Terms and conditions Healing India

We value our customers and are pleased to provide the following terms and conditions which become applicable upon acceptance of any quote/invoice provided to you or upon booking a ticket to a class or program. Terms & Conditions

POSTAGE: Shipping Policy: Once item has been purchased, shipping tracking will be provided to the customer. Postage is from Perth, WA. We will do our best to assist you in resolving any postage delays, damages and undelivered items as per Australia Post limitation but we are bound by their (Aus Post) carrier terms and conditions. Reasonable care is taken in packing and posting of your items.

Materials & designs: Products and materials used: Healing India Creative Arts is a sustainable business using a range of Repurposed, recycled and up-cycling principles in workshops and in designs for sale. As such, the workshop and design materials will change consistently to keep in line with using at hand suitable sustainably obtained materials. Please note that materials may not be suitable for you, please ensure that you only use materials that are suited. Unless otherwise stated, materials used are for adult usage only and may contain small parts, please keep materials away from children.

Images are examples or samples only and don't indicate an exact design to be made in any workshop including sizes. As everyone will work at a different pace in workshops/classes, you may need to make time to complete your item/design at home. 

Our Gift store designs are of exact product designs except for kits which are different given the materials which are at hand.

Should specific materials not be available in time for any workshop, we reserve the right to provide an alternative as close as we possibly can source/provide to be used in your workshops.

Gift certificates: Gift certificates may only be used in one single transaction and cannot be exchanged for cash or any other credits. No exchange or refund will be provided.  Gift Certificates may be used for goods or services of a higher value, on payment of the difference. No expiry date is on our certificates.

Advertising and marketing for cross-promotion: Healing India Creative Arts supports the cross-promotion of workshops and classes that we facilitate on your Organisations/Centres behalf. We will cross-promote using your Social media posts and by adding ours on our Social Media pages in order to promote to a larger audience. Please advise us via email if you do not wish for cross-promotion or if you have specific content you wish us to use. We may use photos of designs created at our classes across our social media and in future marketing pages, please advise if you do not want your designs to be shared on our social media pages or used in future marketing images.

Refunds

As per WA Consumer Law (ACL) within Western Australian Jurisdiction.

Other than these terms and conditions, any project specific Contract terms for services / Cancellation / Return / Exchange Policies will be outlined on your quotes & invoices.

Quotes/Materials cost increases

We source our materials from mainly Australian-based suppliers and do our best to seek the best prices to keep our materials costs down. We are proud to offer you reasonable and equitable priced materials for your workshops and to do so the following terms become applicable to our quotes upon acceptance/booking made:

Materials are quoted as of the day you request a booking/quote for a workshop for your specified workshop/class date and quoted prices are valid for confirmation of booking within 14 days of quote being provided. Should you wish to increase/decrease your originally advertised/enrolled participant numbers, workshop length times, or numbers of workshops scheduled, following your original workshop booking, please note that there may be a quote increase required to reflect this. As prices can fluctuate for materials, this ensures that we can continue to offer well priced equitable materials for your workshops. We will purchase your materials as soon as you make your booking (or within 6 weeks of the booking date, whichever is earlier) to ensure postage delivery times) and we cannot envision pricing increases which occur thereafter these timeframes. Thank you for your understanding. 

Cancellation Policy for our workshops, classes & programs including ticket purchases: Please note our bookings terms & conditions which become applicable once you make a booking/purchase a ticket to a class or workshop/or for quotes, upon acceptance of our quote. Please note your ticket, invoice or quote may have other specific terms too.

For Venues contracting my services: Any workshop cancellation you make within 14 days of the 1st workshop booked date incurs a 50% of total quote payable fee to cover your materials purchase and/or prep and pack costs and times including administration time spent on organising your workshop(s). This may be more than 50% should your materials exceed 50% of the total quote.

For any cancellations you make within 21 days to 15 days of your 1st workshop date incurs a 25% of the total quote payable to cover administration and prep times and costs. This may be more than 25% should your materials exceed 25% of the total quote.

