1. Introduction

 These Terms of Use govern your access and use of the website www.smgoldpalace.com and related services provided by SM GOLD PALACE (SMGP), a proprietorship firm located at Robertsonpet, KGF, Karnataka.

 By using the Platform, you agree to be bound by these Terms. 

2. Services

 SMGP offers:

• Purchase of 24K (99.9%) Gold and Silver

• Secure vault storage

• Sale-back option

• Delivery of physical gold/silver

• Transfer/gifting facility

All services are provided on an “as is” and “as available” basis.

3. Account & KYC

• Users must register and provide accurate details.

• KYC documents may be required, especially for transactions above ₹50,000.

• SMGP may suspend or terminate accounts with incorrect or suspicious information.

4. Purchase of Gold/Silver

• Minimum purchase starts from ₹1.

• Prices are market-linked and may change multiple times daily.

• Orders cannot be cancelled once payment is successful.

• Free storage is available for 1 year (from 1 January 2026).

• After the free period, storage charges will apply.

5. Storage & Vault

• Gold/Silver is stored in insured, secure vaults.

• Customers must take delivery within the maximum storage period.

• If unclaimed beyond the grace period, metal may be sold and proceeds transferred as per policy.

6. Delivery

• Delivery requests must meet the minimum threshold quantity.

• Delivery is processed within 5 business days and shipped in 7–8 working days.

• Customers must inspect packages before accepting.

• Incorrect address details are the customer’s responsibility.

7. Sale of Gold/Silver

• Customers can sell gold after a 48-hour lock-in period.

• Minimum sell quantity: 1g gold, 10g silver.

• Sale proceeds are transferred to the registered bank account within 6–7 business days.

8. Fees & Charges

• Applicable taxes and charges apply as per government norms.

• Storage charges may be deducted from the metal balance.

• All payments are in INR.

• Fees once paid are non-refundable.

9. Fraud & Security

• Do not share OTP, UPI PIN, or wallet details.

• SMGP is not liable for fraud caused by customer negligence.

• Suspicious accounts may be frozen or investigated.

10. Force Majeure

 SMGP is not liable for delays or failures due to events beyond its control (natural disasters, government actions, technical failures, etc.).

11. Limitation of Liability

SMGP:

• Does not guarantee returns.

• Is not liable for price fluctuations.

• Is not responsible for technical errors or third-party service failures.

• Shall not be liable for indirect or consequential damages.

12. Governing Law

• Governed by the laws of India.

• Jurisdiction: Courts of Karnataka.

• Arbitration venue: KGF, Karnataka.

13. Eligibility

• Only Indian residents aged 18+ with a valid PAN and ID can use the Platform.

14. Amendments

 SMGP may update these Terms at any time. Continued use of the Platform means acceptance of updated Terms.
