Erin's Law
In 2014 the South Carolina Legislation passed Erin’s Law, as part of Comprehensive Health Education Act (SECTION 59-32-20 (B). The purpose of the law is to ensure that all students Pre-K through High School receive this prevention instruction during the academic school year. The intent of the law is to equip students with the knowledge and skills to remain safe from sexual assault and how to make a report if an assault occurs.
The state mandated Erin’s Law is yearly instruction that the district provides in various ways depending on the grade level. In GCS, instruction is provided by the school counselors in K- 8th, and by our district health ed teachers in 9th grade. Traditionally, we have sent a generic letter home every year providing information about Erin’s Law. When Erin’s Law was originally put into place in 2014, the district sent this letter home in efforts to be transparent and make parents aware of the new law. Now that we have provided this instruction for 7+ years, it is no longer new and many times the letter is mistakenly used as an “exemption form” or it has prevented the lessons from being taught on the scheduled date because the letters had not been sent home. Beginning the 2021-22 school year, all counselors will need to post the information below (letter also linked HERE/HERE) to their websites and send through Backpack to take the place of printing and sending it home.
Parent preview material will continue to be available for parents to view at the school, and we rely on the counselors professional judgement when it comes to individual situations where the lesson would be more harmful to a student than beneficial (i.e. a student that may be in different home because they experienced abuse by a family member).

In 2014, the State of South Carolina passed Act 293 known as “Erin’s Law,” as part of health and safety education for its public schools. The purpose of the law is to ensure all students, prekindergarten through high school, receive this prevention instruction during the academic school year. The intent of Erin’s Law is to give students skills in knowing how to stay safe from sexual assault and how to report any incidents of sexual assault. In addition, in 2023 Gavin’s Law was passed requiring local school districts to collaborate with the State Department of Education, the South Carolina Law Enforcement Division, and the Attorney General's office, to implement a policy to educate and notify students of the provisions of Gavin’s Law which educate students on how to identify sexual extortion.
Beginning in 2014, instructional units were written as a resource guide for teachers to implement Erin’s Law. In 2023, Gavin's Law instructional content was added to the already established Erin's Law lessons to include online safety for elementary students, implications of taking and sharing inappropriate pictures or videos electronically for middle school students, and implications of digital crimes and how to help victims of sexual extortion for high school students. These units are aligned with the South Carolina Academic Health and Safety Education Standards. Lesson content varies from grade to grade. A copy of each lesson is available at your child’s school for you to preview if you choose.
