“Except as otherwise provided in paragraphs (2) and (3) of this subdivision, parents or other persons in parental relation to a student of compulsory school attendance age shall annually provide written notice to the superintendent of schools of their school district of residence of their intention to educate their child at home by July 1of each school year. The school year begins July 1 and ends June 30 for all purposes within this section. In the case of the City School District of the City of New York, the school district of residence for students who, if enrolled in the public schools, would attend elementary school, intermediate school or junior high school in a community school district, shall be deemed to be the community school district in which the parents reside.”
What is the timeline for the intent letter?
Due July 1 or within 14 days after commencing home instruction
Please contact your district’s registrar to establish residency within the school district if you have not already done so. Districts may also request evidence of compulsory age.
Within 10 days of BOCES receiving the letter of intent, BOCES must respond with a copy of the regulations and an IHIP form.
What is compulsory age?
All youth who become six years of age on or before December 1st in any school year are required to attend upon full-time instruction. All minors are required to remain in attendance during any given school year until the last day of session in the school year in which they turn sixteen years of age except as otherwise provided in EL §3205(3). In other words, young adults who turn sixteen on or after July 1st must continue full-time instruction through June 30th after their sixteenth birthday.
Once your child turns 16 and completes that year of schooling, it is your choice to submit paperwork or not, even if he/she continues with home instruction.
What if I want to start schooling my child BEFORE the compulsory date?
Schools are not required to respond to your paperwork. There is no requirement thus no judgment of compliance. Each district can determine if they will accept paperwork before compulsory age.
