Dock Rules are as follows:
FISH COVE ASSOCIATION REGULATION OF DOCKSLIPS AND MOORINGS:
The use and assignment of dock slips and moorings will be granted only to Full members of Fish Cove Association who are in good standing, i.e. all outstanding dues and assessments have been paid. The board of directors will designate a board member to serve as the “Dock Chairman” who is given the authority and must assign specific dock and mooring spaces to members primarily based on that member’s relative rank (i.e. relative place compared to other full members) on the dock “Seniority List”
The rank of seniority is achieved when all three of the following criteria are met: ownership of property, payment in full of the initiation fee payment of all Full membership dues and all fees owed.
The rank and seniority standing is calculated as follows:
For early members (prior to the establishment of the initiation fee) - the date of purchase of their property, when followed by payment of all annual dues.
For subsequent members – the Most Recent of the following dates:
1) The date they purchased their property,
2) The date they paid their initiation fee, OR
3) The date of payment in full for all fees and dues owed.
The Seniority List will be published annually by the treasurer and posted in a conspicuous place near the docks.
All dues and assessments must be paid by April 30 for the Association’s fiscal year beginning the next July 1 and ending June 30 of the following year. Dues notice will be accompanied by a request for a copy of the member’s boat registration and a completed dock request form indicating the member’s intentions for the summer. No boat will be allowed at the dock until this process is complete. Failure to pay by the due date can result in loss of Seniority position. Any extensions beyond May 31 must be requested in writing and approved by the Board of Directors before the due date.
Seniority rank is forfeited if annual dues are not paid. An exception for hardship can be made when requested in writing and approved by the Board of Directors. This exception will be temporary and must be accompanied by a short-term payment plan.
Full members requesting a dock slip or mooring for the year must turn in a copy of their current year boat registration to the Dock Chairman and indicate their intentions for the summer by June 15 each year. Full members who fail to do so will be indicating by implication that they do not intend to use a boat that summer and will forfeit their priority ranking for that summer season only. The Dock Chairman will then have the opportunity to offer other members that dock or mooring location.
Assignment to specific docks/slips or moorings will be determined by the Dock Chairman with the concurrence of the Board of Directors. The Dock Chairman will attempt to respond to individual preferences based primarily on seniority; however, seniority privilege must be tempered by the overall needs of the Association in terms of length of boats and their required draft. Disputes will be resolved by a binding resolution of the Board of Directors. As required by deed, a dock up to 32 feet must be made available to the Lebel property. Location and size of this dock will be determined by the Dock Chairman as a part of his normal duties
Only one dock and/or mooring space per family/lot owner will be assigned initially, until the entire seniority list has had the opportunity to be offered a space for the season. Subsequent to seasonal space assignment completion, other assignment may be offered in order of seniority rank. Variations, exceptions, or changes to the within can be made by the method of change and/or amendment in accordance with the By Laws and/or powers of the Board of Directors.
All persons using the Association dock and moorings agree to follow all the association rules. This includes moving their boat from any space within 24 hours of being requested to do so by the Dock Chairman (or any board member acting on behalf of the Dock Chairman). Further, all users of the Association docks agree to allow the Dock Chairman or his designee to tow any boat left unattended in any space that has not been approved by the Dock Chairman for that person’s use. Any boat towed will be done at the owner’s expense and liability.
When moorings are in use, the Association will provide a drop-off dock at a location voted by the members. This dock may be used by visitors or by full members other than those on moorings. However, unattended boats may not be left on the drop-off dock for longer than twenty minutes at any time.
Slips may NOT be lent to friends or relatives and in no case may be rented or loaned to non-members.
Because of safety considerations, maximum boat size on the north side docks is 28 feet;
maximum size on the south side docks is 28 feet. Boats any longer will be placed on moorings.
In order to enhance the appearance of the beachfront area, parking of boat trailers and associated paraphernalia is not permitted on the beachfront area during the summer months.
In accordance with the Association By-laws, minor changes to these regulations may be made by majority vote of the Board of Directors. Major items must be brought to a vote of the general membership after initial approval of the Board of Directors - with final approval of the membership by ballot, if necessary or special meeting.

1 There is one exception to the “one dock and/or mooring space per family” method of initial seasonal assignment, and that is as follows: The Popek and Keohane families each currently (as of August 15th, 2011) own more than one lot that are in good standing with Full Membership rights. Only these lots, for these current owners, will be entitled to be offered space for more than one boat and only in the order of their respective seniority rank for each of those lots. After August 15th 2011, the above provision that requires this “one dock and/or mooring space per family” method of initial seasonal assignment shall apply to all Fish Cove Association members/lots in the future.
