The Tenant of an allotment garden shall comply with the following conditions:
1 The Tenant shall keep the allotment garden clean, in a good state of cultivation and fertility and in good condition.
2 The Tenant shall not cause any nuisance or annoyance to the occupier of any other allotment garden, or obstruct any path set out by the Society for the use of the occupiers of the allotment gardens.
3 Water supplies to individual plots will be by hand held hoses only. Sprinklers and other unattended methods of watering are not permitted
4 The Tenant shall not underlet, assign, or part with the possession of the allotment garden or any part of it, without the consent of the Society.
5 The Tenant shall not, without the written consent of the society, cut or prune any timber or other trees, or take, sell or carry away any mineral, gravel, sand or clay.
6 No sheds, greenhouses or chicken runs shall be erected on the allotment sites, without the consent of the Site Management Committee. No other building may be erected upon any site without the written consent of the Society.
7 The Tenant shall not use barbed wire for a fence adjoining any path set out by the Society for use by the occupiers of the allotment gardens.
8 The tenant will serve an initial probationary period of a minimum of three months. At the end of this probationary period, a judgement will be made by the site representative to confirm or cancel the tenancy. The probationary period can be extended at the discretion of the site representative.
9 The Tenant shall, as regards the allotments gardens, observe and perform all conditions and covenants contained in the lease (if any) under which the Society hold the land from the Council.
10 The Tenant shall be liable for any costs incurred by the Society for clearing, tidying and/or cultivating any allotment garden deemed to be in poor condition. Such work may be carried out by the society or its agent either during a tenancy or upon termination.
11 The Tenants shall observe and perform an special conditions which the Society consider necessary to preserve the allotment garden from deterioration, notice of which shall be given to applicants for the allotment garden in accordance with rules made by the Society.
The Tenancy shall terminate on the 31st day of December or the 30th day of June next after the death of the Tenant and shall also terminate whenever the tenancy or right of occupation of the Society terminates. It may also be terminated by re-entry after one month’s notice:
a) If the rent is in arrears for not less than 28 days or
b) If the Tenant is not duly observing the rules affecting the allotment garden, or any other term or condition of his/her tenancy
The Tenancy shall also be determined by the Society by not less than one year’s notice in writing to quit expiring on or before the 6th day of January or on or after the 29th day of June in any year, or by the Tenant by not less than one month’s notice in writing to quit expiring at any time, the notice to be submitted through his site Representative.
If the allotment garden comprises any land required for any of the purposes mentioned in paragraph (b), (c) or (d) of Section I(I) of the Allotment Act 1922, the Surrey Heath Borough council shall have the power to re-enter upon giving notice in writing in accordance with those provisions and the tenancy shall be determined accordingly.
