We store and maintain files, emails and other data pertaining to your usage of our services. In order to prevent loss of data due to errors or system failures, we also keep backup copies of data. Hence your data may remain with us even after termination of this agreement. These terms and conditions of Recruitment Support Services must be read in conjunction with the overarching Terms & Conditions comprising Privacy Policy, Cancellation & Refund Policy and General Terms of Service.
Express Authorization: By using Recruitment Support Services of SALES PATHSHALA , the CLIENT expressly authorizes SALES PATHSHALA to
Post jobs and shortlist candidates / applicants on behalf of the CLIENT at online portals, subscribed / suggested by the client.
Schedule and conduct online / offline interviews of the job applicants on behalf of , as well as jointly with, the CLIENT.
Record and store online interviews of the candidates for quality and training purpose
Collect and store soft copies of the documents of job applicants, shared by the HR team of the CLIENT, for the purpose of sharing reports and insights with the CLIENT. These documents include resume, photograph, education documents, personal IDs, professional documents including experience certificates, appointment and relieving letters from previous employers of the applicant.
Communicate and coordinate with the Client's HR team regarding smooth discharge of its official responsibilities pertaining to recruitment work
Design/modify the job descriptions, offer / appointment letters in consultation with the CLIENT, for the positions requiring Recruitment Support Services of SALES PATHSHALA
Design and administer basic tests to the candidates/ job applicants, through the CLIENT'S HR team, for assessing applicants' reasoning power , mathematical ability and domain knowledge needed for effective discharge of the specific job roles under consideration
Reports & Insights: From time to time SALES PATHSHALA may share reports and insights with the CLIENT
These reports and insights thus shared with the CLIENT present only the summary of comparative candidate details extracted from the information provided by the HR team of the CLIENT. SALES PATHSHALA shall not be responsible for authentication of such documents shared by the HR team of the client. All the documents submitted by candidates to the HR team of the CLIENT must be authenticated through BGV (Background Verification) Agency as detailed in point number 5 below.
These reports and insights do not constitute recommendation / opinion / decision to hire or not to hire any specific applicants /candidates and must not be construed as recommendation / opinion / decision to hire or not to hire any specific applicants /candidates.
These reports and insights are shared with the CLIENT with an intent of providing bird's eye view of applicants' details that might be helpful to the CIIENT in taking hiring decisions. The CLIENT must complement these reports with the CLIENT'S own experience, understanding and due diligence for arriving at the final hiring decisions as suitable to the CLIENT'S business needs.
The CLIENT must take its own hiring decisions and shall solely own complete responsibility for such decisions and their consequences regarding hiring or not hiring any specific candidates. SALES PATHSHALA shall not be responsible in any manner whatsoever for hiring decisions of the CLIENT as well as the consequences of such decisions of the CLIENT.
Employee Compensation: The CLIENT understands and agrees that:
The client shall be solely responsible for taking the final call on the compensation that is appropriate for a particular role based on the CLIENT'S assessment of the applicants' capability and CLIENT's Payment capacity.
The CLIENT shall be solely responsible for the final decision and consequences arising from such decisions, regarding the compensation to be paid to the employees hired by the CLIENT organization.
SALES PATHSHALA , may offer its opinion when requested to do so, but the CLIENT shall be solely responsible for the final decision regarding employee compensation and consequences of such compensation decisions taken by the CLIENT.
Background Verification(BVG): The CLIENT understands and agrees that:
The CLIENT must carry out, and shall be solely responsible for carrying out, all necessary due diligence including employee BGV (Back Ground Verification) as a mandatory BMP (Best Management Practice)
The CLIENT must ensure that it engages a qualified BGV(Back Ground Verification) Agency for carrying out mandatory BGV(Back Ground Verification) of all new hires.
As a mandatory (BMP) Best Management Practice, all new hires must be provided the letter of appointment and taken onboard on the CLIENT company's rolls only after positive BGV report is received from a qualified BGV Agency
All employees of the organization will be require to go through mandatory BGV (Back Ground Verification) check on an annual basis.
In case the CLIENT decides to hire new employee/s before receiving positive BGV report through a qualified BGV agency, the CLIENT shall be solely responsible for such hiring decisions as well as the consequences arising from such hiring decisions of the CLIENT. SALES PATHSHALA will not be responsible in any way whatsoever for such hiring decisions of the CLIENT as well as the consequences arising from such hiring decisions of the CLIENT.
