1. Definitions. "Agreement" means all the terms and conditions on this form page and any other documents you sign or Mambo Rentals LLC give you at the time of rental. "You" or "your" refers to the person listed as the renter or additional renter on this form, all Authorized Drivers, and any person or organization billed by us at their or the renters’ direction. All persons referred to as "you" or "your" are jointly and severally bound by this Agreement. "we", "our", or "us" means the business renting the Trailer to you (Mambo Rentals LLC). "Authorized Driver" means you and any additional driver listed by us on this Agreement. "Trailer" means the non-motorized trailer identified in this Agreement and any substitute trailer. "Loss of Use" refers to our inability to use the Trailer for any reason due to damage or loss during this rental. Loss of Use is calculated by multiplying the number of days from the date of loss or damage until the Trailer is replaced or repaired by the daily rental rate. "Diminished Value" means the difference between the trailer's actual cash value just before damage or loss minus its value after repairs, or if Mambo Rentals LLC decides not to repair it, the difference between its actual cash value and salvage or sale value.
2.Rental, Indemnity, and Warranties. This is a rental contract for the Trailer. Trailers are regularly inspected and maintained for safety reasons. Mambo Rentals LLC may repossess the Trailer at your expense without notice if it is abandoned or used in violation of law or this Agreement. You agree to indemnify, defend, and hold us harmless from all claims, liabilities, costs, and attorney fees resulting from or arising out of this rental and your use of the Trailer. MamboRentals LLC makes no warranties, express, implied, or apparent, regarding the Trailer, including no warranty of merchantability or fitness for a particular purpose.
3.Condition and Return of Trailer. You must return the Trailer to the specified location on the agreed date and time, in the same condition as received, except for normal wear. If returned after hours, you remain responsible for its safety and any damages until inspected during our next business hours. Repairs or accessory replacements require our prior approval.
4.Responsibility for Damage or Loss; Police Reporting. You are responsible for all damage to or loss of the Trailer, including damage caused by weather, road conditions, or acts of nature, whether or not you are at fault. You are liable for repair costs or actual retail value if unrepairable or if Mambo Rentals LLC chooses not to repair. You are also responsible for Loss of Use, Diminished Value, missing equipment, and a reasonable administrative fee for claims. All accidents must be reported to us and the police within 24 hours.
5.Prohibited Uses. The following uses are prohibited: (a) transporting dangerous, hazardous, or illegal items; (b)transporting living persons; (c) towing the Trailer while under the influence of drugs or alcohol; (d) allowing non-rentersor unauthorized drivers to tow; (e) using false or misleading information to extend rental; (f) using the Trailer for illegalpurposes or in violation of law; (g) using outside the U.S. or Canada; (h) overloading beyond capacity; (i) towing throughor under structures without proper clearance; (j) operating the Trailer when it’s reasonable to expect damage; (k)insecurely secured cargo causing damage; (l) damaging the Trailer intentionally, recklessly, or willfully; and (m) defacingthe Trailer with signs, lettering, or paint. Violation of any prohibited use voids insurance coverage and renter assumes fullliability.
6.Insurance. Mambo Rentals LLC provides primary collision and comprehensive coverage. The coverage applies only to the Trailer itself and does not extend to any cargo, personal property, or contents placed inside the Trailer. The renter may choose to accept this coverage or decline it by providing proof of active personal or commercial insurance that includes coverage for the rented trailer during the rental period. Proof of coverage must be provided before the rental begins and MamboRentals LLC reserves the right to verify such coverage with the renter’s insurer. Regardless of coverage option, liability insurance for third-party injury or property damage must be provided by the motor vehicle insurance policy covering the towing vehicle.
7. Charges. You agree to pay on demand all charges including: (a) time and mileage during rental; (b) applicable taxes; (c) violations, fines, penalties, court costs, towing, storage, and other expenses; (d) costs for retrieving the Trailer if not returned as agreed; (e) costs for collecting payments or enforcing rights, including legal fees; (f) a late fee, if applicable; (g) $100 or law’s maximum for bounced checks; and (h) up to $500 for cleaning if returned significantly dirtier. Time and mileage charges won’t be refunded if you return early.
8. Card on File. Mambo Rentals LLC may use your card on file to cover amounts owed under this Agreement, including estimated damages.
9. Modifications. No part of this Agreement can be waived or changed unless in writing signed by us. This document represents the entire agreement between you and us. All prior representations and agreements are merged into this Agreement.
10. Waiver. A waiver by us of any breach does not imply waiver of future breaches or obligations. Acceptance of payment or failure to enforce any part of this Agreement does not waive other rights. You release us from liability for consequential, special, or punitive damages related to this rental or trailer reservation. If any part is deemed invalid, the rest remains enforceable.
