Complaints
The Transportation Supervisor and Bus Drivers should make complaints or problems known to one another and make every attempt to rectify matters. If possible, all complaints should be in writing.
The Transportation Supervisor is to discuss all complaints with the Driver involved, must secure the Driver’s signature indicating that the complaint was discussed with him/her, and must file all complaints in the Driver’s file. (See also KF and KFB)
Discipline of School Bus Drivers
The Transportation Supervisor and/or Secretary Treasurer’s may suspend any Bus Driver of the School Division until the first Board meeting following the suspension, for a preventable accident and/or violation of any provision of the Highway Traffic Act, Manitoba Regulation 465/88, or for failure to comply with policies of the School Board or the orders and directions of the Transportation Supervisor, Secretary Treasurer, a Peace Officer or a representative of Manitoba Education. The Transportation Supervisor or Secretary Treasurer will confirm the suspension in writing to the Driver, will notify the ward Trustee(s) immediately, and will make a report to the Board at the next meeting of the Board regarding the suspension and the facts.
The Board may suspend, with or without pay, a Driver for a preventable accident and/or violation of any provision of the Highway Traffic Act, Manitoba Regulation 465/88, or for failure to comply with Board policy or the orders and directions of the Transportation Supervisor, Secretary Treasurer, a Peace Officer, or representative of Manitoba Education.
Any suspended Driver shall have the right to present his/her case to the Board before any final decision is rendered. The Driver is entitled to have legal counsel present at the meeting.
A third preventable accident and/or reported and confirmed violation of the Highway Traffic Act, Manitoba Regulation 465/88, or failure to comply with the orders and directions of the Transportation Supervisor, the Secretary Treasurer, or a representative of Manitoba Education, within a 3 year period; or two violations within a 12 month period; shall result in a Driver’s termination of employment with the Prairie Spirit School Division.
Any Driver suspected of drinking alcoholic beverages within 8 hours prior to the time of driving a school bus, or who is suspected of using cannabis or illegal drugs, may be suspended from driving responsibilities immediately by the Transportation Supervisor or the Secretary Treasurer.
NOTE: The above refers primarily to accidents and/or violations while driving a school bus. Other violations appearing on the Driver’s abstract will be taken into consideration in a review.
Termination of Employment
Employment of Bus Drivers may be terminated by
Mutual agreement of the Bus Driver and the Board;
Written notice given by either party at least one pay period (one month) prior to the effective date of such termination (see Sec 61 of the Employment Standards Code);
Where the Board deems the behaviour of the Bus Driver to have been insubordinate or dishonest (Sec 62(h) of the Employment Standards Code) instant dismissal will occur without remuneration in lieu of notice.
NOTE:
In the event of a Driver dismissal, the Driver will retain the right to a hearing of the Board and to be represented by legal counsel.
The Board reserves the right to alter any of the foregoing penalties depending upon the length of the Driver service, driving record, Driver attitude, and severity of the offence.