For any cancellations made from the date of acceptance of your quote/booking made date until 22 days prior to your 1st workshop date will incur a 10% of the total quote amount as an administration fee. This may be more should your materials already be purchased for your workshop/class as per the Materials purchase terms and conditions outlined above.

Please note our agreed upon minimum cancellation dates/times and/or participant numbers will be charged regardless of your enrolments obtained/participants attendance. Thank you for your understanding. Please understand that we purchase pre and pack for each participant and participants non-attendance will still be payable as per the quoted/agreed upon attendance numbers.

For Individual Customers: Tickets to our classes & workshops:

Please note our ticket booking terms and conditions: As I purchase prep and pack for your ticket purchased, and have to sell a minimum number of tickets for a class to go ahead, refunds including for non-attendance or change in circumstances, cannot be offered. If you cannot attend your booked class, please feel free to pass your ticket on to someone. 

Alternatively, I can offer you your materials kit and an instruction guide for the missed workshop, or as goodwill where possible, I may be able to provide you with 1 option to reschedule your class date only once (to the same value class) for an upcoming (within 2 months) scheduled class date should one be available; this option is only for the available scheduled class date, should one be available. which will be offered to you.

I appreciate your understanding.

Late unpaid outstanding invoices: Will incur an add 5% to your total invoice amount fee per week to cover our administration; account payable date and any other terms will be stated on your invoice and quote. Please read through these terms and conditions and also any terms and conditions and dates outlined on your quote and invoice to ensure you understand and are agreeable to our booking terms and conditions which become enforceable upon accepting our quote and/or making a workshop booking date.

Product, instructions, workshops, classes, programmes, materials, kits usage:

Please note that the above is suitable for adult use only unless otherwise agreed in writing. Please refer the our Waiver agreement document below for further details. 

Privacy & Our content

We do everything possible to protect consumers information and online safety including use of anti-virus software across our technology, by requesting your permission to email you and to opt out at any time via our Mailchimp Mail list should you sign up to our newsletter, by only using Australia Post tracked postage, by collecting payments via PayPal or as invoiced via Bank deposits to our account, by the use of ZOOM or Google Meets online video platform for online workshops, by constantly following The Australian Guidelines for Electronic Commerce, updating our Privacy eCommerce and standard service delivery policies.

We will use your provided email address that you have provided to us to only communicate with you in regards to your services or goods being provided. We use Google Mail for this purpose.

Our services and goods are suitable for adult use except where agreed upon in writing prior to any use/delivery.

Workshops/projects please note: where a participant has been part of attending a workshop or program conducted as a joint project with another service/organisation, and this participant is enrolled directly via that service/organisation or via Healing India Creative Arts, the participant may have provided contact information upon enrolment and workshop/project outcomes information thereafter if an evaluation is conducted and this may be jointly shared with Leisa and with the service/Organisation in order to conduct the workshop/project most effectively. This will always and only be with your consent and if required and in accordance with Privacy and any other Legislation. 

Healing India Creative Arts does its best in ensuring the information on our website is accurate, but we cannot be held liable for any information including our images not being read or interpreted as accurate. Any misuse or copying of our content contained in this website including stealing of our content and images is disallowed and subject to any governing laws which may apply. We reserve the absolute ownership of our website and training, workshops and course content. Please speak to Leisa for any further information.

Please be reminded that any interactions across our Social Media pages and in workshops are observable by public and other attendees and are your responsibility to ensure you only disclose information that you wish others to know/see/read.

Waiver agreement document for all classes, workshops, projects and items:

Elizabeth (Leisa) Antonio of Lady Language Consultancy Services and Healing India Creative Arts welcomes you and thanks you in advance for reading, understanding and agreeing to the following:

OUR WAIVER & PRODUCT/WORKSHOP PURCHASE TERMS & CONDITIONS:

I understand that Elizabeth (Leisa) Antonio of Healing India Creative Arts & if relevant, of Lady Language Consultancy will explain to me how to:

• take reasonable care for my well-being whilst I am participating in any workshop or by the supply of any of creative art kits, instructions both written, in person and online video tutorial and materials and extending to any other areas of service and product delivery and supply.

