Tip of the Season

The weather is getting chilly. We have already had snow. What if ---- we get a snow day!? Then the calls come in – “Do I get an extra day to: a) hold an IEP meeting? b) to complete and mail out the evaluation report? c) to finish and send out the IEP? The answer to these questions is a resounding “It depends.” It depends on whether the deadline is a calendar-day deadline (must have an IEP meeting annually; must complete an evaluation every 3 years) or a school-day deadline (must complete and mail out an IEP within 10 school days of the IEP meeting; must complete and mail out an evaluation report within 30 school days of parent consent to the evaluation plan). So the answers to the above questions are:

  • Do I get an extra day to hold an IEP meeting? No. You must hold an IEP meeting at least every year (365 calendar days). If the team waited until the 365th day to hold the IEP meeting and it was a snow day, the IEP meeting will be held late.
  • Do I get an extra day to complete and mail out the evaluation report? Maybe. Which deadline is controlling; the 3-year deadline (a calendar-day deadline, no extra day) or the 30 school-day deadline (yes, you get an extra day).
  • Do I get an extra day to finish and send out the IEP? Yes, this is a 10 school-day deadline and a snow day is not a school day. You get one extra school day.
