Recommendations: AB2147 Expungement
1) Make expungement automatic for incarcerated firefighters to allow for EMT certification
2) Expand expungement through AB2147 to allow for expungement of prior offenses, not only one for which the person was serving their sentence at fire camp.
California Assembly Bill AB2147:
Expedited Expungement for Formerly Incarcerated Fire Camp Participants
This bill, passed in September of 2020, allows a justice-impacted individual who succesfully participated in the California Conservation Camp Program (colloquially Fire Camps) to be eligible for expungement of their offenses for which they were serving time when they attended the camp.
Limitations of AB2147
Expungement is not automatic… and only firefighters that participated in FIRE CAMPS are eligible. Support workers at fire camps are NOT eligible, nor are formerly incarcerated firefighters who worked in prison firehouses.
Individuals must return to the “county of commitment” to petition the court for an expungement, and the court can approve or deny petitions at their discretion.
The only conviction eligible for expungement is the one for which the person was serving their sentence at fire camp. Prior convictions remain on the record.
