1. Introduction
Thank you for choosing TrustCall – ID & Spam Filter (the “Service”). These Terms and Conditions (“Terms”) govern your access to and use of our mobile application, website, and any related features, technologies, content, or services provided (collectively, the “Platform”).
By downloading, installing, accessing, registering with, or otherwise using any part of the Service, you agree to comply with and be legally bound by these Terms. If you do not accept these Terms in their entirety, you are not authorized to use the Service and must discontinue use immediately.
The Service is designed to assist users in managing phone communications by identifying unknown callers, blocking spam calls, organizing call logs, and offering optional SMS management features. Your use of the Service is also subject to our Privacy Policy, which describes how we collect and handle your personal information.
These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and the operator of the Service (“we,” “us,” or “our”). Please review them carefully before proceeding.
2. Dispute Resolution and Arbitration Agreement
By using the TrustCall – ID & Spam Filter Service, you agree that any disputes, claims, or controversies arising out of or relating to these Terms, the Privacy Policy, or your use of the Service shall be resolved in accordance with the dispute resolution procedures described below.
2.1 Arbitration

Any and all disputes shall be resolved through binding arbitration, rather than through court proceedings.

You expressly waive your right to a trial by jury, and to participate in any form of class action or representative proceeding, unless such waivers are prohibited by applicable law.
This arbitration agreement is intended to apply broadly to all disputes related to your use of the Service.
2.2 Enforceability
If you do not agree to be bound by the arbitration terms described above, your sole and exclusive remedy is to discontinue use of the Service. This section may significantly affect your legal rights, and you are encouraged to review it carefully and seek independent legal advice if necessary.
3. Conditions of Use
By accessing or using the TrustCall – ID & Spam Filter Service, you agree to abide by these Terms in their entirety and to comply with the following conditions:

4. License Grant and Acceptable Use
Subject to your ongoing compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use TrustCall – ID & Spam Filter solely for your personal, non-commercial use on a compatible mobile device owned or controlled by you.
This license is provided solely to enable your lawful use of the Service in accordance with these Terms and does not constitute a transfer of any ownership rights.
4.1 Prohibited Uses
The license granted to you under these Terms strictly prohibits the following:
Copying, reproducing, adapting, modifying, or creating derivative works based on any part of the Service, including the app’s source code, interface design, or visual content;
Decompiling, disassembling, reverse-engineering, or otherwise attempting to derive the source code or underlying architecture of the Service;
Distributing, sub-licensing, renting, leasing, or otherwise making the Service available to any third party without our express prior written consent;
Using the Service in a manner that infringes upon any intellectual property rights or proprietary rights of the Company or any third party;
Using any of our trademarks, logos, or brand identifiers without express, written authorization.
Any breach of these restrictions constitutes a material violation of these Terms and may result in the immediate suspension or termination of your access to the Service. We reserve the right to pursue legal remedies in the event of unauthorized use.
4.2 Third-Party Integration
Integration of the Service, or any part thereof, into another platform, product, or application—whether commercial or non-commercial—is strictly prohibited without obtaining our prior written authorization in the form of a separate commercial license agreement.
Unauthorized integration, resale, or redistribution of the Service or its components is a violation of these Terms and may result in legal action.
5. Eligibility and Age Restrictions
Access to and use of the TrustCall – ID & Spam Filter Service is subject to the following eligibility criteria. By using the Service, you represent and warrant that you meet the applicable age and legal requirements set forth below.
5.1 Minimum Age Requirement
You must be at least 13 years of age to access or use the Service. If you are between the ages of 13 and 18 (or the age of majority in your jurisdiction), you may only use the Service under the supervision and with the express consent of a parent or legal guardian.
If the laws of your jurisdiction impose a higher minimum age for lawful use of online services without parental consent, then such higher minimum age shall apply.
5.2 Enforcement of Age Compliance
We take age-related compliance seriously. If we become aware that a user who does not meet the minimum age requirements is using the Service without verified parental or guardian consent, we may:
Immediately suspend or terminate the user’s access to the Service;
Delete any personal data collected from that user in violation of applicable child data protection laws, including COPPA, GDPR-K, or equivalent regulations.
By using the Service, you affirm that you meet the age requirements outlined above and that you are fully able and competent to enter into and comply with these Terms.
6. Intellectual Property Rights
All content and components of the TrustCall – ID & Spam Filter Service—including, but not limited to, the software, source code, application interface, user experience designs, logos, graphics, text, icons, trademarks, service marks, databases, and related technology—are the exclusive property of AppSense Digital or its licensors and are protected under applicable intellectual property, copyright, trademark, and trade secret laws.
6.1 Ownership and Reservation of Rights
Except as expressly provided in these Terms, all rights, title, and interest in and to the Service and its content remain the sole and exclusive property of the Company. Nothing in these Terms shall be construed as granting you any license or right to use any intellectual property owned or controlled by the Company, whether by estoppel, implication, or otherwise, without our prior written consent.
6.2 Limited License for Use
Subject to your continued compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service solely for personal, non-commercial purposes. This license may be suspended or terminated at any time at our discretion for any breach of these Terms.
6.3 Prohibited Actions
You agree not to:
Reproduce, distribute, modify, adapt, translate, publish, or create derivative works from any part of the Service or its content;
Reverse engineer, decompile, disassemble, or otherwise attempt to extract the source code of the Service;
Sell, license, rent, lease, or otherwise exploit the Service or its features for commercial gain;
Use our trademarks, trade names, logos, service marks, or branding elements without our prior written consent.
6.4 Enforcement and Remedies
We reserve the right to enforce our intellectual property rights to the fullest extent permitted by law. Unauthorized use, reproduction, or distribution of any part of the Service may result in civil, administrative, or criminal liability. We may pursue injunctive relief, monetary damages, or other remedies as appropriate.
7. Access to and Use of the Service
Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, and revocable license to access and use the TrustCall – ID & Spam Filter Service for lawful, personal, and non-commercial purposes only.
7.1 Grant of Access
Access to the Service is provided on an “as is” and “as available” basis. Your continued access is conditioned upon your adherence to these Terms and all applicable local, state, national, and international laws and regulations.
We do not guarantee uninterrupted availability of the Service and may modify, suspend, or discontinue any part of it without notice.
7.2 Suspension or Termination of Access
We reserve the right, at our sole discretion and without prior notice, to suspend, restrict, or permanently revoke your access to all or part of the Service if:
You breach any provision of these Terms;
You violate any applicable laws or regulations;
You misuse, abuse, or interfere with the normal operation of the Service;
We are required to do so by law or due to legal or regulatory obligations.
7.3 Consequences of Termination
If your access to the Service is terminated for any reason:
Your license to use the Service shall immediately terminate;
You must cease all use of the application and delete it from your device(s);
Any rights, privileges, or features previously granted will be revoked with no liability or further obligation on the part of the Company.
We shall not be liable for any loss of data or damages resulting from such suspension or termination.
8. User-Provided Content and Data Responsibilities
The TrustCall – ID & Spam Filter Service may allow you to submit, upload, or transmit content, including but not limited to contact data, messages, call-related metadata, or call recordings. By providing such content, you accept the responsibilities outlined below.
8.1 Accuracy and Authorization
You are solely responsible for the accuracy, legality, and authorization of any content or information you submit through the Service. By submitting content, you represent and warrant that:
You have all necessary rights, consents, and permissions to provide such content;
Your content does not infringe upon any third party’s intellectual property, privacy, contractual, or other legal rights;
Your content does not disrupt, degrade, or negatively impact the performance or security of the Service or other users’ experience.
8.2 Collection of Technical and Usage Data
We may collect certain non-personal and device-related data in connection with your use of the Service, including but not limited to:
App usage metrics

