Information for Contractors Awarded Construction Projects

Documentation Required within 10 Days of the Notice to Proceed

This page lists labor compliance information for prime, subcontractors, as well as 2nd and 3rd tier contractors assigned to the project. Owner operators are also subject to prevailing wage compliance. The items listed below should be turned in by all contractors, preferably when their first set of certified payroll records is due.

Construction employees may be approached by our LCP Field Inspectors for a short interview on site from time to time. These interviews are voluntary, and should not in anyway create an unsafe working environment for those being interviewed. It is also required that prevailing wages be posted on location where construction employees can review the rate of pay appropriate for their individual crafts. Please download the wages from the websites provided to you during previous Pre-Bid (job walk) conferences. (Link to Pre-Bid material) A notice confirming who employees can call at the District regarding prevailing wages should also be posted.

Public Works Contract Award Information (DAS 140)

Labor code section 1777.5 requires the prime contractor and every subcontractor to file this form before work begins on a public works project with a training program capable of supplying apprentices to the project for every apprenticeable trade the contractor employs. The SFUSD labor compliance program requires a copy of this form along with the name of the training program that received the information, as authorized by labor code section 1777.5.

Apprentice Agreement

This form proves that a person claimed to be an apprentice is registered with an approved training program and with the California Division of Apprenticeship Standards, as required by labor code section 1777.5. This form must be submitted for each individual claimed to be an apprentice, or the contractor must pay the person journeyman wages.

Contractors and subcontractors shall pay workers on a weekly basis, and certified payrolls are to be submitted on a weekly basis. In the event there has been no work performed during a given week, the certified payroll shall be annotated with the words "No Work" for that week. When all work has been completed, the payroll form shall be marked "Final."

Note: Please do not use U.S. Department of Labor form WH-347 unless you write the number of the check issued to the employee for the payment of wages. Regardless of the form used, both the gross amount earned for the specific project and the total amount earned by each employee must be reported. However, the statement of compliance on this form is SFUSD's standard.

9. Statement of Employer Payments (Fringe Benefits)

Contractor Fringe Benefit Statement

The prevailing rate is determined by a basic rate of pay plus employer payments. Employer payments must indicate the hourly benefit amounts and to whom the benefits were paid on the fringe benefit statement for each classification. The fringe benefits are added to the basic rate of pay reported on certified payrolls to determine the prevailing wages paid to employees.
