HIB INVESTIGATION STEPS
HIB complaint filed using the 2023-24 NJDOE Required Staff Reporting Form (Staff must use) District/school staff cannot anonymously report allegations of HIB and, in fact, must submit the HIB 338 Form to the principal within two school days of witnessing or receiving reliable information that a student has been subject to HIB (N.J.S.A. 18A:37- 15b(5)). This form shall be completed even if a preliminary determination is made under the district's policy that the reported incident or complaint is a report outside the scope of the definition of HIB.
Required investigative procedures shall continue after the submission of this form to the school principal.
The completed form must be kept on file in the school.
The principal must promptly submit a copy of this form to the superintendent.
Principal/Anti-Bullying Specialist (ABS) initiates investigation within 1 day and responds to Code of Conduct issues
ASB leads investigation (10 school days to complete)
ABS writes HIB Report (within 2 school days of completing investigation)
Superintendent affirms/rejects HIB response once reviewed prior to that month's Board meeting.
Board of Education informed of incident no later than the next scheduled Board meeting.
Parent/Guardian notified of outcome, right to a Board hearing (within 5 days of the Board being informed)
Limited Information and Student Privacy Laws: Due to student records and privacy laws and regulations, parents are only entitled to review their child’s educational records; a parent is not entitled to view the records of other students. This means that parents are not permitted to receive the entire HIB investigation report if it in any way would identify a student other than their own. If parents believe they are entitled to more information than has been provided by the school district, the parents may request a hearing before the board of education. The process for the board hearing and other options available to parents are explained in the following section (Based on 20 U.S.C. §1232g, the Family Education Rights and Privacy Act, and N.J.A.C. 6A:32-7, Student Records).