• make reasonable efforts to minimise my exposure to known risks, and

• take precautions to avoid damage, harm or injury. 

I also understand, acknowledge and accept that there are / may be risks in some activities I am undertaking and that I have a personal responsibility to follow ALL general safety measures throughout each workshop I attend,  instructions both written, in person and online tutorial or use of our materials or creative arts kits. This includes all COVID19 personal safety obligations. I also understand that some materials/ingredients may not be suited to persons with allergies or sensitivities  or otherwise and that it is my responsibility to ensure the materials and ingredients are suitable for me. I understand that workshops, classes, instructions, materials and kits are for adult usage and attendance only  unless otherwise agreed upon in writing. 

The safety measures have been explained to me on my first workshop day and/or in the kit and/or written instructions guides and I agree that I have understood them all.  I accept full responsibility and liability for my own safety and well-being from the moment I arrive at and enter the premises being used by Elizabeth (Leisa) Antonio for the workshop activity or participate in use of any creative arts kits or written instructions guides.  This agreement extends to any child under my care attending the activity.

WORKSHOPS ACTIVITY INFORMATION USAGE:

I understand that information and instructions including handouts provided to me at my workshops are only for use at the workshops and agree that they are not to be relied upon as professional opinion or to be used for any monetary gain or copied and distributed for any purpose.  I further understand that the information and instructions are introductory only and are in no way expert advice and are only basic guidelines in using the fusing/ slumping and kiln-fired methods of glass making or other techniques/ workshops of glass arts or other creative arts and crafts, or any other workshops for the sole purpose of participating in the workshop activity.  I understand and agree that should I choose to continue glass art creations or self-teaching in any related glass art or any other craft form or any workshop or activity topic at any time following the workshops that I do this at my own risk and I will not place any responsibility on or seek to hold liable Elizabeth (Leisa) Antonio for anything whatsoever or howsoever arising. This agreement extends to any child under my care attending the activity. We ask that you do not take any photos or video recording at our classes without our permission to do so.

PRODUCTS: I understand that Elizabeth (Leisa) Antonio of Healing India may kiln fire my products or take on any other type of work on my products, although no guarantee can be made for my products/ designs turning out to my satisfaction.  No refund or reimbursement of any kind can be offered or is payable given the nature of the activities.

I understand that the products I make throughout any workshop held by Elizabeth (Leisa) Antonio and the materials and kit products are for my personal adult use. Should I engage in any sales of these products, I do this at my own risk.  I further understand and acknowledge that any future arising product liability is my sole responsibility and I release Elizabeth (Leisa) Antonio from any and all claims in any way relating thereto.  I understand that the products I make are made from new and repurposed or recycled glass, tiles, and other materials including some textiles, beads and metals, so I must take all reasonable care and responsibility when wearing, displaying and using the products and keep these out of children's reach or possession. This agreement extends to any child under my care attending the activity or where I display or keep my products.

WAIVER DECLARATION:

By signing/viewing and reading this waiver and agreement document, I agree that I am 18 years of age or older, that I am entering into this waiver on my own behalf or/and that of any child whom I am responsible for, that I have fully understood all information described herein and I voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify Elizabeth (Leisa) Antonio trading of “Healing India Creative Arts” and if relevant, also of "Lady Language Consultancy Services" and any volunteers or assistants from and for ANY and ALL CLAIMS including those of personal, professional, products and public liability claims, in contract, negligence or otherwise including but not limited to compensation claims for any damage or injuries, physical or mental, which I might incur as a result of my voluntary decision to participate in workshop or product purchase, written or online or video recorded or gifted activities or any service delivery or other operations operated by Elizabeth (Leisa) Antonio of Healing India Creative Arts or if relevant, Lady Language Consultancy Services. This agreement extends to any child under my care attending the activity and to the life cycle of my items.

OPTIONAL: I agree that I may be photographed throughout the workshop and such photos may be used for marketing including Facebook, Instagram, marketing, and Website pages at our absolute discretion.   Please speak to Leisa if you do not wish to have your photos taken and used for this purpose.  Thank you, Leisa (Elizabeth Antonio)