Attrition: The CLIENT understands and agrees that it is the sole responsibility of the CLIENT to manage the risk of employee attrition. Employee attrition may be triggered by the factors that can be controlled BY THE CLIENT. The CLIENT shall be solely responsible for any employee attrition and managing all the associated risks for the same. SALES PATHSHALA will not be responsible for employee attrition at the CLIENT organization in any manner what so ever.
The controllable factors that need to be managed by the CLIENT include:
Employee Benefits: The job applicants look for organizations offering better employee benefits. Modern day organizations strive to be an employer of choice. Employees tend to switch jobs when they are hired at below the market pay. It is solely the responsibility of the CLIENT to take decision regarding the employee benefits and pay offered to the candidates, depending on how the CLIENT wishes to position itself as an employer in the job market.
Professional Development Opportunities: Modern day workers are looking for employer organizations that can add value to their professional skills. Creating an environment rich in professional development opportunities solely rests with the employer, the CLIENT.
Career Growth Opportunities: Good performers are always excited to work with employers offering them with Career Growth Opportunities. Hence it is the onus of the CLIENT to ensure that the organizational design and culture caters to the employees looking for such opportunities.
Employee Grievance Redressal: Motivated employees tend to stay longer in the organization and are most likely to contribute extraordinary results. To ensure that employees remain motivated , it is the sole responsibility of the CLIENT to build a robust employee grievance redressal system.
Working Environment: Professional work environment is not negotiable for building a performance oriented culture. It is solely the responsibility of the CLIENT to provide professional working environment conducive to retention of good performers that is free from politics , groupism and favoritism.
Transparency: Transparency in the day to day employee facing processes fosters mutual trust and confidence. It is the sole responsibility of the CLIENT to build transparency for retaining good performers.
Leadership Quality: Providing right leadership and support is critical for retaining good performers. It shall be the sole responsibility of the CLIENT to develop leadership talent for ensuring retention of key team members.
Management System: Efficient management system is the backbone of every modern organization and is also necessary for effective functioning of the employees. It shall be the sole responsibility of the CLIENT to develop and implement effective management systems for retaining good performers.
Organizational Culture: Building an organization culture, where people are heard, trusted, are free to talk their mind, are allowed to practice work life balance and are not micromanaged, is a prerequisite for building long term engagement and bonding with the employees. It is the sole responsibility of the CLIENT to build the culture of employee engagement.
Brand Equity: Brand is not only a name it is the value that is delivered to customers on a day to day basis. Good employees take pride in working for an organization that is viewed by its customers as offering value under its brand. It is the sole responsibility of the CLIENT to build healthy employee perception around its brand.
Business Profitability: At the end of the day business profitability is critical as it affects all major departments of a business enterprise. Employee benefits, morale and retention can be the most important factors impacted by business profitability. It is the sole responsibility of the CLIENT to do its business planning the right way for ensuring business profitability and sustainability.
Customer Focus: Customer focus is an important factor in setting the tone of the team responsible for delivering results. Good performers take pride in delivering value to their customers. It is the sole responsibility of the CLIENT to ensure sustained focus on delivering value to the customers.
Social Responsibility: Employees take pride in working for an organization that cares about and contributes to solving real world societal problems. It is the sole responsibility of the CLIENT to ensure that this critical dimension is taken care off.
Ethics & Compliance: Focus on good governance practices and a proactive approach for being ethical and compliant on a consistent basis has an impressive positive impact on the employee wellbeing and retention. It is the sole responsibility of the CLIENT to ensure alignment with this critical business dimension.
Cancellation & Refund: The CLIENT understands and agrees that:
In case the CLIENT cancels the event /program/ activity before giving the confirmation of the final schedule of the program / event / activity, the client shall be entitled for complete refund.
However the CLIENT is not allowed to cancel the scheduled program or event after providing the confirmation of the final schedule. All payments shall be non refundable and non transferable under any circumstances, after the confirmation from the CLIENT about the final schedule of the program / activity / event.
Client is also not allowed to ask for the refund after the services are delivered or deem to have been delivered , as stated in clause of
Refund & No Show, under General terms of Service below
In case the CLIENT wishes to cancel the event / program / activity before the confirmation of the final schedule by the CLIENT , the CLIENT must share a written request for cancellation and refund through their official email id ,giving details of the Invoice number, details of the payment made and payee account details at sanjayvsharma@salespathshala.com.
