Terms of Service for HeicDrop

Welcome to HeicDrop. These Terms of Service ("Terms") govern your use of the HeicDrop iOS application (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acknowledgment

These are the Terms and Conditions governing the use of this App and the agreement that operates between you and HeicDrop. These Terms and Conditions set out the rights and obligations of all users regarding the use of the App.

Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App.

2. License to Use the App

HeicDrop grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App for your personal, non-commercial purposes strictly in accordance with these Terms.[1] This license is for the sole purpose of enabling you to use and enjoy the benefit of the services provided by HeicDrop, in the manner permitted by these Terms.

3. Prohibited Uses

You agree not to, and you will not permit others to:

• License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the App or make the App available to any third party.

• Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the App.[1]

• Remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) of HeicDrop or its affiliates, partners, suppliers, or the licensors of the App.

• Use the App for any illegal purpose, or in violation of any local, state, national, or international law.[1]

• Use the App to send automated queries to any website or to send any unsolicited commercial e-mail.

• Use the App in any way that could harm the App, or interfere with any other party's use of the App.[2]

4. Intellectual Property

The App, including its original content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by HeicDrop, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.[2] You may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information.

5. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.[3]

Upon termination, your right to use the App will cease immediately.

6. "AS IS" and "AS AVAILABLE" Disclaimer

The App is provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, HeicDrop, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the App, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage, or trade practice.

Without limitation to the foregoing, HeicDrop provides no warranty or undertaking, and makes no representation of any kind that the App will meet your requirements, achieve any intended results, be compatible or work with any other software, applications, systems, or services, operate without interruption, meet any performance or reliability standards, or be error-free, or that any errors or defects can or will be corrected.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall HeicDrop or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the App, third-party software and/or third-party hardware used with the App, or otherwise in connection with any provision of this Terms), even if HeicDrop or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.[1]

8. Governing Law

The laws of the jurisdiction in which HeicDrop is based, excluding its conflicts of law rules, shall govern this Terms and your use of the App. Your use of the Application may also be subject to other local, state, national, or international laws.

9. Changes to These Terms of Service

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify you of any changes by posting the new Terms of Service within the App.

You are advised to review these Terms periodically for any changes. Changes to these Terms are effective when they are posted. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
