The Ashland Park declaration sets out a common plan for the development, maintenance, and protection of properties within Ashland Park. This declaration is designed for the mutual benefit of all lots within Ashland Park and is binding to all current and future owners.
Definitions:
Association: Refers to the Ashland Park Homeowners Association.
Owner: Anyone with a fee simple title to a lot.
Common Area: Property owned by the Association for the collective use and maintenance of the owners.
John Olsen right-of-way: Property between NE John Olsen Ave and East Property lines of lots 1-5.
Acceptance of Covenants:
All lot owners agree to abide by these covenants, which cover property use, maintenance, and signage.
The association shall maintain the sign and landscaping along the John Olsen right-of-way.
Property Rights:
Owners have easements for enjoyment of common areas but may be charged for maintenance and improvements. The Association can transfer common areas with the consent of two-thirds of the membership.
Membership and Voting Rights:
Membership in the Association is mandatory for lot owners with one vote for each lot. If a lot has multiple owners, each owner is a member, but the lot still has one vote.
Maintenance Assessments:
Owners are required to pay assessments. Assessment shall be used for repair, maintenance, utilities, and other expenses for the common area, sign, and fence along the John Olsen right-of-way.
The initial annual assessment is $50. Assessments may increase up to 10% per year with a 51% vote or over 10% with a 2/3 vote. Special Assessments may be levied with a 2/3 vote.