All refund requests shall be processed within two to three weeks after receiving the cancellation and refund request on email, provided the cancellation request is received before the CLIENT's confirmation for the final schedule of the said program / activity / event.
Implementation of BMPs (Best Management Practices) is necessary for ensuring organizational hygiene and effectiveness.
SALES PATHSHALA may share Best Management Practices (BMPs) with the CLIENT from time to time. From management perspective it is highly recommended to incorporate recommended BMPs into the functioning of the CLIENT organization. But the final decision to implement or not to implement the recommended BMPs rests with the CLIENT depending upon the CLIENT'S assessment of the effectiveness and relevance of the recommended BMPs in meeting the CLIENT'S business needs and goals.
The CLIENT must carry out its own due diligence to ascertain the suitability and need of the recommended BMPs for its business, before arriving at the decision to implement or not to implement the same. The CLIENT shall be solely responsible for such decisions and their accompanying consequences. SALES PATHSHALA shall not be responsible in any manner whatsoever for such decisions of the CLIENT as well as the consequences of such decisions of the CLIENT.
Advance payment is mandatory for initiating the planning and scheduling of any program or activity. The proposed program / event schedule shall be communicated to the client. The program / event schedule shall be finalized strictly after receiving written confirmation of the same from the client.
Rescheduling & No-show: The client is not allowed to reschedule the activity / program after providing a written confirmation of the final schedule. No request for rescheduling the same shall be entertained at any time before or after the proposed event. In case of no show-up by the client for the scheduled activity / event / session / program , the professional services shall be deemed to have been delivered.
No Liability: Owing to the nature of the offered services SALES PATHSHALA shall have no liability for any claim arising out of or relating to these terms of services or the provision of any service under service order by client to SALES PATHSHALA. SALES PATHSHALA shall be facilitating development of the client and the client's team on the best management practices in the domain of sales. The consultant shall be sharing knowledge and experience with the client through in-depth discussions, brainstorming, consulting, training, coaching, mentoring and handholding support. In no case the knowledge and experience shared by the consultant be construed as advisory for choosing a particular course of action. The consultant shall not be involved with decisions of the client regarding day to day business operations. The client agrees to carry out necessary due diligence on its own to understand the nature of risks involved in their day to day decisions regarding business strategy, planning and implementation. The client understands and agrees to be solely responsible for the risks and consequences of making and implementing all business decisions pertaining to client's business.
In no event shall SALES PATHSHALA be liable for any loss of data, loss of business, loss of opportunities or any other special or incidental loss relating to direct or indirect business of client. This limitation will apply even if SALES PATHSHALA has been advised of, or is aware of the possibility of such damage.
Disclaimer of Warranties: Role of SALES PATHSHALA is limited to that of a facilitator sharing knowledge with the client without any responsibility for the decisions taken by the client regarding day to day business operations and the consequences of these decisions on the client's business. SALES PATHSHALA shall not be involved with the day to day operations and decisions of the client's business. Business related decision making and implementation shall entirely be the sole responsibility of the client.
Third party services: Occasionally, we may be called upon by the client for sharing our opinion, regarding the efficacy of third party products or services. We do not recommend, promote or sell third party products or services. The client must carry out all necessary due diligence on its own before taking the final decision regarding any third party products or services. The client shall be solely responsible for such decisions.
Termination: In case the either side is not satisfied with the conduct of the other side that may be resulting in failure to perform its obligations by the breaching side, as defined in this MOU, the non-breaching side shall provide written notice detailing the breach. The breaching Party shall have thirty 30 (thirty) days from receipt of such notice to cure the breach. If the breach is not cured within this period, the non-breaching side may, at its option, terminate this relationship.
Your Consent: By using our services, you agree to these Terms and Conditions comprising Privacy Policy, Terms & Conditions of Recruitment Support Services, Cancellation & Refund Policy and General Terms of Service.
Changes to our Terms and Conditions: SALES PATHSHALA may modify these Terms & Conditions comprising Privacy Policy, Terms & Conditions of Recruitment Support Services, Cancellation & Refund Policy and Terms of Service by updating this page from time to time. The CLIENT, you should check this page from time to time to ensure that you are happy with any changes. The CLIENT understands and agrees that continued use of our services shall be deemed to be an acceptance of these Terms & Conditions.
