Question:
What are hidden custodians?
Answer:
When internet discussion takes place in social media, some of the entries by persons are 'filtered' out by moderators who review the submissions to their social media platform. In some cases, a person involved in a potential case and litigation may have submitted some comment or information that exists on the social media platform's file servers but did not make it to the discussion forum. Hence the original submission may now only exist on that company's server and the hidden custodian has the submissions that did not make it to the online forum. This is one example of what a hidden custodian means. In other situations, the file in question may exist on a server but the person who 'owns' the file is 'hidden' by normal viewing practices and the ECA software has tools for delving into who originated the file and really is the owner.