All call recordings, if enabled, are stored locally on your device and are not transmitted to or stored on our servers. We do not access or retain this content.
8.4 License to Use Your Content
By submitting content to or through the Service, you hereby grant us a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable license to:
Use, reproduce, modify, adapt, publish, display, and distribute such content for operational, support, and product improvement purposes;
Incorporate the content into other materials, services, or analytics, provided such use complies with our Privacy Policy.
This license shall remain in effect even if you cease using the Service or delete your account or data.
9. Third-Party Services and External Links
The TrustCall – ID & Spam Filter Service may include links to, integrations with, or references to third-party platforms, services, websites, or content (collectively, “Third-Party Services”) for the purpose of enhancing your user experience or providing optional features.

10. Service Availability and Disclaimer
The TrustCall – ID & Spam Filter Service is provided on an “as-is” and “as-available” basis, without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
10.1 Service Interruptions
We do not warrant that access to the Service will be uninterrupted, timely, secure, or error-free. Periodic maintenance, technical updates, third-party outages, or unforeseen events may cause temporary disruptions or the unavailability of certain features or functionalities.
You acknowledge that we shall not be liable for any delays, outages, losses, or damages arising from such interruptions.
10.2 Accuracy of Information
While we strive to provide reliable caller identification, spam detection, and SMS filtering features, we do not guarantee the completeness, timeliness, or accuracy of:
Caller names or identification data
Spam risk ratings
Phone number classifications
SMS categorization or filtering
You understand and agree that caller information displayed by the Service is derived from third-party databases and algorithms, and may not always be accurate or up to date.
Use of the Service is at your own discretion and risk.
11. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms, the Privacy Policy, or your use of the Service shall be subject to the exclusive jurisdiction of the competent courts located in New Delhi, India.
You hereby irrevocably consent to the jurisdiction and venue of such courts for the resolution of any such disputes.
12. Indemnification
You agree to indemnify, defend, and hold harmless AppSense Digital, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, expenses, or costs (including reasonable legal fees) arising out of or in connection with:
Your violation of these Terms or applicable laws;
Your misuse, abuse, or unauthorized use of the Service;
Your infringement or violation of any third-party rights, including intellectual property, privacy, or contractual rights.
This indemnification obligation will survive the termination or expiration of your use of the Service.
13. Limitation of Liability
To the maximum extent permitted by law, AppSense Digital shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from or related to:
The use or inability to use the Service;
Any loss of data, profits, business opportunities, or device malfunctions;
Unauthorized access, breaches, or alterations to your data;
Reliance on the accuracy or completeness of caller identification or spam ratings;
Content, services, or actions of any third party linked or integrated with the Service.
You agree that your sole and exclusive remedy for any dissatisfaction with the Service is to stop using it.
14. Advertisements and Promotional Content
The TrustCall – ID & Spam Filter Service may display advertisements, sponsored content, or promotional offers from third-party advertisers in order to support the free version of the app.
14.1 Third-Party Advertisers
These advertisements may link to external websites, products, or services that are not owned or operated by us. We do not control, endorse, or guarantee the offerings or practices of these third-party advertisers and disclaim any responsibility for their content, availability, accuracy, or security.
14.2 User Assumption of Risk
Your interactions with third-party ads, including visiting third-party sites or participating in promotional offers, are solely at your own risk. You are strongly encouraged to review the terms and privacy policies of those third-party entities before engaging with their content or services.
15. Changes to These Terms
We reserve the right to update, modify, or revise these Terms at any time to reflect changes in legal requirements, service functionality, or business practices.
When changes are made, the updated Terms will be published within the application and/or on our website, along with the revised “Last Updated” date.
Your continued use of the Service following any such changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must discontinue use of the Service immediately.
