I. Acceptance of Terms
By downloading, installing, accessing, or using the Arabia Cars mobile application (the "App" or "Application") operated by Kaldtech Technologies L.L.C ("Company", "We", "Us", or "Our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not download, install, or use the Application.
We reserve the right to modify these Terms at any time. Your continued use of the Application after such modifications constitutes your acceptance of the modified Terms.
II. Eligibility
You must be at least 18 years of age to use the Arabia Cars Application. By using the Application, you represent and warrant that:
- You are at least 18 years of age
- You have the legal capacity to enter into these Terms
- You will comply with all applicable laws and regulations
- All information you provide is accurate and current
III. Account Registration
To use certain features of the Application, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your account information to keep it accurate
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
We reserve the right to suspend or terminate your account if you provide false, inaccurate, or incomplete information, or if you violate these Terms.
IV. User Accounts and Seller Accounts
The Application supports two types of accounts:
A. Buyer/Customer Account:
- Allows you to browse and purchase cars, rent cars, book services, and purchase marketplace products
- Requires basic information (name, email, phone number)
B. Seller Account:
- Allows you to list cars for sale, offer car rentals, provide services, and sell marketplace products
- Requires additional verification, including ID proof
- Subject to approval by the Company
- Sellers must comply with additional seller policies and guidelines
Seller accounts are subject to verification and approval. We reserve the right to reject or suspend seller accounts at our sole discretion.
V. Use of the Application
A. Permitted Use:
You may use the Application to:
- Browse car listings, rental listings, services, and marketplace products
- Purchase cars, rent cars, book services, and purchase products
- List cars, offer rentals, provide services, and sell products (if you have a seller account)
- Communicate with other users through in-app messaging
- Access and manage your orders, wallet, and account information
B. Prohibited Activities:
You agree NOT to:
- Use the Application for any illegal purpose or in violation of any laws
- Post false, misleading, or fraudulent listings or information
- Infringe on any intellectual property rights
- Harass, abuse, or harm other users
- Transmit any viruses, malware, or harmful code
- Attempt to gain unauthorized access to the Application or its systems
- Use automated systems (bots, scrapers) to access the Application
- Interfere with or disrupt the Application's functionality
- Create multiple accounts to circumvent restrictions
- Sell or transfer your account to another person
- Use the Application to compete with our business
VI. Listings and Content
A. Listing Requirements:
- All listings must be accurate and truthful
- You must have the legal right to sell, rent, or offer the items/services listed
- Listings must comply with all applicable laws and regulations
- We reserve the right to remove any listing that violates these Terms
B. Content Ownership:
- You retain ownership of content you post on the Application
- By posting content, you grant us a license to use, display, and distribute such content on the Application
- You are responsible for ensuring you have the right to post any content you submit
C. Prohibited Listings:
You may NOT list:
- Stolen items
- Items that violate intellectual property rights
- Illegal items or services
- Items that violate local laws or regulations
- Fraudulent or misleading listings
VII. Transactions and Payments
A. Payment Processing:
- Payments are processed through Stripe, a third-party payment processor
- All transactions are subject to Stripe's terms and conditions
- We do not store your full payment card information
B. Pricing:
- Prices are set by sellers (for marketplace items, services, and rentals)
- Prices are set by the Company (for platform fees and services)
- We reserve the right to change prices at any time
- Prices displayed are subject to change until the transaction is confirmed
C. Fees:
- Platform fees may apply to transactions
- Fees will be disclosed before you complete a transaction
- All fees are non-refundable except as required by law
D. Refunds:
- Refund policies vary depending on the type of transaction
- Refunds are subject to the specific terms of each transaction
- We reserve the right to issue refunds at our discretion
- Disputes should be resolved directly with the seller when possible
VIII. Car Rentals
A. Rental Terms:
- Rental terms are set by the car owner/seller
- You are responsible for returning the car in the same condition as received
- You are responsible for any damage or loss during the rental period
- Insurance requirements are the responsibility of the renter
B. Cancellations:
- Cancellation policies are set by the car owner/seller
- Cancellation fees may apply
- Refunds for cancellations are subject to the cancellation policy
IX. Services
A. Service Bookings:
- Service providers set their own terms and pricing
- You are responsible for providing accurate information for service bookings
- Service quality and completion are the responsibility of the service provider
B. Home Services:
- Home services may require additional location and access information
- You are responsible for providing a safe and accessible location for service providers
X. Intellectual Property
A. Our Intellectual Property:
- The Application, including its design, features, and content, is owned by Kaldtech Technologies L.L.C
- All trademarks, logos, and service marks are our property
- You may not copy, modify, or distribute any part of the Application without our written permission
B. Your Content:
- You retain ownership of content you post
- By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use such content
XI. Privacy
Your use of the Application is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.
XII. Disclaimers and Limitation of Liability
A. Disclaimer of Warranties:
- The Application is provided "AS IS" and "AS AVAILABLE"
- We do not guarantee that the Application will be uninterrupted, error-free, or secure
- We do not warrant the accuracy, completeness, or usefulness of any information on the Application
B. Limitation of Liability:
- To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages
- Our total liability is limited to the amount you paid to us in the 12 months preceding the claim
- We are not responsible for transactions between users
- We are not responsible for the quality, safety, or legality of items or services listed
C. Third-Party Services:
- The Application may contain links to third-party services
- We are not responsible for third-party services or their content
- Your use of third-party services is at your own risk
XIII. Indemnification
You agree to indemnify, defend, and hold harmless Kaldtech Technologies L.L.C, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Application
- Your violation of these Terms
- Your violation of any rights of another party
- Content you post or transmit through the Application
XIV. Termination
A. Termination by You:
- You may stop using the Application at any time
- You may delete your account through the Application settings
B. Termination by Us:
We may suspend or terminate your account and access to the Application immediately, without notice, if:
- You violate these Terms
- You engage in fraudulent or illegal activity
- We suspect fraud or misuse
- Required by law or legal process
- For any other reason at our sole discretion
C. Effect of Termination:
- Upon termination, your right to use the Application ceases immediately
- We may delete your account and data
- Provisions that by their nature should survive termination will survive
XV. Dispute Resolution
A. Governing Law:
These Terms are governed by the laws of the United Arab Emirates, without regard to conflict of law principles.
B. Disputes:
- You agree to first contact us to resolve any disputes
- If a dispute cannot be resolved, it shall be resolved through binding arbitration in Dubai, United Arab Emirates
- You waive any right to a jury trial or to participate in a class action lawsuit
XVI. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes through the Application or via email. Your continued use of the Application after such changes constitutes acceptance of the modified Terms.
XVII. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
XVIII. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kaldtech Technologies L.L.C regarding your use of the Application and supersede all prior agreements.
