I AM NOT PRETENDING I UNDERSTAND THE BATTLE ON THIS MORNING'S HOUSE TAX COMMITTEE AMENDMENT TO SB151, BUT HERE'S WHAT IT DOES:
Decoupling from federal corporate income tax changes
By decoupling from 3 new federal corporate income tax provisions and conforming to one passed in the One Big Beautiful Bill Act (OBBBA), the bill created capacity for the expenditures included in the package. This protects an estimated $121.5M in revenue annually.
A series of tax credits and deductions
Physician Tax Credit
Extended the sunset for High Wage Jobs Tax Credit (added in HTRC)
Local Journalist and Local News Printer Tax Credit
Construction Materials GRT Deduction
The HTRC amended in a 1% salary increase for all NM state workers that was cut from HB 2 in SFC.
HTRC added sunset clauses to all to the credits and deductions (previously, some did not have end dates), made some components effective in FY 27 and others effective in FY 28, and took out the Healthcare Equipment GRT Deduction that was included in the Senate version.
The tax package is likely to come out close to revenue neutral between the decoupling provisions that raised capacity and the included tax expenditures and appropriation for salaries.

About the original version: Similar to HB194, SB283 likely seeks to avoid property tax increases by making an entire metro area a Metro Redevelopment Zone. So, housing receiving the tax abatement doesn't have to go into areas of a city that need some love. More importantly, only 15% of multi-family units in a complex would need to be affordable -- defined as b/w 70% and 95% AMI. That completely leaves out our extremely and very low income (30% and 50% AMI, respectively) folks that are (a) are most in need and (b) most likely to lose housing. Additionally, there is ONE particular developer that builds for exactly 95% AMI. AN ACTUAL MRA affordable REdevelopment build in Albuquerque requires 80% of all units in a multi-family to be affordable. So, 80% of the units versus 15% of the units.

It has been flagged in at least a couple of subsequent presentations. I, therefore, think it will be pulled back in. BUT:

Please also encourage them to include eviction cases from owned/mortgaged manufactured housing under this program
I haven't researched whether this is statutorily possible, but it is definitely something to explore to stop the bleeding

$1M for down payment assistance for medical residents (so to get/keep doctors)

3 to 1 match requirement
If that possible amount is used for tribal housing, leaves
$25M to the NM Housing Trust Fund for affordable and attainable housing. "Attainable" means market rate.

OVERALL APPROACH
Increase the size of the pie
Currently only about 1% of the House recommended budget
When the feds are trying to back out of this work/support
The HAFC Housing Workgroup originally had $115M attributed, so there is a loss of $15M to recover
$5M in rental assistance will not go too far
This year's amount is at least $20M than last year though we are further into the Housing Crisis
Perhaps they should consider creating a rental assistance fund
Through any of the 3 entities, additional funding should be directed to those at the precipice -- the unhoused and the extremely low-income (30% AMI and below)
If the legislature wants to reach those folks via grants, it needs to say so in the HB2 language
Appropriate GRO dollars to promising, innovative homelessness to housing projects

We need folks to pay attention to this. Originally, this bill was seen as an industry end-run around property tax increases, essentially turning all of CABQ into an MRA zone, and really only benefittng one specific developer
Owners were already not reporting multi-family complex valuations to the County Assessor at any time-of-sale as required
There is now an in-depth substitute
We need to understand who this benefits

They mentioned that this program is supported by a $170M Consumer Settlement Fund

Please also encourage them to include eviction cases from owned/mortgaged manufactured housing under this program
I haven't researched whether this is statutorily possible, but it is definitely something to explore to stop the bleeding

Housing NM (formerly MFA) is increased from $20M to $40M, going through DFA first, but still has earmarks:
$10M (or possibly "up to" $10M) for down payment assistance for starter homes (I believe this is for AFFORDABLE housing) -- if HB200 passes
Same as workgroup recommendation
Does MFA still get if HB200 does not pass???
$5M for rental assistance (this was broad language under workgroup recommendation, so that it would covers direct payment, vouchers, transitional, etc.)
Same as workgroup recommendation but moved from DFA/DWS to MFA

$30M to DFA (then probably to DWS, but not for certain) for "housing, affordable housing, transitional housing, homeless initiatives, and expansion of housing services statewide" (regional housing projects), down from overall of $55M in workgroup recommendation

Now we understand that THERE ARE SOME HOMELESSNESS DOLLARS in the $40M chunk of the appropriation to DFA (which probably then goes to DWS)
Unclear if there is a particular amount allocated to substitute for lost CoC dollars (unclear to me, at least. Someone else might have a better grasp of this.)
PLUS the ~$10M HCA dollars referenced below
Not sure if they are going to change that language or move (part of) it to DFA/DWS or MFA
RIGHT NOW, AS WE UNDERSTAND IT, THERE ARE NO DOLLARS TO COVER THE FEDERAL HOMELESS SERVICES DOLLARS THAT LIKELY WILL BE LOST UNDER THE NEW FEDERAL COC NOFO (LITIGATION WILL NOT COMPLETE UNTIL AFTER SESSION)
We THINK legislators are viewing housing dollars as encompassing homelessness, and we believe that actually is not the case
They mentioned $10M in unspent HCA funds for unhoused folks with behavioral health or substance use disorder problems. Of course, not all unhoused folks are suffering these issues.
Recommended increasing overall Housing (NOT Homelessness) spend to $115M from $100M. LFC originally proposed all $100M to Opportunity Enterprise Fund of NM Finance Authority (different entity than Housing NM, formerly MFA).
$55M to DFA (probably then to DWS, but that is not a 100% certainty), including:
$40M for localities for regional housing projects (like the $110M from last year)
$10M for housing and infrastructure on tribal lands (requires consultation with Indian Affairs Dep't)
$5M for rental assistance. Broad language, so covers direct payment, vouchers, transitional, etc.
Total of $40M to OEF for infrastructure support and new/market rate housing (not AFFORDABLE housing)
Total of $20M to Housing NM, formerly MFA. The following earmarks are SUBTRACTED from that $20M.
$10M (or possibly "up to" $10M) for down payment assistance for starter homes (I believe this is for AFFORDABLE housing) -- if HB200 passes
$500K for administration of the Affordable Housing Act -- if HB140 passes
$1M for UNM Medical School graduates for down payments, to keep doctors here
So, likely only $9.5M then goes to the NM Housing Trust Fund
UNLESS the bills don't pass, then all of the money still goes to Housing NM
Keep in mind that Housing NM will bring in about $51M from severance tax bonds over the year, HOWEVER, STB money is not flexible/only for bricks and sticks
General fund dollars appropriated into the NM Housing Trust Fund, ON THE OTHER HAND, are more flexible, though they have a 3 to 1 match requirement
Housing NM is seeking $135M into the NM Housing Trust Fund (HB140), so this is quite a bit less
ADDITIONALLY, general fund appropriations "to DFA for MFA to administer for [EXAMPLE - homelessness and homelessness prevention services" IS THE MOST FLEXIBLE type of MFA funds
