $75,000. The amendment approved Wednesday adds $200,000 for support in the litigation.

Marin Water’s Statement in response to a Temporary Restraining Order issued Oct. 3, 2024, preventing the start of the District’s new Trail Sharing Pilot and E-Bike Class I Trial programs on the Mount Tamalpais Watershed:
Following the Marin Water Board of Directors approval of the Trail Sharing Pilot and E-Bike Class I Trial programs on the Mount Tamalpais Watershed, Marin Water has been working diligently to prepare for implementation of both programs, which were set to begin this week.
On Tuesday, October 1, 2024, the California Native Plant Society, the Marin Audubon Society and the Marin Conservation League filed a lawsuit against Marin Water alleging that Marin Water failed to comply with the California Environmental Quality Act (CEQA) in its adoption of these program and sought a temporary restraining order to stop Marin Water’s implementation of the Trail Sharing Pilot and E-Bike Class I Trial. On Thursday, Oct. 3, 2024, the Marin County Superior Court issued a Temporary Restraining Order temporarily halting the initiation of these programs by Marin Water. This means that the status quo rules remain in place on the Mt. Tam Watershed until the order is lifted or amended by the court.

We don’t know what Kent would have thought of e-bikes any more than we know what the Founding Fathers would have thought of automatic weapons when drafting the Second Amendment, and for the same reason.
I do know that I can’t enjoy the watershed while wondering when or whether I’m going to be knocked down by or have to interact with riders, polite or not.

Fairfax has codified its deal with the Marin Open Space Trust for the acquisition of the 100-acre tract known as the Wall property.
The Town Council unanimously approved a memorandum of understanding and authorized Mayor Barbara Coler to sign it at a meeting on May 22. The purpose of the agreement is to memorialize the intent of the open space trust to transfer title of the property to the town. In the document, the trust commits to raising $2.3 million for the purchase of the property and $500,000 in restoration costs and to convey both the funds and property to the town before Oct. 29.

Mount Tamalpais search party finds rare bee

A rare, elusive bee that is endemic to the Bay Area has turned up on Mount Tamalpais in its first documented sighting in nearly 45 years.
The San Francisco leaf-cutter bee, also known as Trachusa gummifera, was found as part of a One Tam community science effort to locate the fast-flying pollinator. The bee has been documented less than 100 times and has not been seen since 1980. The discovery could help fill in unknown details about its ecosystem.
